When Will My Student Loan Be Written Off or Forgiven?

When will your student loan be written off? If it’s a federal loan, the shortest route is 10 years through Public Service Loan Forgiveness, the standard route is 20 or 25 years through an income-driven repayment plan, and an immediate discharge is possible if you become totally and permanently disabled, if you die, if your school closed or defrauded you, or if a bankruptcy court finds repayment would be an undue hardship. Private student loans sit outside almost all of this.

Ten Years: Public Service Loan Forgiveness

Public Service Loan Forgiveness (PSLF) is the fastest standard write-off available. It requires 120 qualifying monthly payments while you work full-time for a qualifying employer, which takes a minimum of 10 years.1eCFR. 34 CFR 685.219 – Public Service Loan Forgiveness Program The 120 payments do not have to be consecutive. If you leave qualifying employment for a stretch, the count pauses rather than resets.

Qualifying employers include any U.S.-based federal, state, local, or tribal government entity and any organization with 501(c)(3) tax-exempt status.2eCFR. 34 CFR 685.219 – Public Service Loan Forgiveness Program – Section: Qualifying Employer Full-time means averaging at least 30 hours per week. Teachers and professors on 8-month contracts count as full-time if they hit that 30-hour threshold during their work period.

Only Direct Loans qualify. If you still have older FFEL or Perkins loans, you’ll need to consolidate them into a Direct Consolidation Loan first. For consolidations completed after September 1, 2024, any qualifying payments you already made on underlying Direct Loans are preserved through a weighted average rather than wiped out.3eCFR. 34 CFR 685.219 – Public Service Loan Forgiveness Program – Section: Consolidation Payments on non-Direct loans don’t feed into that average.

Two timing rules catch people out. You must be employed by a qualifying employer both when you make your 120th payment and when you submit your forgiveness application. Leave the job before you apply and you lose eligibility until you return to qualifying work.4eCFR. 34 CFR 685.219 – Public Service Loan Forgiveness Program – Section: Borrower Eligibility You also can’t be in default when you request forgiveness. Submit employment certification periodically through your servicer so your payment count stays current and problems surface early rather than at the finish line.

Twenty or Twenty-Five Years: Income-Driven Repayment

Income-driven repayment (IDR) plans tie your monthly payment to what you earn, and after enough years of payments any remaining balance is forgiven. The exact clock depends on your plan and whether your debt is undergraduate or graduate.5eCFR. 34 CFR 685.209 – Income-Driven Repayment Plans

  • 20 years (240 payments) if you are repaying only undergraduate loans under Pay As You Earn (PAYE), you are a “new borrower” under Income-Based Repayment (IBR), or you are on REPAYE with only undergraduate debt.
  • 25 years (300 payments) if you have any graduate school debt on REPAYE, you are not a “new borrower” under IBR, or you are on Income-Contingent Repayment (ICR).

Months where your calculated payment is $0 because your income is low enough still count. The Department of Education tracks the total automatically and processes forgiveness without a separate application from you.6eCFR. 34 CFR 685.209 – Income-Driven Repayment Plans – Section: Tracking and Forgiveness

Parent PLUS Borrowers

If you borrowed through Direct PLUS as a parent, your path is narrower. Parent PLUS loans can’t enroll directly in most IDR plans. The only IDR option is ICR, and only after you consolidate the Parent PLUS loan into a Direct Consolidation Loan. Forgiveness under ICR comes after 25 years, and consolidation resets any prior payment count to zero, so the 25-year clock starts fresh.

If You Enrolled in SAVE

The Saving on a Valuable Education (SAVE) plan was the rebranded, expanded version of REPAYE, but court injunctions have blocked it since 2024. In December 2025 the Department of Education proposed a settlement with the state of Missouri that would end SAVE entirely: no new enrollments, pending applications denied, and current SAVE borrowers moved to other available plans.7Federal Student Aid. Income-Driven Repayment Court Actions The settlement is still pending court approval as of early 2026.

SAVE borrowers remain in a general forbearance unless they switched status, and interest began accruing again on August 1, 2025.7Federal Student Aid. Income-Driven Repayment Court Actions This matters for your write-off clock: general forbearance time typically does not count toward IDR forgiveness, so months in this limbo may not be adding to your 240 or 300. The Department of Education encourages using the Loan Simulator at studentaid.gov to look at plans you can switch to now.

Immediately: Total and Permanent Disability

If a severe physical or mental impairment prevents you from working, your federal loans can be discharged at any point. The regulation defines “totally and permanently disabled” as being unable to engage in any substantial gainful activity due to an impairment expected to result in death, that has lasted at least 60 continuous months, or that is expected to last at least 60 continuous months.8eCFR. 34 CFR 685.102 – Definitions

You can document eligibility three ways:9eCFR. 34 CFR 685.213 – Total and Permanent Disability Discharge

  • A VA determination that you are unemployable due to a service-connected disability. No additional medical documentation is required.
  • An SSA notice of award or Benefit Planning Query showing you qualify for SSDI or SSI based on disability, subject to certain conditions about your next scheduled disability review.
  • Certification from a physician, nurse practitioner, physician assistant, or licensed clinical psychologist confirming you meet the disability definition.

After the discharge is granted, there’s a three-year monitoring window during which it can be reversed if you take out a new federal student loan or receive a new TEACH Grant.9eCFR. 34 CFR 685.213 – Total and Permanent Disability Discharge Clear the three years without triggering reinstatement and the discharge is permanent.

