When to Renew Your EAD: 180-Day Window, Fees, and Gaps

File your Form I-765 renewal about 180 days — roughly six months — before your current Employment Authorization Document expires. That has always been the USCIS recommendation, but knowing when to renew your EAD matters more now than it used to: for renewal applications filed on or after October 30, 2025, there is no longer any automatic extension to keep you working while USCIS decides your case.1U.S. Citizenship and Immigration Services. DHS Ends Automatic Extension of Employment Authorization If your new card hasn’t been approved by the expiration date on your old one, your work authorization simply lapses.

Why the 180-Day Window Changed in Importance

Until recently, a timely renewal triggered an automatic extension of your work authorization for up to 540 days while USCIS processed the new application. That cushion no longer exists. DHS issued an interim final rule ending automatic EAD extensions for anyone who files on or after October 30, 2025.2U.S. Citizenship and Immigration Services. Automatic Employment Authorization Document (EAD) Extension The only carve-outs are extensions provided by law or announced through a Federal Register notice for TPS-related employment documentation.

The practical effect is straightforward. If USCIS is still working on your renewal when your card’s expiration date arrives, you have no bridge. You would need to stop working until the new EAD is approved, and processing can stretch for months depending on your category. Filing the full 180 days early gives USCIS the maximum runway to finish adjudicating before your current card runs out.1U.S. Citizenship and Immigration Services. If You Filed Before October 30, 2025

The old rules still apply to applications filed before that date. If you filed under the same eligibility category as your expiring EAD and received a Form I-797C receipt notice, you may have gotten an extension of up to 540 days. During that window, your expired card paired with the receipt notice functions as proof of continued work authorization for Form I-9 purposes.3U.S. Citizenship and Immigration Services. What a Gap in Work Authorization Actually Costs

Working after your EAD expires and before your new card is approved counts as unauthorized employment under immigration law. The consequences reach far beyond losing paychecks. USCIS treats unauthorized employment as a potential bar to adjusting status to lawful permanent residence.4U.S. Citizenship and Immigration Services. USCIS Policy Manual Volume 7 Part B Chapter 6 – Unauthorized Employment

Two provisions can block a future Green Card. One bars adjustment if you accepted or continued unauthorized employment before filing for adjustment of status. The other bars adjustment if you have ever engaged in unauthorized employment at any point, before or after filing. Leaving the country and returning does not erase either bar.4U.S. Citizenship and Immigration Services. USCIS Policy Manual Volume 7 Part B Chapter 6 – Unauthorized Employment

Some categories are exempt, including immediate relatives of U.S. citizens, VAWA-based applicants, and special immigrant juveniles. Employment-based applicants may also qualify for exemption in some circumstances. For everyone else, even a few weeks of unauthorized work can damage the path to permanent residence. If your card expires before your renewal is approved, stop working until the new one arrives.

How to File the Renewal

Use Form I-765, Application for Employment Authorization, and select the option for renewing employment authorization. You can file online through a USCIS account or mail a paper application to the appropriate USCIS Lockbox. The correct address depends on your eligibility category and where you live, so check the current filing instructions on the Form I-765 page before you send anything.5U.S. Citizenship and Immigration Services. Supporting documents vary by category. USCIS publishes a checklist tailored to each eligibility code on the I-765 page. Common items include passport-style photographs (unmounted and unretouched) and evidence of your current immigration status. H-4, E, and L-2 dependent spouses also need to include an unexpired Form I-94.3U.S. Citizenship and Immigration Services. If you mail the application, use a delivery service that provides tracking. USCIS does not acknowledge receipt until it issues its own notice, and tracking is the only way to confirm the package arrived.

Filing Fees

USCIS adjusted filing fees effective January 1, 2026, so a renewal postmarked on or after that date must include the updated amount. The fee depends on your category:6U.S. Citizenship and Immigration Services. USCIS Announces FY 2026 Inflation Increase for Certain Immigration-Related Fees

  • Asylum applicant EAD renewal, category (c)(8): $275
  • Parole-based EAD renewal or extension: $280
  • TPS-based EAD renewal or extension: $280

Fees for other categories may differ; check the current Form I-765 filing instructions for your specific code. If you originally filed the I-765 alongside a Form I-485 adjustment application, the EAD fee was bundled into the I-485 fee. A standalone renewal after that carries its own separate fee. Most categories can request a fee waiver on Form I-912 based on financial hardship, though DACA recipients filing under category (c)(33) cannot.7U.S. Citizenship and Immigration Services. After You File

USCIS mails a Form I-797C, Notice of Action, confirming receipt of your application. Keep it. It may also schedule you for a biometrics appointment at a local Application Support Center to collect fingerprints, a photograph, and a signature.8U.S. Citizenship and Immigration Services. Preparing for Your Biometric Services Appointment Missing that appointment can delay or derail the case, so treat it as mandatory.

Processing times fluctuate and vary by category. Current estimates are on the USCIS processing times page under Form I-765. When your renewal is approved, USCIS mails the new card to the address on file. A denial comes with a written explanation.

Keep Your Address Current

If you move while the renewal is pending, report the new address to USCIS within 10 days. The simplest method is through your USCIS online account, which satisfies the legal notification requirement without a separate paper form. You can also file paper Form AR-11.9U.S. Citizenship and Immigration Services. AR-11, Alien’s Change of Address Card If you don’t update your address, USCIS sends the new EAD card, biometrics notices, and any requests for evidence to somewhere you no longer live, and missed correspondence can produce a denial.

If You’re Already Close to the Deadline

USCIS allows expedite requests for EAD renewals in limited circumstances. Severe financial loss is one qualifying ground, but a general need for work authorization is not enough on its own.10U.S. Citizenship and Immigration Services. Expedite Requests The agency looks for concrete evidence such as risk of losing your job, a company at risk of failing or losing a critical contract, or loss of critical public benefits.

There is an important limit. USCIS will not grant an expedite where the urgency comes from your own late filing. If you waited until the last minute, that argument alone is unlikely to work.10U.S. Citizenship and Immigration Services. Expedite Requests Filing 180 days out is the reliable answer.

A Note for Combo Card Holders

If you have a pending adjustment of status application, you may hold a combined EAD and advance parole card. The two permissions are separate even though they share a card. A pending renewal does not authorize international travel. Leaving the United States without a valid, approved advance parole document can cause USCIS to treat the pending I-485 as abandoned. If a true emergency requires travel while your renewal is pending, you can request emergency advance parole through a local USCIS field office with documentation of the urgent circumstances, but do not assume the renewal itself covers travel until the physical document is in your hand.
