An H-4 spouse can apply for an Employment Authorization Document the moment one of two things happens to the H-1B worker they’re married to: either USCIS approves an I-140 immigrant petition filed by the H-1B worker’s employer, or the H-1B worker is granted an extension beyond the standard six-year limit under sections 106(a) and (b) of the American Competitiveness in the Twenty-First Century Act (AC21). Those are the only two triggers. Without one of them, H-4 status by itself carries no right to work.
The rule is spelled out in federal regulation. 8 CFR 214.2(h)(9)(iv) states plainly that H-4 status “does not confer eligibility for employment authorization incident to status.”1eCFR. 8 CFR 214.2 Eligibility is derivative: it flows from where the H-1B spouse sits in the green card process.
Trigger One: An Approved I-140
This is the cleaner of the two paths. Once the H-1B worker’s employer has filed Form I-140 (Immigrant Petition for Alien Worker) and USCIS has approved it, the H-4 spouse can file for work authorization. The controlling document is the I-797 approval notice for that I-140.
Visa number availability is irrelevant here. The green card backlog for the H-1B worker’s country of birth could be a decade long, and it doesn’t matter. Approval of the I-140 is the trigger, not visa retrogression or priority date movement.2U.S. Citizenship and Immigration Services. Employment Authorization for Certain H-4 Dependent Spouses
Trigger Two: An AC21 Extension Past Six Years
H-1B workers normally max out at six years in that status. AC21 lets them stay longer if their permanent residence process has been dragging. When the H-1B worker receives an extension under AC21 sections 106(a) and (b), the H-4 spouse becomes eligible for an EAD.2U.S. Citizenship and Immigration Services. Employment Authorization for Certain H-4 Dependent Spouses These extensions are generally available when a labor certification application or an I-140 was filed at least 365 days before the extension period begins.1eCFR. 8 CFR 214.2
The AC21 path requires more paper than the I-140 path. Expect to gather the H-1B worker’s passport, prior I-94 records, current and past I-797 approval notices for I-129 petitions, and evidence of the specific AC21 basis, such as a long-pending labor certification or a long-pending I-140.2U.S. Citizenship and Immigration Services. Who the Rule Does Not Cover
Two limits catch people off guard. First, this program is only for spouses. H-4 dependent children cannot apply for an EAD, no matter where the H-1B parent stands in the green card queue. Second, both the H-1B worker and the H-4 spouse must be in valid status at the time the EAD application is filed; the regulation requires evidence that the H-1B beneficiary is currently in H-1B status and the H-4 spouse is currently in H-4 status.1eCFR. 8 CFR 214.2 A lapse on either side blocks the application.
Filing at or After the Trigger
The application is Form I-765, Application for Employment Authorization. On the form, the eligibility category is (c)(26), which is the code specifically designated for H-4 spouses of H-1B workers.3U.S. Citizenship and Immigration Services. Filing Form I-765 with Other Forms The wrong code means a denial, so verify that field before submitting.
Along with the form, USCIS wants three categories of evidence:2U.S. Citizenship and Immigration Services. Employment Authorization for Certain H-4 Dependent Spouses
- Proof of your H-4 status: an I-797 approval notice for your I-539 extension, or an I-94 admission record.
- Proof of marriage: your marriage certificate.
- Proof of the eligibility basis: the I-797 for the H-1B worker’s approved I-140, or the AC21 documentation set described above.
You do not have to wait for a separate H-4 approval before filing the I-765. USCIS allows concurrent filing of the I-765 with Form I-539 (extension or change of status) or alongside the H-1B worker’s Form I-129 petition for (c)(26) applicants.3U.S. Citizenship and Immigration Services. Filing Form I-765 with Other Forms Bundling the filings is usually the better strategy because it lines up the timelines instead of stacking them end to end.
One recent change: as of January 2026, USCIS removed the option to request a Social Security Number directly through the I-765. If you need an SSN, apply separately at a Social Security Administration office after your EAD arrives.
What to Expect After Filing
USCIS issues a Form I-797C, Notice of Action, confirming receipt.4U.S. Citizenship and Immigration Services. Form I-797 Types and Functions Hold onto it; the receipt number lets you track the case and proves the application is pending.
H-4 EAD processing has generally run about five to six months, with fluctuations depending on service center workload. Premium processing is not available for this category, so paying for speed is not an option. Filing early and filing completely are the only real controls you have; a Request for Evidence can add months.
Approved EADs are mailed to the address on the application and authorize work for any U.S. employer without job or company restrictions. As of December 2025, the maximum validity of a newly issued EAD is 18 months, down from the previous five-year cap. Plan the next renewal accordingly.
Travel While the Application Is Pending
If you already hold valid H-4 status and only filed the I-765, international travel generally does not cause abandonment. If you filed I-539 at the same time, leaving the country before the I-539 is approved causes USCIS to treat that application as abandoned, which pulls down the I-765 filed with it.2U.S. Citizenship and Immigration Services. Employment Authorization for Certain H-4 Dependent Spouses When both are pending, staying put is the safer call.
Renewals: File 180 Days Out
Renewal applications can go in up to 180 days before the current EAD expires. Because H-4 EAD validity tracks H-4 status, which tracks the H-1B worker’s status, renewals often need to be coordinated with an H-1B extension. Bundling the H-1B I-129, the H-4 I-539, and the H-4 I-765 renewal is usually the efficient move.
The timing matters more than it used to. For renewal applications filed before October 30, 2025, USCIS granted an automatic extension of work authorization for up to 540 days while the renewal was pending. That safety net is gone for renewals filed on or after October 30, 2025.5U.S. Citizenship and Immigration Services. Handbook for Employers M-274 – 5.1 Automatic Extensions If your EAD expires while USCIS is still processing the renewal, you cannot legally work in the gap. Filing at the earliest permitted date is no longer a nice-to-have.
Events That End Work Authorization Before the Card Expires
Because the EAD is derivative, several events can shut it down early:
- Divorce. H-4 status terminates when a divorce becomes final, and the EAD becomes invalid at the same moment. No grace period applies to work authorization.
- H-1B job loss. When the H-1B worker is terminated, both spouses get a maximum 60-day grace period. The H-4 EAD remains valid during that window. If the H-1B worker does not secure a new employer or change status within 60 days, both spouses fall out of status and the EAD is no longer usable.6U.S. Citizenship and Immigration Services. Options for Nonimmigrant Workers Following Termination of Employment
- H-1B status lapse. Any gap in the H-1B worker’s status, whether from a missed extension or a denied petition, flows through to the H-4 spouse and the EAD.
The consistent thread across all of it: H-4 work authorization exists only as long as the H-1B worker holds status and the marriage stands. Every H-1B extension deadline is your deadline too.
