When to Apply for EAD Renewal After Rule Changes

Apply to renew your Employment Authorization Document up to 180 days before the expiration date printed on your current card, and treat that 180-day mark as the target rather than the outer limit. Filing early matters more in 2026 than it did a year ago because the temporary rule that automatically extended expired EADs for up to 540 days while a renewal was pending no longer applies to new filings. If your card expires before USCIS decides your renewal, your right to work stops on the expiration date.

The 180-Day Filing Window

USCIS accepts Form I-765 renewal applications up to 180 days before the expiration date on your current EAD (Form I-766). You can file later than that, and your application is still valid as long as it arrives before the card expires, but every week you wait shrinks your cushion against processing delays.

Processing times for EAD applications routinely stretch to several months depending on your eligibility category and the service center handling the case. USCIS publishes processing time estimates on its website, but treat those as rough guides. The 180-day window exists because it usually covers a realistic worst case; filing at day 90 or day 60 assumes USCIS will move faster than it often does.

Why Filing Early Matters More Now

Between April 2024 and October 30, 2025, a temporary federal rule gave eligible EAD renewal applicants an automatic extension of up to 540 days past their card’s expiration while USCIS worked through the renewal.1U.S. Citizenship and Immigration Services. Handbook for Employers M-274 – 5.1 Automatic Extensions Based on a Timely Filed Application to Renew Employment Authorization That rule expired on October 30, 2025. Renewals filed after that date do not get an automatic extension.2eCFR. 8 CFR 274a.13 – Application for Employment Authorization

The practical effect is straightforward. Once your card expires, your work authorization lapses unless USCIS has already approved the renewal or your underlying immigration status independently authorizes employment. There is no safety net between the expiration date and the approval date. That is the single strongest reason to file at the 180-day mark rather than waiting.

If you filed your renewal before October 30, 2025, and your application is still pending, you may still benefit from the 540-day extension under the old rule.1U.S. Citizenship and Immigration Services. Handbook for Employers M-274 – 5.1 Automatic Extensions Based on a Timely Filed Application to Renew Employment Authorization For anyone filing now, plan as though no extension exists.

TPS-Based EADs Follow a Different Rule

If you hold Temporary Protected Status, a separate limit applies. Under H.R. 1, signed into law in 2025, TPS-based EADs for renewal applications pending or filed on or after July 22, 2025, can only be automatically extended for up to one year or the duration of the TPS designation, whichever is shorter. The earlier 540-day extension does not apply to TPS holders in this group, even if the I-797C receipt notice lists the longer period.3U.S. Citizenship and Immigration Services. Filing Late, or After Expiration

Filing inside the 180-day window but past the ideal date is common and permitted. The application is timely as long as USCIS receives it before your EAD expires.

Filing after your EAD has already expired is a different situation. At that point you are no longer renewing; you are applying for a new EAD. You cannot claim any automatic extension, and depending on your category you may already be accruing days of unauthorized status or unauthorized employment. Any work you perform between the expiration date and the approval of a new EAD is unauthorized.

What You Need to File

Have your paperwork ready before you reach the 180-day mark so filing is not what delays you. The core requirements are Form I-765 with the correct eligibility category code, two passport-style photos meeting USCIS specifications,4U.S. Citizenship and Immigration Services. Application for Employment Authorization a copy of the front and back of your current EAD, and proof of your immigration status, which varies by category. Refugees and asylees, for example, need a copy of a stamped I-94 or a USCIS approval letter.5U.S. Citizenship and Immigration Services. Form I-765 Instructions Some categories require additional evidence, such as a pending asylum receipt or an approved I-140; the I-765 instructions list what your category needs.

Any document not in English needs a certified English translation with the translator’s signed statement of fluency and accuracy, plus their name, address, and date.

The filing fee has historically been $520 for paper filing and $470 for online submissions, with a reduced fee of $260 when filed with a Form I-485. H.R. 1 changed some USCIS fees, so confirm the current amount with the USCIS fee calculator before you send anything. Fee waivers using Form I-912 are available for most I-765 categories based on financial hardship, though DACA applicants under category (c)(33) cannot receive a waiver.6U.S. Citizenship and Immigration Services. You can file online through a USCIS account if your category is eligible, or by mail to the address listed in the I-765 instructions for your category.4U.S. Citizenship and Immigration Services. Application for Employment Authorization If you mail it, use a tracked delivery service. A lost package with no proof of receipt is a serious problem when your work authorization depends on the filing date.

After You File

USCIS mails a receipt notice (Form I-797C) confirming they received your application, with a 13-digit receipt number for checking status online.7U.S. Citizenship and Immigration Services. Form I-797C, Notice of Action Some applicants receive a biometrics appointment notice; attend on time, because missing it can delay or derail the case. USCIS may also send a Request for Evidence if something is missing. Respond promptly and completely. An ignored or incomplete RFE response is one of the most common reasons renewals are denied, and it is avoidable.

Every one of these steps can add weeks. That is the case for filing at 180 days rather than treating the window as a countdown.

If Your Card Expires Before Approval

If you filed on time but the card expires before USCIS decides the case, and no automatic extension applies to you, stop working on the expiration date. Your employer must stop allowing you to work until USCIS approves the renewal and you present the new EAD. Talk to your employer before the expiration date so the transition does not surprise either of you.

Continuing to work is not a minor risk. Unauthorized employment can bar you from adjusting to permanent resident status. The bar applies whether the unauthorized work happened before or after you filed for adjustment, and leaving the country does not erase it. Some applicants are exempt, including immediate relatives of U.S. citizens and VAWA-based applicants. Employment-based green card applicants may qualify for a limited exception forgiving up to 180 total days of status violations, but that count includes every calendar day the unauthorized work continued, weekends and holidays included.8U.S. Citizenship and Immigration Services. Chapter 6 – Unauthorized Employment

A few weeks of paychecks can cost a green card. That is the calculation behind the 180-day rule: file early enough that the choice never has to be made.
