The World Trade Center disability pension is a New York accidental disability retirement benefit for public employees who took part in 9/11 rescue, recovery, or cleanup work and later developed a qualifying illness. It generally pays 75 percent of final average salary, is exempt from federal income tax under the Victims of Terrorism Tax Relief Act, and rests on a legal presumption that shifts the burden of proving causation off the worker.1New York State Senate. Before anything else, be aware of one deadline. If you have not already filed a Notice of Participation with your retirement system, you must do so by September 11, 2026 to preserve your right to claim the benefit later.3NYS Comptroller. World Trade Center Presumption Overview Filing the notice does not require you to be sick yet.
What the Presumption Actually Does
New York’s WTC Presumption Law says that if you are eligible, permanently disabled from a listed condition, and can no longer perform your job duties, your disability is presumed to have been caused by your WTC work. Your employer or the retirement system can rebut that presumption, but only with competent evidence.3NYS Comptroller. World Trade Center Presumption Overview You do not have to independently prove that the dust, the site, or the trauma caused your illness.
The presumption runs across the major New York City and state pension systems: NYCERS, the Police Pension Fund, the Fire Department Pension Fund, and NYSLRS (both ERS and PFRS).4NYC.gov. WTC Disability Law It also extends to death benefits. If a retiree who qualified for the WTC accidental disability retirement later dies from the qualifying condition within the statutory period, eligible beneficiaries can apply for an accidental death benefit, treated as a line-of-duty death.5NYC Council. Who Is Eligible
Covered Workers
Eligible workers include uniformed members of the NYPD, FDNY, Department of Sanitation, and Department of Correction, along with civilian employees such as EMS workers, 911 dispatchers and supervisors, and emergency vehicle radio repair mechanics. Vested members of a public pension system who left employment before filing a claim can also qualify.6NYC.gov. Workers Compensation and Pensions Benefits On the state side, the benefit reaches NYSLRS members who worked for a participating employer between September 11, 2001 and September 12, 2002.7NYS Comptroller. The 40-Hour Exposure Rule
You must have spent at least 40 hours performing rescue, recovery, or cleanup work at a designated WTC site between September 11, 2001 and September 12, 2002, or worked at Ground Zero during the first 48 hours after the attacks. Workers who were injured during WTC work on September 11 or 12, 2001 and could not reach 40 hours because of that injury are excepted from the hour requirement.7NYS Comptroller. World Trade Center Frequently Asked Questions
Qualifying locations are:
- The WTC site: Lower Manhattan south of Canal Street, roughly bounded by Canal Street to Pike Street to the East River and down to the southern tip of the island.
- The NYC morgue and any temporary morgues.
- The Fresh Kills Landfill, including barges between Manhattan and the landfill.
- Specific NYPD, FDNY, and EMS sites during the first 24 hours after the attacks.
- Any location where NYC-owned vehicles or equipment contaminated by debris were repaired, cleaned, or rehabilitated.7NYS Comptroller. World Trade Center Frequently Asked Questions
Work at the Pentagon or in Shanksville, Pennsylvania is not covered by New York’s pension presumption. Those sites fall under the federal WTC Health Program at the CDC, which is a separate medical program.8CDC. WTC Health Program Eligible Groups
Pre-Employment Health Records
The condition you are claiming cannot appear in your pre-employment physical or in medical records from before September 11, 2001. For civilian city workers outside the uniformed police, fire, and sanitation ranks, a documented pre-employment physical is required to invoke the presumption.9NYC.gov. WTC Disability Law
Conditions the Presumption Covers
The New York State Comptroller groups the covered conditions this way:
- Upper respiratory: rhinitis, sinusitis, pharyngitis, laryngitis, vocal cord disease, upper airway hyper-reactivity, and tracheobronchitis.
- Lower respiratory: bronchitis, COPD, asthma, reactive airway dysfunction syndrome, and various forms of pneumonitis.
- Gastroesophageal: esophagitis and reflux disease.
- Psychological: PTSD, anxiety, depression, or combinations of these.
- Skin: conjunctivitis, contact dermatitis, and burns caused or aggravated by exposure.
- New-onset diseases: cancer, asbestos-related diseases, heavy metal poisoning, musculoskeletal disease, and chronic psychological conditions resulting from exposure.10NYS Comptroller. World Trade Center Qualifying Conditions
The new-onset category is forward-looking and captures cancers and other diseases with long latency periods that may not appear for years or decades after exposure.
