Who Can Invoke the 25th Amendment: President, Cabinet, or Congress

Only three actors can invoke the 25th Amendment: the president acting alone, the vice president acting together with a majority of the cabinet, or the vice president acting together with a body that Congress creates by law. No member of Congress, no court, and no private citizen can start the process. Who can invoke the 25th Amendment is answered entirely by the text of Sections 3 and 4, and the vice president is the indispensable figure in any involuntary use.

The President, Acting Alone

Under Section 3, the president can transfer power voluntarily by sending a written declaration to the Speaker of the House and the President pro tempore of the Senate stating that they are unable to carry out the duties of the office.1Congress.gov. U.S. Constitution – Twenty-Fifth Amendment The moment that letter arrives, the vice president becomes acting president. No vote, hearing, or outside approval is required. The president reclaims power by sending a second letter to the same two congressional leaders stating that the inability has ended.2Legal Information Institute. U.S. Constitution – Amendment XXV

Every formal use to date has been a president preparing for anesthesia. George W. Bush invoked Section 3 twice, in 2002 and 2007, for routine colonoscopies. Joe Biden did the same in November 2021, transferring power to Kamala Harris for about 85 minutes. Ronald Reagan sent a similar letter during colon surgery in 1985 but avoided citing the amendment by name, making his invocation technically informal.3Congress.gov. The Vice President Plus a Cabinet Majority

Section 4 covers the harder case of a president who is incapacitated but unable or unwilling to say so. The vice president and a majority of the “principal officers of the executive departments” send a joint written declaration to the Speaker and the President pro tempore stating that the president cannot carry out the duties of the office. The vice president immediately becomes acting president upon delivery.1Congress.gov. U.S. Constitution – Twenty-Fifth Amendment This is the only constitutional path for stripping a living, non-impeached president of executive power without their consent, and it has never been used.4Congress.gov. The Twenty-Fifth Amendment: Sections 3 and 4

The vice president is not optional. Without the vice president’s signature, no involuntary transfer can happen, no matter how many cabinet officers agree the president is unfit. That also means a vacancy in the vice presidency disables the entire Section 4 mechanism, since the text has no workaround.

Which Cabinet Members Count

In Freytag v. Commissioner (1991), the Supreme Court noted in a footnote that the phrase “principal officers of the executive departments” was intended to cover the heads of the departments listed in 5 U.S.C. ยง 101.5Congress.gov. Overview of Twenty-Fifth Amendment, Presidential Vacancy and Disability That statute currently lists fifteen departments:6Office of the Law Revision Counsel. 5 USC 101 – Executive Departments

  • State
  • Treasury
  • Defense
  • Justice
  • Interior
  • Agriculture
  • Commerce
  • Labor
  • Health and Human Services
  • Housing and Urban Development
  • Transportation
  • Energy
  • Education
  • Veterans Affairs
  • Homeland Security

A majority means at least eight of these fifteen secretaries must sign alongside the vice president. Officials who attend cabinet meetings but do not lead one of these departments, such as the White House Chief of Staff or the U.S. Trade Representative, have no role in the process. Their political weight is irrelevant to the text.

An Alternative Body Congress Could Create

Section 4 gives Congress a second option: the vice president can act with “such other body as Congress may by law provide” in place of the cabinet.1Congress.gov. U.S. Constitution – Twenty-Fifth Amendment Congress has never created such a body. A 2017 bill from Representative Jamie Raskin would have established an independent commission of physicians and former officials to evaluate presidential fitness, but it did not become law.

Any such body would replace the cabinet, not the vice president. The vice president would still need to co-sign, keeping the executive branch inside the process no matter who does the evaluation.

Who Cannot Invoke It

The list of people who cannot start a 25th Amendment process is longer than the list of those who can. Individual members of Congress cannot invoke it. Congressional committees cannot invoke it. Courts cannot invoke it. The president’s physician, family members, and White House staff cannot invoke it. Public petitions and calls from former officials carry no legal weight. If the vice president will not act, Section 4 does not move, regardless of who else believes the president is unfit. Impeachment is a separate mechanism with its own actors and thresholds.

What Happens If the President Fights Back

Anyone weighing who can invoke Section 4 should understand how easily the president can undo it. Once the vice president and cabinet transfer power, the president can send their own written declaration to the Speaker and the President pro tempore stating that no inability exists. Power returns to the president immediately, but only for the moment. The vice president and cabinet majority then have four days to send a second declaration insisting the president is still unable to serve.5Congress.gov. Overview of Twenty-Fifth Amendment, Presidential Vacancy and Disability If they miss the four-day window, the president keeps power and the matter ends.

If the second declaration is sent, Congress must assemble within 48 hours and then has 21 days to vote. Keeping the president out of power requires a two-thirds vote in both the House and the Senate.5Congress.gov. Overview of Twenty-Fifth Amendment, Presidential Vacancy and Disability Anything short of two-thirds in either chamber restores the president. The threshold is deliberately high, set by the amendment’s framers to prevent Section 4 from becoming a tool for political coups.
