Who Is the Commerce Secretary and What Do They Do?

The Commerce Secretary is the head of the U.S. Department of Commerce, a cabinet official who oversees federal trade enforcement, export controls, the census, patents and trademarks, weather forecasting, and semiconductor manufacturing incentives. The job is currently held by Howard Lutnick, the 41st Secretary of Commerce, who was confirmed by the Senate on February 18, 2025, in a 51–45 vote and sworn in three days later.1U.S. Senate. Who Howard Lutnick Is

Lutnick came to the cabinet from Wall Street. He joined Cantor Fitzgerald as a bond broker after college, became president and CEO in 1991, and was named chairman in 1996. He rebuilt the firm after the September 11 attacks, which killed 658 of its 960 New York-based employees, and launched the Cantor Fitzgerald Relief Fund, which distributed more than $180 million to victims’ families. In 2004 he spun off the firm’s voice brokerage business into BGC Partners. He co-chaired President Trump’s 2024 transition team before being nominated as Commerce Secretary, and his confirmation vote broke largely along party lines.

What the Job Involves

Trade enforcement is one of the most consequential pieces of the portfolio. The Secretary has direct authority over anti-dumping and countervailing duty investigations. When a foreign company sells goods in the United States below fair market value, the Commerce Department determines whether dumping occurred and calculates the margin. If the U.S. International Trade Commission then finds that a domestic industry was harmed, the Secretary issues a duty order enforced at the border.4United States International Trade Commission. The Secretary also oversees export controls through the Bureau of Industry and Security. The Agencies the Secretary Runs

  • The Bureau of the Census, which runs the decennial population count that determines congressional apportionment and how trillions in federal funding get distributed.
  • The U.S. Patent and Trademark Office, which reviews and grants patents and trademark registrations.
  • The National Oceanic and Atmospheric Administration, which provides weather forecasts, manages fisheries, and monitors ocean and atmospheric conditions.
  • The National Institute of Standards and Technology, which sets measurement standards, develops cybersecurity and AI guidelines, and houses the CHIPS for America program offices.

Weather satellites and patent applications don’t obviously belong in the same department, but they trace back to the original 1903 mandate to support American industry in all its forms.

Current Priorities Under Lutnick

Lutnick’s tenure has focused heavily on tariff policy. The administration has pursued higher tariff rates on major trading partners with the stated goal of opening foreign markets to American goods and encouraging domestic manufacturing. Lutnick has framed the approach as reciprocal trade: countries that restrict American exports face tariffs until they lower their own barriers.

The department also continues to implement the CHIPS and Science Act of 2022, which directed $50 billion toward domestic semiconductor research and manufacturing.9National Institute of Standards and Technology. How Someone Becomes Commerce Secretary

The appointment follows the Appointments Clause in Article II, Section 2: the President nominates, and the Senate provides advice and consent.10Congress.gov. Most of the real scrutiny happens at the committee stage. Nominees complete a detailed questionnaire covering their professional history and personal finances. The committee reviews confidential financial details that never become public, though the non-confidential portions and any written responses to follow-up questions are posted online. Committee members then question the nominee in a public hearing before voting on whether to send the nomination to the full Senate floor. On the floor, a simple majority of senators present is enough to confirm.

Cabinet officials also face strict conflict-of-interest rules once confirmed. Under federal criminal law, the Secretary cannot participate in any government matter that would directly and predictably affect their own financial interests or those of a spouse, minor child, or organization where they serve as an officer or director. Violations are crimes, not just ethics problems. If the office becomes vacant, the Federal Vacancies Reform Act of 1998 governs who steps in. Normally the Deputy Secretary takes over in an acting capacity.
