Will a Repossession Affect Buying a House? Credit, Waiting Periods, and Taxes

A repossession will affect buying a house, but it does not disqualify you. The seven-year mark on your credit report, any unpaid deficiency balance, and heightened underwriter scrutiny are the real hurdles, not a formal waiting period tied to the repo itself. Most borrowers who stay disciplined with credit rebuilding reach mortgage eligibility within one to three years of losing a vehicle.

How a Repossession Shows Up on Your Credit

Federal law caps the reporting period. Under 15 U.S.C. ยง 1681c, a consumer reporting agency cannot include an account placed for collection or charged off if it predates the report by more than seven years.1Office of the Law Revision Counsel. 15 USC 1681c – Requirements Relating to Information Contained in Consumer Reports The clock begins 180 days after the first missed payment that led to the repossession, not on the day the car was taken. Once that seven-year window closes, the entry drops off.

The damage is heaviest in the first 12 to 24 months and softens over time. A borrower with otherwise clean credit before the repo may lose 100 points or more, while someone already in the low 600s may see a smaller numerical drop. Either way, the mark reads as a serious derogatory event to every mortgage underwriter who opens your file. Voluntary surrender and involuntary repossession produce roughly the same credit damage, though some lenders view a voluntary surrender as a slightly better signal because it suggests the borrower took initiative.

Credit Score Minimums by Loan Type

Where your score lands after the hit determines which loan programs are even in play.

  • FHA loans: minimum score of 500. Between 500 and 579, you must put at least 10 percent down. At 580 or above, the standard 3.5 percent down payment applies.2HUD. Does FHA Require a Minimum Credit Score and How Is It Determined
  • Conventional loans sold to Fannie Mae: minimum representative credit score of 620 for both fixed-rate and government-insured products.3Fannie Mae. General Requirements for Credit Scores
  • VA and USDA loans: no official minimum in program guidelines, but most lenders impose overlays in the 580 to 640 range.

FHA’s lower floor is why it tends to be the first realistic path after a repo. Individual lenders often set minimums above what a program allows, so shopping several lenders is worth the time.

Is There a Required Waiting Period After a Repossession?

There is no formal waiting period tied specifically to a vehicle repossession. Fannie Mae’s list of significant derogatory events with mandatory waiting periods covers foreclosure (seven years, or three with documented extenuating circumstances), deed-in-lieu and mortgage charge-offs (four years, or two with extenuating circumstances), and bankruptcy by chapter.4Fannie Mae. Significant Derogatory Credit Events – Waiting Periods and Re-establishing Credit A car repo is not on that list.

What actually controls your timeline:

  • Credit score recovery. If the repo pushed your score below the minimum for your target program, you need enough time for consistent on-time payments to pull it back. Most borrowers regain 50 to 80 points within 12 to 24 months.
  • Deficiency balance. An unresolved deficiency inflates your debt-to-income ratio and often appears as an open collection or judgment, both of which block approval.
  • Underwriter judgment. Even once your score recovers, the underwriter wants to see the repo as an isolated event with a year or more of clean payment history behind it.

If a Bankruptcy Was Involved

When the repossession happened alongside a bankruptcy filing, the bankruptcy waiting periods control. For conventional loans through Fannie Mae, a Chapter 7 discharge triggers a four-year wait (two with extenuating circumstances), and a Chapter 13 discharge triggers a two-year wait.4Fannie Mae. Significant Derogatory Credit Events – Waiting Periods and Re-establishing Credit FHA generally requires two years after a Chapter 7 discharge, with a possible reduction to one year if the borrower documents circumstances beyond their control, such as a job loss causing at least a 20 percent income drop for six months or more.5HUD. Mortgagee Letter 2013-26 Back to Work – Extenuating Circumstances These periods run from the discharge or dismissal date, not from the repossession date.

Deficiency Balances and Debt-to-Income

When a repossessed vehicle sells at auction for less than you owed, the difference is a deficiency balance. The lender can pursue you for it, and if they get a court order, you owe the shortfall plus any auction and legal fees added on. Many post-repo mortgage applications fall apart right here.

Underwriters count the deficiency as debt when calculating your debt-to-income ratio. Current limits by program:

  • Conventional (Fannie Mae): loans run through the automated system can go up to 50 percent DTI. Manually underwritten loans cap at 36 percent, or up to 45 percent with strong credit and reserves.6Fannie Mae. Debt-to-Income Ratios
  • FHA: standard maximum back-end DTI is 43 percent, with ratios up to roughly 50 percent available when compensating factors like substantial savings or strong credit history are present.

