A business issues a Form 1099 when it has paid a non-corporate recipient at or above the applicable dollar threshold — usually $600 — for services, rents, or certain other payments made in the course of a trade or business during the calendar year. The recipient’s copy is generally due by January 31 of the following year. The IRS copy is also due January 31 for Form 1099-NEC; for Form 1099-MISC and most other 1099s, the IRS copy is due February 28 on paper or March 31 electronically.1Internal Revenue Service. The Dollar Amount That Triggers a 1099
A 1099 is only required once total payments to a single recipient during the year reach the threshold set for that form. The threshold applies to the cumulative total across the year, not to any single check.1Internal Revenue Service. Instructions for Forms 1099-MISC and 1099-NEC (04/2025) Pay a contractor $200 in March, $250 in July, and $150 in November, and the $600 total triggers a 1099-NEC even though no single payment crossed the line.
The thresholds that matter most:
- $600 for nonemployee compensation reported on Form 1099-NEC, and for rents, prizes, awards, medical and health care payments, and attorney payments reported on Form 1099-MISC.2Office of the Law Revision Counsel. 26 USC 6041 – Information at Source
- $10 for royalties on Form 1099-MISC and for interest income on Form 1099-INT.3Internal Revenue Service. About Form 1099-MISC, Miscellaneous Information4Office of the Law Revision Counsel. 26 USC 6049 – Returns Regarding Payments of Interest
- $20,000 in payments and more than 200 transactions for third-party payment processors filing Form 1099-K. Both tests must be met in the same calendar year.5IRS.gov. Publication 1099 General Instructions for Certain Information Returns – For Use in Preparing 2026 Returns
Which Payments Count
Only payments made in the course of a trade or business trigger 1099 reporting. Personal payments — hiring someone to mow your lawn at home, for example — do not count, regardless of amount.6Internal Revenue Service. Am I Required to File a Form 1099 or Other Information Return
Services: Form 1099-NEC
Use Form 1099-NEC for $600 or more paid for services performed by someone who is not your employee: independent contractors, consultants, freelancers, accountants, engineers, and similar professionals.7Internal Revenue Service. About Form 1099-NEC, Nonemployee Compensation The reportable amount includes both labor and any parts or materials the contractor billed as part of the service.1Internal Revenue Service. Other Payments: Form 1099-MISC
Form 1099-MISC covers other payment types at the $600 threshold, including rent for office or equipment space, prizes and awards, medical and health care payments, and crop insurance proceeds. It also picks up royalties of $10 or more.3Internal Revenue Service. About Form 1099-MISC, Miscellaneous Information
Attorneys
Payments to attorneys follow their own rules. Legal fees you pay directly to an attorney for services go on Form 1099-NEC. Settlement proceeds that pass through an attorney’s trust account on the way to a client are reported on Form 1099-MISC, box 10, at the gross amount.8IRS.gov. Instructions for Forms 1099-MISC and 1099-NEC (Rev. April 2025)
Barter
Trading services instead of paying cash does not exempt the transaction. The fair market value of services exchanged with another business is reportable on Form 1099-MISC if it reaches $600 and the other party is not a corporation.9IRS.gov. Who Gets a 1099 and Who Doesn’t
The payee’s legal structure determines whether a 1099 is required. Collect a Form W-9 before making the first payment so you have the taxpayer identification number and business classification on file.
You issue a 1099 when payments reach the threshold to:
- Individuals and sole proprietors, including independent contractors, freelancers, and single-member LLCs that have not elected corporate tax treatment.
- Partnerships, including general partnerships, limited partnerships, and multi-member LLCs taxed as partnerships.
- The estate of a deceased person receiving payment for services.
