If your employer or client didn’t give you a 1099, report the income anyway using your own records, and if the January 31 furnishing deadline has passed, contact the payer, then call the IRS if they don’t respond.1Internal Revenue Service. What to Do When a W-2 or Form 1099 Is Missing or Incorrect The missing form does not change what you owe. The IRS requires you to include all earnings on your tax return whether or not a payer sends a Form 1099-NEC, and the $600 reporting threshold that triggers the payer’s duty to issue the form has nothing to do with your duty to pay tax on what you earned.2Internal Revenue Service. Form 1099-K FAQs – General Information
Payers have until January 31 following the tax year to get your copy to you.3Internal Revenue Service. General Instructions for Certain Information Returns (2026) Mail delays happen in early February. By mid-February, start making calls.
Was a 1099 Even Required?
Before chasing a form, confirm the payer owed you one. A business or individual who pays you $600 or more during the year for services you perform as a non-employee must send you a Form 1099-NEC.4Internal Revenue Service. Instructions for Forms 1099-MISC and 1099-NEC Four conditions have to line up: the payment was for services, you weren’t the payer’s employee, the payer made the payment in the course of their trade or business, and total payments to you reached at least $600 for the year.
Two situations commonly explain a “missing” form that was never required in the first place. Payments to corporations (including LLCs taxed as C or S corporations) generally don’t require a 1099-NEC, though legal fees are an exception.4Internal Revenue Service. Instructions for Forms 1099-MISC and 1099-NEC And payments made through a credit card, debit card, or third-party payment network like PayPal or Venmo are not supposed to appear on a 1099-NEC at all; those transactions get reported by the processor on Form 1099-K instead.5Internal Revenue Service. The $600 Threshold Is Not a Tax-Free Line
Independent contractors trip over this often. The $600 figure applies only to the payer’s obligation to file the form. It is not a floor on what you owe tax on. If a client paid you $400 for freelance work, no 1099-NEC is required, but the IRS still expects you to report that $400 as income.2Internal Revenue Service. Form 1099-K FAQs – General Information All income is taxable unless the tax code specifically says otherwise, with or without a form in your mailbox.
Contact the Payer First
Reach out to the business that paid you. Ask specifically for a Form 1099-NEC and confirm they have your correct mailing address and taxpayer identification number. A surprising share of missing forms come down to a wrong digit in a ZIP code or an outdated address on file. Give a reasonable deadline for a response, and follow up in writing if a phone call doesn’t produce results.
Keep records of every attempt: dates, who you spoke with, and what they said. If this escalates to an IRS inquiry, a paper trail showing a good-faith effort matters.
Call the IRS
If the payer doesn’t respond or refuses to issue the form by the end of February, call the IRS at 800-829-1040.1Internal Revenue Service. What to Do When a W-2 or Form 1099 Is Missing or Incorrect Have ready:
- Your name, address, phone number, Social Security number, and the dates you performed the work
- The payer’s name, address, and phone number
The IRS will contact the payer directly and request the missing form. A call from the IRS tends to be more motivating than one from you, and this step is often enough.
If the payer still refuses after the IRS contacts them, you can file Form 3949-A (Information Referral) to report the non-compliance.6Internal Revenue Service. About Form 3949-A, Information Referral This won’t produce your 1099 any faster, but it puts the payer on the IRS’s radar. Payers face per-form penalties for failing to file, with the heaviest tier reserved for intentional disregard and carrying no annual maximum cap.7Internal Revenue Service. File Your Return Without the Form
Don’t wait on the payer to file your taxes. Report all self-employment income on Schedule C (Form 1040), where you list gross receipts and subtract eligible business expenses to arrive at your net profit or loss.8Internal Revenue Service. About Schedule C (Form 1040), Profit or Loss From Business (Sole Proprietorship) Base the amounts on your own records:
- Bank statements showing deposits
- Invoices you sent
- Payment confirmations from apps or email
- Contracts and written agreements
Unlike a missing W-2, where the IRS provides Form 4852 as a substitute, there is no IRS substitute form specifically for a missing 1099-NEC.9Internal Revenue Service. About Form 4852, Substitute for Form W-2, Wage and Tax Statement You simply report the income from your records. If you later receive a 1099-NEC showing a different amount than what you reported, and the difference changes your tax liability, file Form 1040-X to amend your return.1Internal Revenue Service. What to Do When a W-2 or Form 1099 Is Missing or Incorrect
If a Form Does Arrive But the Amount Is Wrong
A 1099-NEC showing the wrong amount is a different problem than one that never arrives. Contact the payer first and ask for a corrected form. If the payer won’t fix a clearly wrong amount, report the actual income you received on Schedule C and keep thorough documentation. The IRS may flag a mismatch between what the payer reported and what you reported, but your records will support your position. Good recordkeeping does the work here.
Could You Actually Be an Employee?
Sometimes a missing 1099 points to something larger. You may be an employee, not an independent contractor. Employees get a W-2 with taxes already withheld; independent contractors get a 1099-NEC and handle their own taxes.10Internal Revenue Service. When Would I Provide a Form W-2 and a Form 1099 to the Same Person If a company controls when, where, and how you work but calls you a contractor, the classification may be wrong. That affects more than tax forms. It also determines whether you qualify for overtime pay, unemployment insurance, and employer-paid benefits.
If you believe you’ve been misclassified, file Form SS-8 with the IRS to request a formal determination of your worker status. The IRS will contact the business, send them their own copy of SS-8 to complete, and assign a technician to review the facts and apply the law.11Internal Revenue Service. Instructions for Form SS-8 The resulting determination letter is binding on the IRS as long as the underlying facts don’t change. The process takes time, and information you provide may be shared with the other party, so it is not an anonymous filing.
If the IRS reclassifies you as an employee, the business may owe back employment taxes. Relief provisions exist for businesses under Section 530 of the Revenue Act of 1978, but those cannot be considered during the SS-8 determination itself; the business would need to pursue that separately.
The Bottom Line on a Missing Form
A missing 1099 doesn’t excuse you from reporting, and it doesn’t trap you either. File on what you earned, document what you did to chase the form, and let the IRS pursue the payer if it comes to that. The money you were paid is the fact that matters on your return. The piece of paper is just the payer’s record of it.
