What Law Requires Credit Counseling Before Bankruptcy?

Credit counseling before bankruptcy is required by the Bankruptcy Abuse Prevention and Consumer Protection Act of 2005, known as BAPCPA. That law added Section 109(h) to the Bankruptcy Code, which bars anyone from filing a bankruptcy petition unless they have first completed a briefing from a nonprofit counseling agency approved by the U.S. Trustee Program within the 180 days before filing.1Office of the Law Revision Counsel. 11 U.S. Code 109 – Who May Be a Debtor The rule applies to every individual filer, in every judicial district, in both Chapter 7 and Chapter 13 cases.

The 180-Day Window

The counseling must happen within the 180 days immediately before your filing date. A certificate from a session completed earlier than that is stale and will not satisfy the requirement, even by a day.1Office of the Law Revision Counsel. 11 U.S. Code 109 – Who May Be a Debtor The window runs the other direction too. Some courts have read the statute to mean that counseling obtained on the same calendar day as filing does not count if the petition was filed first, so finishing the briefing at least a day before you file is the safest approach.

If you are filing jointly with a spouse, each of you must complete the briefing individually and receive your own certificate. One session for the household does not cover both filers.

What the Briefing Covers

During the session, a counselor reviews your income, expenses, and debts. Section 109(h) specifically requires a budget analysis and an overview of the credit counseling options available to you.1Office of the Law Revision Counsel. 11 U.S. Code 109 – Who May Be a Debtor If a debt management plan could realistically resolve your situation, the counselor will explain how one would work. You are not obligated to follow any plan the counselor suggests. The point of the briefing is to make sure you have considered whether bankruptcy is the right answer, not to force you into an alternative.

Sessions typically run 60 to 90 minutes and can be done individually or in a group. When you finish, the agency issues a certificate of completion. That certificate gets filed with your bankruptcy petition, and without it the case cannot proceed.

Finding an Approved Agency

Only agencies approved by the U.S. Trustee Program, part of the Department of Justice, can issue a certificate that satisfies the statute. The official list of approved providers is searchable by state and judicial district on the Department of Justice website.2United States Department of Justice. Credit Counseling and Debtor Education Information A certificate from an agency that is not on that list will not be accepted, regardless of how thorough the session was.

A few practical points as you choose a provider:

  • Most approved agencies charge between $10 and $50 for the pre-filing briefing.
  • Under federal law, approved agencies must provide services regardless of your ability to pay. If you cannot afford the fee, say so before the session. Many agencies will waive or reduce it, particularly for low-income filers.3Office of the Law Revision Counsel. 11 USC 111 – Nonprofit Budget and Credit Counseling Agencies
  • Most agencies offer the briefing online, by phone, or in person. Online is the most common choice and lets you complete the course on your own schedule.
  • Many agencies offer counseling in languages other than English. The approved provider list shows which languages are available in your district.

The Narrow Exceptions

Section 109(h) carves out limited exceptions, and courts read them strictly.

Permanent Exemption

The court can exempt you from the counseling requirement entirely if you are unable to complete it because of incapacity, disability, or active military duty in a combat zone. For this purpose, incapacity means a mental illness or deficiency severe enough that you cannot make rational decisions about your finances.1Office of the Law Revision Counsel. 11 U.S. Code 109 – Who May Be a Debtor Getting the exemption requires a court determination after notice and a hearing, which means filing a motion and presenting evidence.

Temporary Emergency Waiver

If a genuine emergency forces you to file before completing the briefing, you can ask for a temporary waiver. To qualify, you must show three things: that you contacted an approved agency and could not get an appointment within seven days, that exigent circumstances required you to file immediately, and that you filed a certification describing those facts with your petition.1Office of the Law Revision Counsel. 11 U.S. Code 109 – Who May Be a Debtor The waiver gives you 30 days from the petition date to finish the counseling, and a court can extend that by 15 more days for good cause, but no further.

The waiver is genuinely hard to get. Exigent circumstances mean something like an imminent foreclosure sale or a wage garnishment that would cause irreparable harm if you waited another week. Being busy or not knowing about the requirement does not qualify. Most bankruptcy attorneys treat the pre-filing counseling as a non-negotiable first step rather than something to waive after the fact.

What Happens If You Skip It

If you file a bankruptcy petition without a valid certificate and do not qualify for a waiver, the court will dismiss your case.2United States Department of Justice. Credit Counseling and Debtor Education Information Dismissal closes the case as though it never existed. You can refile once you complete the counseling, but the consequences in between are real. Any automatic stay that was holding off creditors evaporates the moment the case is dismissed. And if you refile within a year, the automatic stay in the new case may be shorter or unavailable altogether.

The Separate Course After Filing

The pre-filing briefing is not the only educational requirement BAPCPA created. The same law added Sections 727(a)(11) and 1328(g), which block the court from discharging your debts in a Chapter 7 or Chapter 13 case unless you also complete a separate personal financial management course after filing.4Office of the Law Revision Counsel. 11 U.S. Code 727 – Discharge That post-filing course is a distinct requirement with its own deadlines and its own certificate. It cannot be combined with the pre-filing briefing in a single session, and skipping it means the court closes your case without wiping out any debts.5U.S. Trustee Program.