The familiar “DTI must be below 43 percent” rule came from the original Qualified Mortgage definition, but the CFPB removed that fixed cap in 2020 and replaced it with price-based thresholds.7Federal Register. Qualified Mortgage Definition Under the Truth in Lending Act Regulation Z General QM Loan Definition The actual ceiling depends on your lender’s automated underwriting result or manual guidelines.

Judgments Follow You to Closing

If the deficiency went to court and the lender won a judgment, the stakes rise. In most states, a recorded judgment creates a lien that attaches to real property you own or later acquire in that jurisdiction. Fannie Mae’s underwriting system flags open judgments shown in the public records section of your credit report, and they must be paid off at or before closing.8Fannie Mae. The Tax Bill When Deficiency Debt Is Forgiven

If the lender writes off your deficiency balance or you settle for less than the full amount, the IRS generally treats the forgiven portion as taxable income. The lender reports the canceled amount on Form 1099-C, and you must include it on your return as ordinary income even if you never receive the form.9Internal Revenue Service. Topic No 431 Canceled Debt – Is It Taxable or Not For a deficiency of several thousand dollars, the unexpected tax hit can derail down payment savings.

There is a meaningful exception. If your total liabilities exceeded the fair market value of all your assets immediately before the debt was canceled, you were insolvent and can exclude some or all of the forgiven amount from income, up to the smaller of the canceled amount or the amount by which you were insolvent.10Internal Revenue Service. Publication 4681 – Canceled Debts Foreclosures Repossessions and Abandonments Many people who just lost a vehicle qualify, because their debts often exceed their remaining assets at that point. You claim the exclusion on Form 982 filed with your return.

What the Underwriter Will Ask For

Once your score meets the minimum and the deficiency is handled, you still have to pass underwriter review. A repossession in your file triggers extra documentation. Having it ready moves things along.

A Letter of Explanation

You will be asked to write a short, factual letter about what led to the repossession. Underwriters respond to specifics: a layoff on a given date, a documented medical event, a divorce. Attach supporting records such as a termination letter, hospital billing, or a divorce decree. Vague references to “hard times” without evidence rarely satisfy a reviewer. The point is to show the repo was a one-time disruption, not a pattern.

Proof the Deficiency Is Closed

Bring a satisfaction of judgment or a signed settlement agreement showing the debt is resolved. If you settled for less than the full balance, the underwriter will also want the 1099-C the creditor issued, because the forgiven portion may have created a tax liability that factors into your financial picture.11Internal Revenue Service. About Form 1099-C Cancellation of Debt Unpaid tax from forgiven debt is itself a liability.

A Rebuilt Payment History

Underwriters look for evidence of re-established credit. As a general benchmark, most guidelines expect at least three active or recently closed credit accounts with 12 months of payment history and no lates during that stretch. A car payment, a credit card, and a small installment loan paid on time for a year or more paint the right picture. The longer and cleaner your post-repo history, the less weight the old repossession carries.

Clean Bank Statements

Expect a review of two to six months of bank statements. Unexplained recurring withdrawals raise questions about undisclosed debts. If you are still making payments toward the repossession balance or any related obligation, disclose it upfront. Surprises found during underwriting stall or sink applications.

What to Do While You Wait

The months between repossession and mortgage approval are the whole game. What you do with them decides whether you qualify in 18 months or still cannot get approved after five years.

  • Resolve the deficiency first. Negotiate a settlement if you cannot pay in full, and get the terms in writing before you pay. A settled account looks far better than an open collection and removes the DTI drag.
  • Keep two or three credit accounts active. Secured cards or small credit-builder loans work if traditional credit is closed to you. Pay every balance on time, every month, no exceptions.
  • Monitor your credit report. Verify the repossession date, because an incorrect date can extend the reporting period. Dispute errors in writing.
  • Save for a larger down payment. More money down offsets risk in the underwriter’s eyes and can compensate for a borderline score, especially on FHA where 10 percent down opens the door at a 500 credit score.2HUD. Does FHA Require a Minimum Credit Score and How Is It Determined
  • Avoid any new derogatory marks. A second negative event tells lenders the first one was not an anomaly. Even a single 30-day late can push your timeline back by months.

Borrowers who work through these steps consistently tend to reach mortgage eligibility within about two years of the repossession date. Those who ignore the deficiency or let other accounts slip often watch the seven-year reporting window run out before they qualify.