What the Benefit Pays
The WTC accidental disability retirement pays 75 percent of final average salary. Under NYCERS, that payment is made in lieu of any other disability retirement allowance you would otherwise receive.1New York State Senate. Section 605-B of the Retirement and Social Security Law By comparison, ordinary disability retirement through the state system generally caps at one-third of final average salary.11NYS Comptroller. Disability Benefits
The IRS has confirmed that disability payments tied to injuries or illnesses connected to the September 11 attacks are exempt from federal income tax under the Victims of Terrorism Tax Relief Act. Some recipients have still had federal tax incorrectly withheld by retirement systems or insurers and have had to seek refunds through the IRS or the Taxpayer Advocate Service.2U.S. Senate – Gillibrand. The Notice of Participation: The Step That Preserves Your Rights
The Notice of Participation is a sworn statement that documents when and where you performed WTC work. It is not a benefits application. Filing it preserves your ability to apply later if a qualifying condition develops. The current deadline to file with NYSLRS is September 11, 2026.3NYS Comptroller. Applying for the Disability Benefit
NYCERS members can apply online, by mail, or in person by appointment. Each applicant is assigned a case manager who tracks the claim, prompts the applicant for forms and appointments, and relays Medical Board determinations. You should submit physician’s reports and other medical evidence as early as possible.13DC37 / Civil Service Technical Guild. DC37 Disability Process Presentation
A panel of three independent physicians reviews the medical evidence, may conduct interviews or examinations, and then makes a recommendation to the NYCERS Board of Trustees, which issues the final decision. Partial payments begin in the month of retirement or the following month while the case is finalized.13DC37 / Civil Service Technical Guild. DC37 Disability Process Presentation
If You Already Retired
If you retired on a service pension or an ordinary disability pension and later developed a qualifying condition, you can apply to reclassify your benefit as a WTC accidental disability retirement. You must show that you would have been permanently disabled and unable to perform your job had the condition been fully developed at retirement. Reclassification takes effect on the date of reclassification, not the original retirement date, and you cannot change the payment option you chose when you first retired.14NYS Comptroller. World Trade Center Filing Requirements
If Your Application Is Denied
You can request an administrative hearing after a denial. The written request must reach the Hearing Administrative Bureau within four months of the determination date on the denial letter and can be sent by email or mail. You have the right to an attorney at the hearing, but representation is not required.11NYS Comptroller. Disability Benefits
NYCERS members have additional options. There is a “refer back” opportunity to submit more evidence within 30 days of the Medical Board’s report, before the Board of Trustees ratifies the decision. After ratification, you can request reconsideration up to two times within 60 days by submitting new evidence, or refile the application entirely as a new case. WTC applicants keep the right to refile regardless of earlier outcomes.13DC37 / Civil Service Technical Guild. DC37 Disability Process Presentation
How the Pension Interacts With Other Benefits
Victim Compensation Fund
The September 11th Victim Compensation Fund calculates awards as non-economic loss plus economic loss minus collateral offsets. WTC disability pension payments count as a collateral offset and are subtracted from the VCF’s economic loss award, so you will not receive the full value of both. The VCF verifies pension information directly with entities like NYCERS, NYSLRS, the FDNY, and the NYPD.15VCF. Calculation of Loss Claimants must report all collateral source payments to the VCF, including new payments that arise after a claim is decided, through October 1, 2090.16VCF. VCF FAQ on WTC-BP Disability Pensions
Social Security Disability Insurance
You can collect a WTC disability pension and SSDI at the same time, but the 80 percent rule may reduce your SSDI. If SSDI plus public disability benefits together exceed 80 percent of your average pre-disability earnings, Social Security cuts the SSDI payment by the excess. The reduction continues until you reach full retirement age or the public disability benefit ends. If your public disability pension comes from a government job where Social Security taxes were withheld from your pay, SSDI is not reduced.17Social Security Administration. How Workers Compensation and Other Disability Payments May Affect Your Benefits
Workers’ Compensation
Within NYSLRS, ordinary disability benefits under Article 14 for Tier 3 members are reduced by Workers’ Compensation payments. Disability benefits under Article 15, which typically require ten years of service credit or an on-the-job accident, are not offset by Workers’ Compensation.18NYS Comptroller. Pending Changes to Watch
Several legislative changes were moving through Albany in mid-2026 and could shift the deadlines and eligibility above.
Senate Bill S10605 would push the Notice of Participation filing deadline from September 11, 2026 to September 11, 2030. It passed both chambers by early June 2026, with a 61–0 Senate vote, and was awaiting the Governor’s signature. It also directs the Workers’ Compensation Board to reconsider previously disallowed claims for disablement between September 2021 and September 2025, if refiled by the new deadline.19New York State Senate. Senate Bill S10605
Senate Bill S10085A would extend the presumptive death-benefit window for the FDNY pension fund from 25 to 35 years after retirement and push the filing deadline for sworn employment statements to September 11, 2036. It also passed both chambers by early June 2026.20New York State Senate. Senate Bill S10085A
Senate Bill S7831-A, sponsored by Senator Scarcella-Spanton, would open the 75 percent WTC performance-of-duty disability retirement to current active members of NYSLRS or the Teachers’ Retirement System who worked at WTC sites but were not members of any retirement system on 9/11. Those workers would need at least ten years of service credit and a qualifying condition. A fiscal analysis put the cost at roughly $20.4 million if all approximately 60 known previously rejected applicants became eligible. The bill remained in the Committee on Civil Service and Pensions as of mid-2026.21NY State Legislature. Senate Bill S7831-A
Senate Bill S4554A, signed into law on September 10, 2025, addresses verification for NYPD officers. The Police Pension Fund had required officers to prove WTC participation by searching more than a million pages of employment records, a process that could take up to 18 months and had been hampered by poor scan quality and records lost to Superstorm Sandy and a warehouse fire. The new law creates a rebuttable presumption that the contents of a sworn Notice of Participation are true and accurate, placing the burden on the employer to disprove them. Officers previously denied under the old verification process must reapply.22New York State Senate. Senate Bill S4554A