Most payments to C corporations and S corporations are exempt. Two exceptions override that: payments for legal services and payments for medical or health care must be reported regardless of the recipient’s corporate status.8IRS.gov. Instructions for Forms 1099-MISC and 1099-NEC (Rev. April 2025)
Payments made by credit card, debit card, or a third-party payment processor such as PayPal or Stripe are also outside your reporting obligation on 1099-NEC or 1099-MISC. The payment processor reports those amounts on Form 1099-K, which prevents duplicate reporting of the same income.10Internal Revenue Service. What to Do With Form 1099-K
Deadlines by Form Type
Recipients must generally receive their copy by January 31 following the payment year. The IRS filing deadline depends on the form and how you file. If any deadline lands on a weekend or federal holiday, it shifts to the next business day.
Form 1099-NEC
One date covers everything: January 31. Both the recipient copy and the IRS copy are due January 31, whether you file on paper or electronically. There is no extended March deadline for electronic 1099-NEC filers.1Internal Revenue Service. Instructions for Forms 1099-MISC and 1099-NEC (04/2025)
Form 1099-MISC
Recipient copies are due January 31. The IRS copy is due February 28 on paper or March 31 electronically.1Internal Revenue Service. Instructions for Forms 1099-MISC and 1099-NEC (04/2025)
Other 1099s
Forms 1099-INT (interest), 1099-DIV (dividends), 1099-B (brokerage), and 1099-K (payment card and third-party network transactions) follow the same pattern as the 1099-MISC: recipient copies by January 31, IRS copies by February 28 on paper or March 31 electronically.
If You Need More Time
Form 8809 requests additional filing time from the IRS, and the rules split by form.
For 1099-MISC and most other information returns, the extension is automatic: 30 days, no justification required, no signature required, provided you submit Form 8809 by the original due date.11IRS.gov. Form 8809 Application for Extension of Time to File Information Returns
Form 1099-NEC is different. Because the January 31 deadline is already tight, there is no automatic extension. You must supply a written justification, and no second 30-day extension is available.11IRS.gov. Form 8809 Application for Extension of Time to File Information Returns
An IRS filing extension does not push back the January 31 recipient deadline. Payees still need their copies by the end of January.
Penalties for Missing the Deadline
Penalties apply separately to two failures: filing an incorrect or late return with the IRS, and furnishing an incorrect or late copy to the payee. The amount per form escalates with how late the filing is. For returns due in 2026:12Internal Revenue Service. Information Return Penalties
- Up to 30 days late: $60 per form.
- 31 days late through August 1: $130 per form.
- After August 1 or never filed: $340 per form.
- Intentional disregard: $680 per form with no annual cap.
Small businesses (average annual gross receipts of $5 million or less) have lower annual maximums: $239,000 for forms up to 30 days late, $683,000 for forms filed between 31 days late and August 1, and $1,366,000 for forms filed after August 1 or not at all.13Internal Revenue Service. IRM 20.1.7 Information Return Penalties
Penalty relief for reasonable cause is available but narrow. The IRS looks for events beyond your control or significant mitigating factors, along with evidence you acted responsibly before and after the failure. Natural disasters, inability to access records, serious illness, and system issues that blocked timely electronic filing are examples that may qualify. Reliance on a tax professional, general lack of knowledge, and simple oversights typically do not.14Internal Revenue Service. Penalty Relief for Reasonable Cause
If You’re the One Who Received the 1099
If you received a 1099 with a wrong amount, wrong name, or income you did not earn, contact the payer and ask for a corrected form. The payer is responsible for filing the correction with the IRS and sending you an updated copy.15Internal Revenue Service. What to Do When a W-2 or Form 1099 Is Missing or Incorrect
If the payer will not fix it, file your return reporting only the income you actually received. If a corrected form arrives after you have already filed and it changes your tax, submit Form 1040-X to amend the return.15Internal Revenue Service. What to Do When a W-2 or Form 1099 Is Missing or Incorrect
One boundary worth knowing: the $600 threshold governs when a payer must issue a 1099, not when you must report the income. All taxable income belongs on your return whether or not a 1099 shows up in the mail.
