Will Marriott Buy Back Vacation Club Points? ROFR and Deed-Back

A Marriott Vacation Club buyback, in the sense of handing points back for a refund, is not something Marriott offers. The company has no standing program that repurchases points at or near their original price. Your two realistic exits are selling on the resale market, where Marriott may step in through a contractual right of first refusal, or surrendering your interest through Marriott’s exit specialists, which usually returns nothing financially. Points that sold at retail routinely resell for 10 to 25 percent of the original price, so recovering most of what you paid is unlikely under either path.

When Marriott Actually Pays You: The Right of First Refusal

Standard Marriott Vacation Club contracts include a right of first refusal. It is the only mechanism under which the developer writes you a check, and it does not activate on demand. It activates only after you have found a third-party buyer and signed a purchase agreement.

Once the closing company submits that signed agreement to Marriott, the developer generally has 15 to 30 days to respond. If Marriott exercises the right, it steps into the buyer’s shoes and purchases your interest at the exact price and terms already negotiated. You receive the proceeds the same way you would from the original buyer. If Marriott passes or lets the window expire, the sale closes with your buyer as planned.

What triggers Marriott to exercise this right is not published. In practice the developer intervenes more often when the price sits well below what it considers acceptable for that resort or point category, or when it needs inventory for its trust. Some low-priced deals pass through untouched; some higher-priced ones get intercepted. You cannot force the issue. What you can count on is that any payment comes at resale value, not retail.

The Deed-Back Through Marriott’s Exit Specialists

Owners who want to deal directly with the developer can contact Marriott’s Exit Service Specialists. Marriott’s official exit page frames this as a service for long-time owners leaving because of reduced finances, health, or other personal circumstances.1The Marriott Vacation Clubs. Timeshare Exit There is no branded program name.

In most cases this works as a deed-back. You transfer your ownership interest back to Marriott, and your future maintenance fee obligations end. You do not receive payment. Some owners have reported being asked to cover an administrative fee of several hundred dollars for closing costs. Alongside the deed-back track, Marriott occasionally repurchases intervals at specific high-profile resorts when its inventory needs justify it, but this selective buy-back is at the developer’s discretion and not something you can request into existence.

Approval is not guaranteed. Marriott evaluates each request against its current inventory needs, the specific resort or point category, and the owner’s account standing. Owners with an outstanding mortgage balance on their timeshare are generally ineligible, and maintenance fees and assessments must be current before the company will consider a return.

Preparing Your Account Before You Call

Whether you aim at resale or deed-back, two things need to be true before anyone will deal with you: clear title and current fees. Any loan balance on the timeshare must be paid off. Marriott will not accept a deed-back on an interest with a lien, and no resale buyer wants to inherit your debt. Maintenance fees and property taxes must be paid through the current year. Maintenance fees on Marriott Vacation Club Destinations points have run roughly 80 cents per point, so an owner with a few thousand points is looking at four figures annually.

Have these on hand before your first call:

  • Your original deed or contract, including owner number, legal description, and the resort or trust affiliation.
  • Your current point balance, including anything banked or borrowed across use years.
  • Proof that your mortgage is satisfied and your maintenance fees are current.
  • Your original purchase price and any upgrade records, which matter at tax time.

You can confirm balances through the online owner portal or by requesting a financial statement from owner services.

How the Transfer Actually Moves

The process begins with a phone call or online inquiry. Marriott then reviews your account and decides whether to accept the return, a step that typically takes several weeks while the developer looks at inventory for your resort or point category. If approved, closing documents follow. The transfer is then recorded in the appropriate county.

From initial request to final release, the full timeline usually runs 60 to 120 days, and some cases run longer. Keep paying maintenance fees and watching your account until you receive written confirmation that title has transferred and your obligations have ended. Stopping payment before that confirmation can trigger default proceedings even while a deed-back is in motion.

Tax Consequences Owners Miss

Two tax issues catch owners off guard on the way out. The first is the loss. If you sell for less than you paid, which is almost certain on the resale market, that loss is not deductible. The IRS treats vacation timeshares as personal-use property, and losses on sales of personal-use property cannot be claimed as capital losses.2Internal Revenue Service. Topic No. 409, Capital Gains and Losses Deductible losses are limited to property used in a trade or business, transactions entered into for profit, and certain casualty events.3Internal Revenue Service. Capital Gains, Losses, and Sale of Home A vacation timeshare used personally fits none of those.

The second is cancelled debt. If you still owe a balance and the developer forgives it as part of a deed-in-lieu-of-foreclosure or similar arrangement, you may receive a Form 1099-C reporting the forgiven amount. The IRS generally treats cancelled debt as taxable income in the year of the cancellation. On a timeshare that originally cost tens of thousands of dollars, that is a real tax bill. Two exclusions can apply: debt cancelled in a Title 11 bankruptcy case, and debt cancelled while you are insolvent (your total debts exceed the fair market value of your total assets). Both require filing Form 982 with your return.4Internal Revenue Service. Topic No. 431, Canceled Debt – Is It Taxable or Not?

Why Walking Away Is Worse

Owners who get worn down by the timeline sometimes consider just stopping payment. It almost always makes things worse. The resort’s homeowners’ association typically sends the delinquent balance to collections, and the debt lands on your credit report, where it stays for seven years. During that window it can hurt your ability to qualify for mortgages, auto loans, and other credit.

If the balance stays unpaid, the developer or HOA can foreclose on the interest. Foreclosure removes the ownership but not the credit damage, and depending on your contract, you may still owe a deficiency balance. Any amount forgiven afterward brings the same 1099-C problem described above. You trade one set of obligations for a worse set.

Avoiding Exit Scams

Owner frustration has built a large industry of third-party exit companies, and many are predatory. The FTC warns about outfits that guarantee they can cancel your contract, demand large upfront fees, and then either do nothing or simply contact the resort on your behalf, which you could have done for free.5Federal Trade Commission. Timeshares, Vacation Clubs, and Related Scams

Watch for these red flags:

  • Unsolicited calls or emails offering to exit a timeshare you never asked about selling.
  • Guaranteed results. Marriott has full discretion over any deed-back, so no one can promise acceptance.
  • Large upfront payments. Legitimate resale brokers typically collect commission at closing.
  • Instructions to stop paying maintenance fees, which sets you up for default and credit damage.

Before paying any third party, call Marriott’s exit specialists directly through the number on the official exit page.1The Marriott Vacation Clubs.
