Which Tax Refund Comes First: Federal or State?

For most taxpayers, the federal refund arrives before the state refund. The IRS targets 21 days to issue a refund on an e-filed return, while state revenue departments typically take three to eight weeks to process an electronic return.1Internal Revenue Service. IRS Opens 2026 Filing Season That said, the order is not guaranteed. Whether your federal or state tax refund comes first depends on which credits you claimed, whether you e-filed or mailed each return, and whether any debts are attached to your federal refund.

Why Federal Usually Arrives First

The IRS runs every federal return through one centralized processing system built around that 21-day window for clean e-filed returns.1Internal Revenue Service. IRS Opens 2026 Filing Season State revenue departments each run their own systems with their own staffing, technology, and review procedures, and their normal turnaround runs roughly three to eight weeks for an e-filed return.

The two systems have no connection to each other. Your federal return being accepted tells you nothing about where your state return sits in its own queue, and each agency finishes on its own clock. That structural difference is why federal wins the race for most filers.

One boundary worth noting: eight states have no individual income tax at all. If you live in one, there is no state refund and only the federal timeline matters.

When the State Refund Beats the Federal

The main reason the order flips is the Protecting Americans from Tax Hikes (PATH) Act. Under that law, the IRS cannot issue any refund before February 15 to a taxpayer who claims the Earned Income Tax Credit or the Additional Child Tax Credit, and the hold applies to the entire refund, not just the portion tied to those credits.2Office of the Law Revision Counsel. 26 USC 6402 – Authority to Make Credits or Refunds

For the 2026 filing season, the IRS estimates that most filers who claimed these credits, e-filed, and chose direct deposit can expect their refund by March 2, with the Where’s My Refund tool showing updated status by February 21.3Internal Revenue Service. When to Expect Your Refund if You Claimed the Earned Income Tax Credit or Additional Child Tax Credit Most states do not impose an equivalent hold. If you file in January and claim either credit, expect your state refund to land first.

How Filing and Delivery Method Change the Order

E-filing with direct deposit is the fastest combination on both the federal and state side. Paper returns are dramatically slower: the IRS estimates six weeks or more to process a mailed return even when it contains no errors.4Internal Revenue Service. Refunds State agencies show the same gap between electronic and paper processing.

Mixing methods flips the order on its own. E-file your federal return and mail your state return, and the state will almost certainly arrive second by a wide margin. Reverse it, and the state may catch up or overtake the federal refund. If you want the standard federal-first sequence, file both electronically.

Delivery method matters after approval too. Once the IRS marks a refund as “Sent,” a direct deposit can take up to five days to appear in your bank account. A paper check can take several weeks in the mail from the same “Sent” date, and any hold your bank places after deposit runs on top of that.5Internal Revenue Service. Where’s My Refund? Two refunds issued the same day can reach your account weeks apart if one goes by check and the other by direct deposit.

One rarely-hit limit on the federal side: the IRS allows a maximum of three refund deposits to the same bank account or prepaid debit card per year. A fourth refund routed to that account converts automatically to a paper check, which adds mailing time.6Internal Revenue Service. Direct Deposit Limits

What Slows the State Side

Several state-specific factors can stretch that three-to-eight-week window and push the state refund further behind the federal one:

  • Fraud detection filters that pull returns with unusual income patterns, credit claims, or filing details into manual review.
  • Identity verification requirements, such as a quiz or a letter mailed to your address, that hold the refund until you respond.
  • Batch issuance schedules in some states, where approved refunds wait for a payment cycle rather than going out individually.
  • Manual review of state-specific credits, such as a state education credit or property tax credit, which can add several weeks on its own.

What Reduces or Delays the Federal Refund

Even when federal would ordinarily arrive first, the Treasury Offset Program can shrink or eliminate it before you see the money. The Bureau of the Fiscal Service can redirect your federal refund to cover past-due child support, prior-year federal tax debt, defaulted student loans owed to a federal agency, state income tax debt, and unemployment compensation overpayments.7Bureau of the Fiscal Service. Tax Refund Offset By law, child support debts are satisfied first, then other federal agency debts, then state debts.2Office of the Law Revision Counsel. 26 USC 6402 – Authority to Make Credits or Refunds You receive advance notice before an offset, and the IRS sends a separate notice afterward showing how much was taken and where it went.

If you file jointly and only your spouse owes the qualifying debt, Form 8379, Injured Spouse Allocation, protects your share. Processing runs about 11 weeks when the form is e-filed with the joint return, about 14 weeks on paper, and about 8 weeks if filed separately after the joint return has already processed.8Internal Revenue Service. Instructions for Form 8379 Filing Form 8379 when no offset actually exists will delay your refund, so use it only when a qualifying past-due debt applies.

Tracking Each Refund

The IRS “Where’s My Refund?” tool is the primary way to check federal status. You’ll need your Social Security number or ITIN, your filing status, and the exact whole-dollar refund amount from your return. It shows three stages: Return Received, Refund Approved, and Refund Sent.5Internal Revenue Service. Where’s My Refund? The tool updates within 24 hours of an e-filed return being accepted; for a mailed return, wait four weeks before checking.9Internal Revenue Service. Most state revenue departments run their own online portals with similar identifying inputs. Because federal and state trackers pull from separate systems, they routinely show mismatched stages. It’s normal to see the state status still reading “Under Review” while federal already shows “Sent,” or the reverse during a PATH Act hold.
