When You Don’t Have to File Taxes: Thresholds and Exceptions

You don’t have to file a federal income tax return when your gross income for the year falls below the standard deduction for your filing status. For the 2026 tax year, a single filer under 65 can earn up to $16,099 before a filing obligation kicks in, and a married couple filing jointly can earn up to $32,199 as long as neither spouse has turned 65.1Internal Revenue Service. Revenue Procedure 2025-32 Age, dependent status, self-employment, and a handful of specific financial events all move that line, sometimes down to almost nothing.

2026 Income Thresholds by Filing Status

Gross income for this purpose means wages, taxable interest, business profits, and essentially everything else the tax code doesn’t specifically exclude.2Office of the Law Revision Counsel. 26 USC 6012 – Persons Required to Make Returns of Income If your total for the year lands below the number for your situation, you generally don’t have to file. For 2026:1Internal Revenue Service. Revenue Procedure 2025-32

  • Single, under 65: $16,100
  • Single, 65 or older: $18,150
  • Head of household, under 65: $24,150
  • Head of household, 65 or older: $26,200
  • Married filing jointly, both under 65: $32,200
  • Married filing jointly, one spouse 65 or older: $33,850
  • Married filing jointly, both 65 or older: $35,500
  • Qualifying surviving spouse, under 65: $32,200
  • Qualifying surviving spouse, 65 or older: $33,850
  • Married filing separately, any age: $5

The higher thresholds at 65 reflect the additional standard deduction: $2,050 for unmarried filers and $1,650 for married filers or surviving spouses. The same additional amount applies if you’re legally blind, and the two stack. A single filer who is both 65 and blind adds $4,100 to the base threshold.1Internal Revenue Service. Revenue Procedure 2025-32 These figures adjust for inflation every year, so a number that kept you under last year won’t necessarily do it this year.

The $5 married-filing-separately threshold is not a typo. It exists so spouses can’t split income across two returns to game deductions. If your spouse itemizes, you can’t take the standard deduction, and you have to file once you’ve earned $5.3Internal Revenue Service. Check if You Need to File a Tax Return

If Someone Claims You as a Dependent

Dependents follow a tighter set of rules that look separately at earned income (wages, salaries, tips) and unearned income (interest, dividends, capital gains). For 2026, a dependent has to file if any one of these is true:1Internal Revenue Service. Revenue Procedure 2025-32

  • Unearned income is more than $1,350
  • Earned income is more than $16,100
  • Combined gross income is more than the larger of $1,350 or earned income (up to $15,650) plus $450

The lower unearned-income figure is deliberate. Without it, parents could park investments in a child’s name and duck their own bracket. The combined formula tends to hit teenagers who have both a part-time job and a savings account that pays interest.

Dependents who are 65 or older or legally blind get higher thresholds that mirror the additional standard deduction. A single dependent age 65 or older doesn’t have to file until unearned income tops $3,400 or earned income tops $18,150.3Internal Revenue Service. Check if You Need to File a Tax Return

The $400 Self-Employment Rule

If you freelance, drive rideshare, sell things online, or do any independent work, the general income thresholds above don’t protect you. You have to file once your net earnings from self-employment reach $400 for the year, no matter how low your total income is.4Internal Revenue Service. Topic No. 554, Self-Employment Tax Net earnings means revenue minus legitimate business expenses, not gross receipts.

The trigger is low because self-employed workers owe both halves of Social Security and Medicare taxes that a traditional employer would split with an employee. Filing is the mechanism that reports and calculates those contributions. A designer who brings in $2,000 from freelance projects and has $1,700 in expenses has $300 in net earnings and isn’t pushed into filing by this rule. If expenses only come to $1,500, the $500 net crosses the line.

Receiving a Form 1099-K or 1099-NEC doesn’t by itself mean you owe tax. Those forms report gross payments, not profit. The current federal reporting threshold for a payment platform to issue a 1099-K is $20,000 across more than 200 transactions.5Internal Revenue Service. Understanding Your Form 1099-K Whether or not one shows up in your mailbox, self-employment income above the $400 net threshold has to be reported.

Other Situations That Force a Return

Some events require a return regardless of what you earned. These are easy to miss because they have nothing to do with income level.

Marketplace Health Insurance Credits

If you bought coverage through the federal or a state marketplace and received advance payments of the Premium Tax Credit to lower your monthly premiums, you have to file and attach Form 8962 to reconcile what you got against what your final income actually entitled you to.6Internal Revenue Service. Instructions for Form 8962 (2025) Overpayments come back through the return; underpayments turn into extra refund.7HealthCare.gov. Health Care Tax Forms, Instructions and Tools Skipping the filing doesn’t erase an overpayment; the IRS catches up eventually.

Household Employment and Special Taxes

A handful of less common triggers also require a return no matter your income:3Internal Revenue Service. Check if You Need to File a Tax Return

  • You owe household employment taxes for a nanny, housekeeper, or similar worker.
  • You owe alternative minimum tax.
  • You took a distribution from a Health Savings Account or Archer MSA.
  • Your employer didn’t withhold enough Social Security or Medicare tax on your reported tips.
  • You earned at least $108.28 from a church or church-controlled organization that opted out of employer Social Security taxes.

Foreign Accounts

If the combined value of your financial accounts outside the U.S. exceeds $10,000 at any point during the year, you have to file FinCEN Form 114 (the FBAR) with the Financial Crimes Enforcement Network. That’s a separate filing from your tax return.8Financial Crimes Enforcement Network. BSA Electronic Filing Requirements for Report of Foreign Bank and Financial Accounts (FinCEN Form 114) A second layer, FATCA, requires Form 8938 (attached to a tax return) once specified foreign financial assets pass higher thresholds that vary with filing status and whether you live in the U.S. or abroad.9Internal Revenue Service. Reasons to File Even When You Don’t Have To

Being below the threshold isn’t always the best answer. If your employer withheld federal income tax from your paychecks, the only way to get that money back is to file a return. The IRS doesn’t cut refund checks unprompted.

Filing also opens the door to refundable credits that pay out even when you owe no tax:10Internal Revenue Service. Refundable Tax Credits

  • Earned Income Tax Credit, worth up to $8,046 for a family with three or more children (2025 figures, adjusted annually).
  • Child Tax Credit, up to $2,200 per qualifying child, with up to $1,700 refundable.
  • American Opportunity Tax Credit, up to $1,000 of which is refundable.

You generally have three years from the original due date of a return to claim a refund.11Internal Revenue Service. Time You Can Claim a Credit or Refund After that, the money stays with the Treasury. If you skipped a past year and think withholding or a credit was on the table, it’s worth checking before the window closes.

State Rules Are Separate

Federal thresholds don’t settle the state question. Most states with an income tax set their own filing floors, and those floors are often lower than the federal ones. Some states have no income tax at all; the rest use their own standard deductions, exemptions, and filing categories. Income that’s below the federal line can still be above your state’s line, so check your state tax agency’s current numbers before assuming you’re clear.
