When to Use Form 1099-MISC: Thresholds, Deadlines, Penalties

Use Form 1099-MISC when your business made certain non-service payments of $2,000 or more to a payee during the 2026 tax year, including rents, prizes and awards, medical and health care payments, crop insurance proceeds, and gross proceeds paid to an attorney.1Internal Revenue Service. 1099-MISC or 1099-NEC

The most common filing error is putting contractor pay on 1099-MISC. Before 2020, nonemployee compensation went in Box 7 of the 1099-MISC. That box no longer serves that purpose. If you paid someone for work they did, use 1099-NEC.2Internal Revenue Service. Reporting Payments to Independent Contractors If you paid someone for something other than services, keep reading.

The two forms have different filing deadlines, and misreporting nonemployee compensation on 1099-MISC can delay processing and generate automated penalty notices. The test is simple: services go on 1099-NEC; the categories below go on 1099-MISC.

The IRS can also waive penalties for reasonable cause.