Immediately: Death

Federal student loans are discharged when the borrower dies. For Parent PLUS loans, the debt is also discharged if the student on whose behalf the parent borrowed dies.10eCFR. 34 CFR 685.212 – Discharge of a Loan Obligation The family or estate submits an original or certified death certificate, a verified photocopy, or a scanned electronic copy. The Department of Education can also verify the death through an approved federal or state electronic database.11Federal Student Aid Knowledge Center. Required Actions When a Student Dies

If a Parent PLUS loan was folded into a Direct Consolidation Loan and the student dies, the Department discharges the portion of the consolidated balance attributable to that PLUS loan.10eCFR. 34 CFR 685.212 – Discharge of a Loan Obligation Any payments received after the date eligibility began are returned.

Immediately: When the School Was the Problem

If a school closed, lied, or certified a loan it shouldn’t have, the loans tied to that school can be written off without waiting out a repayment clock.

Closed School Discharge

If your school shut down while you were enrolled, or you withdrew within 180 days before the closure, you can apply to have the loans for that program discharged.12eCFR. 34 CFR 685.214 – Closed School Discharge The 180-day window can be extended for exceptional circumstances. There’s one disqualifier: if you completed a comparable program at another school through a teach-out agreement or by transferring credits, you aren’t eligible. The logic is simple. If you got the education, the loan stays.

Borrower Defense to Repayment

If a school made a substantial misrepresentation that you reasonably relied on when deciding to enroll or borrow, you can file a borrower defense claim to have the debt discharged.13eCFR. 34 CFR 685.222 – Borrower Defenses and Procedures This isn’t limited to inflated job placement numbers. Any material false claim about cost, accreditation, or transferability of credits can qualify if you relied on it and were harmed. Claims to recover money already paid are subject to a six-year limitations period running from when you discovered, or should have discovered, the misrepresentation.

False Certification Discharge

A separate path applies when the school certified eligibility for a loan that should never have been issued. It covers three situations:14Federal Student Aid. False Certification Discharge

  • Identity theft, where someone fraudulently took out a loan in your name.
  • Unauthorized signature, where a school employee signed loan documents or endorsed your loan check without your knowledge or permission.
  • Disqualifying status, where the school enrolled you in a program for an occupation you could never legally enter because of a physical or mental condition, age, criminal record, or other barrier under state law.15Federal Student Aid. Loan Discharge Application – False Certification Disqualifying Status

For the disqualifying-status ground, only loans made on or after January 1, 1986 are eligible.

Bankruptcy

Discharging student loans in bankruptcy is harder than wiping out credit card or medical debt, but it has become more accessible in recent years and shouldn’t be dismissed if you are in genuine financial distress.

Student loans are excluded from a standard bankruptcy discharge unless you can demonstrate “undue hardship” through a separate court proceeding called an adversary action.16Office of the Law Revision Counsel. 11 USC 523 – Exceptions to Discharge Most courts apply the three-part Brunner test:17United States Bankruptcy Court. Guidelines for Adversary Proceedings Under 11 USC 523(a)(8)

  • You cannot maintain a minimal standard of living for yourself and your dependents if forced to repay.
  • The hardship is likely to persist for a significant portion of the repayment period.
  • You have made good-faith efforts to repay before filing.

A smaller number of courts use a broader “totality of the circumstances” test that weighs the same factors without treating any single one as an automatic disqualifier.

Since November 2022, the Department of Justice and Department of Education have used an attestation process for federal loan borrowers in adversary proceedings. The DOJ attorney sends an attestation form that collects income, expenses, and loan history under penalty of perjury.18Department of Justice. Student Loan Attestation Fillable Form If your circumstances satisfy the undue hardship factors, DOJ attorneys are directed to stipulate to the facts and recommend that the court grant a full or partial discharge.17United States Bankruptcy Court. Guidelines for Adversary Proceedings Under 11 USC 523(a)(8) The legal standard hasn’t changed, but the government contests fewer of these cases than it used to. Attorney fees for an adversary proceeding still run several thousand dollars, which keeps the option out of reach for some borrowers who might qualify.

Private student loans can be discharged in bankruptcy under the same undue hardship standard.16Office of the Law Revision Counsel. 11 USC 523 – Exceptions to Discharge

The Tax Bill Waiting at the Finish Line

A write-off isn’t always free. The temporary American Rescue Plan Act provision that excluded nearly all student loan forgiveness from federal taxable income expired on December 31, 2025.19Internal Revenue Service. Instructions for Forms 1099-A and 1099-C Starting in 2026, treatment depends on why your loan was discharged:

If you are insolvent at the time of discharge, meaning your total debts exceed your total assets, you may be able to exclude some or all of the forgiven amount using IRS Form 982. Some states exclude student loan forgiveness from state income; others tax it. Check your state’s rules well before your forgiveness year so a five-figure tax bill doesn’t catch you off guard.

Private Student Loans

Private student loans have almost none of the discharge paths above. There is no IDR forgiveness, no PSLF, no disability discharge program, and no closed-school discharge. Your options are to negotiate a settlement with the lender, refinance, pursue bankruptcy under the undue hardship standard, or wait out the statute of limitations.

Each state sets its own statute of limitations on private student loan debt, and the range runs roughly 3 to 15 years depending on the state and whether the loan is governed by a written contract or promissory note. After that period expires, the lender can no longer sue to collect, though the debt itself doesn’t vanish and can continue to appear on your credit report for up to seven years from the date of first delinquency.

If Your Loan Is in Default

A loan in default is not eligible for most of the programs above. You can’t apply for PSLF, enroll in an IDR plan, or receive IDR forgiveness while your loans are in default. The Fresh Start program that ran through October 2024 gave defaulted borrowers a one-time path back to good standing.22Federal Student Aid. A Fresh Start for Federal Student Loan Borrowers in Default That window has closed. If you’re currently in default, you’ll need to go through loan rehabilitation (nine agreed-upon payments over 10 months) or consolidation before any of these write-off clocks can start, or restart, running.
