Why Does PayPal Need My SSN? Federal Law, 1099-K, and EIN Options

PayPal asks for your Social Security Number because federal law requires it. As a licensed money transmitter, PayPal has to verify the identity of everyone who opens an account, and as a payment settlement company it has to report certain payments you receive to the IRS using a taxpayer identification number. For most individual users in the United States, that number is an SSN.

Identity Verification Is Required by Federal Law

Every U.S. financial institution, including payment platforms like PayPal, must confirm the identity of each customer who opens an account. The requirement comes from the customer identification program provisions of the USA PATRIOT Act at 31 U.S.C. § 5318.1Office of the Law Revision Counsel. 31 USC 5318 – Compliance, Exemptions, and Summons Authority The implementing regulations require the institution to collect, at a minimum, your name, date of birth, address, and a taxpayer identification number.2eCFR. 31 CFR 1020.220 – Customer Identification Program Requirements for Banks For most individuals, that identifier is the Social Security Number.

PayPal refers to this as its Customer Identification Process. Depending on the account, you may also be asked for a government-issued photo ID and a recent proof of address.3PayPal. How Do I Confirm My Identity (CIP) The purpose is to match what you enter against government records so PayPal can confirm you are who you say you are. Banks, brokerages, and other licensed money transmitters do the same thing for the same reason.

IRS Reporting and the 1099-K

Identity verification is only half the answer. PayPal also needs your taxpayer identification number to comply with IRS reporting rules. Under Internal Revenue Code Section 6050W, payment settlement entities must report the total payments you receive for goods and services each year on Form 1099-K.4Office of the Law Revision Counsel. 26 USC 6050W – Returns Relating to Payments Made in Settlement of Payment Card and Third Party Network Transactions That form carries your name, address, and taxpayer identification number, and the IRS matches it against your tax return.

For third-party settlement organizations like PayPal, the reporting requirement kicks in when your goods-and-services payments exceed $20,000 and you have more than 200 such transactions in a calendar year. An earlier law had lowered that to $600 with no transaction minimum, but the One Big Beautiful Bill Act restored the $20,000-and-200 standard.5Internal Revenue Service. One Big Beautiful Bill Provisions PayPal still collects a taxpayer identification number regardless of your volume, because it cannot know in advance whether you’ll cross the threshold.

Only payments for goods and services count. Money sent through Friends and Family, such as splitting a bill or reimbursing a roommate, is not reportable and should not appear on a 1099-K.6Internal Revenue Service. Understanding Your Form 1099-K

What Happens If You Don’t Provide a Valid Number

If you don’t give PayPal a valid taxpayer identification number, or the number you give doesn’t match IRS records, federal law requires PayPal to withhold 24% of your incoming payments and send it to the IRS. This is called backup withholding, and it applies automatically under 26 U.S.C. § 3406 whenever a payee fails to furnish a correct taxpayer identification number.7Office of the Law Revision Counsel. 26 USC 3406 – Backup Withholding

Backup withholding is not a penalty. It’s a pre-collection of tax you would likely owe anyway, and you can claim any excess back when you file. But the 24% flat rate may be higher than your actual bracket, so the government ends up holding more of your money than it needs until you file a return.8Internal Revenue Service. Backup Withholding

Beyond withholding, PayPal’s user agreement lets it place holds and limits on your account and, if verification cannot be completed after reasonable attempts, close or suspend it entirely.9PayPal. How Do I Confirm My Identity (CIP) If you still don’t respond, any remaining balance can be frozen until you complete verification.

You Can Use an EIN or ITIN Instead

You don’t necessarily have to hand over a personal Social Security Number. PayPal accepts three types of taxpayer identification numbers: an SSN, an Employer Identification Number, or an Individual Taxpayer Identification Number.10PayPal. How Will PayPal Use My TIN or SSN and How Do I Add It

If you operate a business, such as a partnership, LLC, or corporation, you can open a business PayPal account and provide the EIN rather than your personal SSN. The IRS issues EINs to businesses for tax purposes, and using one keeps your personal number off the platform.11Internal Revenue Service. Employer Identification Number

Non-citizens who aren’t eligible for a Social Security Number can use an ITIN. The IRS issues ITINs strictly for federal tax purposes; they don’t authorize work or change immigration status, but they satisfy PayPal’s need for a taxpayer identification number.12Internal Revenue Service. Individual Taxpayer Identification Number (ITIN)

Don’t Provide a Number That Isn’t Yours

Using someone else’s Social Security Number or making one up to open a PayPal account is a federal crime. Under 18 U.S.C. § 1028, knowingly using another person’s identifying information, which specifically includes Social Security Numbers, in connection with unlawful activity affecting interstate commerce carries up to 5 years in prison. If the fraud yields $1,000 or more in value within a year, the maximum increases to 15 years, and attempts are punished the same as completed offenses.13Office of the Law Revision Counsel. 18 USC 1028 – Fraud and Related Activity in Connection with Identification Documents, Authentication Features, and Information A false or mismatched number will also trigger the 24% backup withholding described above, and PayPal will typically freeze the account as soon as its verification process flags the mismatch.
