Your wife will not keep receiving your VA disability when you die. Those monthly payments are tied to you personally and end the month before your death. What she can receive instead is a survivor benefit paid directly to her: Dependency and Indemnity Compensation, which starts at $1,699.36 per month in 2026, or a needs-based Survivors Pension if the death is not linked to your service. Which one applies, and how much she ultimately receives, depends on how you die, your disability history, and whether she files on time.
Why the Disability Check Stops
VA disability compensation pays a veteran for service-connected injuries or illness. Because it belongs to the veteran, federal regulations end it at death. Under 38 C.F.R. § 3.500(g), the last covered day is the final day of the month before death.1eCFR. 38 CFR 3.500 – General If you die in March, the February payment is the last one issued under your file. From that point forward, your wife applies under her own survivor claim, and the money that arrives is a different benefit with different rules.
Dependency and Indemnity Compensation When Death Is Service-Connected
Dependency and Indemnity Compensation, or DIC, is the main income-replacement benefit for a surviving spouse. Under 38 U.S.C. § 1310, the VA pays DIC when a service-connected condition caused or contributed to the veteran’s death.2Office of the Law Revision Counsel. 38 USC 1310 – Deaths Entitling Survivors to Dependency and Indemnity Compensation The condition does not have to be the sole cause. Substantial contribution is enough.
The base rate in 2026 is $1,699.36 per month, effective December 1, 2025.3Veterans Affairs. Current DIC Rates for Spouses and Dependents Your disability rating while alive does not change that figure. A spouse of a veteran who was rated 30 percent receives the same base DIC as a spouse of a veteran who was rated 100 percent. DIC is also tax-free at the federal level, so your wife would not report it on her return.4Internal Revenue Service. Add-Ons That Increase the Monthly Payment
- $421.00 per month for each child under 18.
- $421.00 per month if she has a disability that requires help with daily activities like bathing, eating, or dressing (aid and attendance).

DIC When You Were Rated Totally Disabled but Died of Something Else
Your wife can still qualify for DIC even when the cause of death was unrelated to your service, as long as you were rated 100 percent for long enough. - You held a total disability rating continuously for at least ten years immediately before death.
- You held a total disability rating continuously for at least five years from your date of discharge.
- You were a former prisoner of war and held a total disability rating continuously for at least one year immediately before death.
Section 1318 also requires that your wife was married to you for at least one year before your death, or that you had a child together. When she qualifies this way, the DIC rate is the same as under § 1310.
Concurrent Receipt of SBP and DIC
If you enrolled in the military’s Survivor Benefit Plan as a retiree, your wife receives both SBP and DIC in full. The dollar-for-dollar offset that used to reduce SBP by the amount of DIC was fully eliminated on January 1, 2023.3Veterans Affairs. Survivors Pension When Neither DIC Path Applies
If your death is not service-connected and the § 1318 total-disability rules do not fit, your wife may still qualify for a monthly Survivors Pension. For 2026, the maximum net worth she can have and still qualify is $163,699, effective December 1, 2025.8Federal Register. Unreimbursed medical expenses reduce countable income and can pull an otherwise over-the-limit household into eligibility.
The pension pays an annual maximum reduced by her countable income. For a surviving spouse alone in 2026, the maximum is $11,699 per year, roughly $975 per month. Higher maximums apply if she has dependent children, is housebound, or needs aid and attendance. Like DIC, pension payments are federally tax-free.4Internal Revenue Service. How Remarriage Affects Her Benefits
Remarriage does not automatically end DIC. Under 38 U.S.C. § 103(d)(2)(B), remarriage at age 55 or older preserves DIC.9Office of the Law Revision Counsel. 38 USC 103 – Special Provisions Relating to Marriages Remarriage before 55 stops DIC, but if that later marriage ends by death or divorce, she can apply to have DIC restored.
Unpaid Benefits You Were Owed
The VA may owe you money at the time of death that had not yet been paid. Under 38 U.S.C. § 5121, these accrued benefits can go to your wife. They cover amounts you were entitled to based on existing ratings or evidence already in your file, and a common example is retroactive pay from a claim the VA decides shortly after death. A related option is claim substitution under 38 U.S.C. § 5121A. If you have a claim or appeal pending when you die, she can ask to step in as the claimant so the VA finishes deciding it. How She Applies
DIC, the Survivors Pension, and accrued benefits are all claimed on VA Form 21P-534EZ, filed online or mailed to the Pension Management Center for her region.12Veterans Affairs. - Your DD214 showing service dates, branch, and character of discharge.
- A certified death certificate showing cause of death.
- Your marriage certificate.
- Medical records linking the death to a service-connected condition, if she is claiming DIC on that basis.
- Financial records for a Survivors Pension claim, including income, assets, and unreimbursed medical expenses.
Timing changes how much she collects. A DIC claim filed within one year of your death can be backdated to the first day of the month after death. A claim filed later generally takes effect on the date the VA receives it. She can also submit an intent to file, which locks in her earliest possible effective date and gives her up to 365 days to complete the full claim.14VA News. Beyond the Monthly Check
Two related benefits sit alongside the income question and are worth knowing exist. Your wife may qualify for CHAMPVA health coverage if she is not eligible for TRICARE and either your death was service-connected or you were permanently and totally disabled from a service-connected condition at the time of death.15Veterans Affairs.
