On an income tax return, works contract activity is reported under the Construction sector business codes in the 6000 series, and for Assessment Year 2026-27 the works contract business code in income tax filings will be one of codes 6001 through 6010, depending on what kind of construction or contract work you actually do. General civil contractors use 6002, road and bridge contractors use 6005, and specialized activities like installation, finishing, or waterworks each have their own code. The code sits in the “Nature of Business” section of ITR-3 or ITR-4, and picking it accurately matters because the Income Tax Department benchmarks your declared profits against other taxpayers filing under the same code.
The 6000-Series Codes for Works Contractors
The Income Tax Department publishes the full list of business codes in the instructions to ITR-3 and ITR-4.1Income Tax Department. Instructions for Form ITR-3 For works contract activity, these are the codes you’ll be choosing between:
- 6001 – Site preparation works
- 6002 – Building of complete constructions or parts (civil contractors)
- 6003 – Building installation
- 6004 – Building completion
- 6005 – Construction and maintenance of roads, rails, bridges, tunnels, ports, harbours, and runways
- 6006 – Construction and maintenance of power plants
- 6007 – Construction and maintenance of industrial plants
- 6008 – Construction and maintenance of power transmission and telecommunication lines
- 6009 – Construction of waterways and water reservoirs
- 6010 – Other construction activity not elsewhere classified
If you build houses or commercial properties as a general civil contractor, 6002 is your code. Road, bridge, and runway work goes under 6005. Water supply and irrigation projects sit at 6009. When the bulk of your work is fitting out interiors, plumbing, or similar installation work rather than putting up the structure itself, 6003 fits. Finishing trades like plastering, painting, and tiling are under 6004. Code 6010 is the residual bucket for construction work that genuinely doesn’t fit anywhere else.
What a Works Contract Actually Covers
A works contract combines the supply of materials with labor to produce a finished result on immovable property. Building a house, repairing a bridge, laying a pipeline, or installing electrical systems in a commercial building all qualify. The point of distinction is that you’re not just selling goods or offering a standalone service; you deliver both materials and workmanship as a single package.
For income tax purposes, the definition is broader than under GST. The explanation to Section 44AD specifically brings in “civil construction,” which covers the construction or repair of any building, bridge, dam, canal, or road, and the execution of any works contract.2Income Tax Department. Section 44AD That broader definition is what pulls most small works contractors into the presumptive taxation framework, and it’s why the business code you select needs to line up with a construction activity when you claim presumptive income.
Choosing a Code When You Handle More Than One Kind of Work
Many contractors do more than one type of project in a year: a stretch of road repair for a government body in one quarter, a residential building in the next. The ITR forms let you report up to three business activities. Your primary code should match the activity that produced the highest revenue during the year, with the others listed as secondary.
An example. If you earned ₹80 lakh from building construction and ₹30 lakh from road maintenance, 6002 is your primary code and 6005 is secondary. If a third activity — say, site preparation for a separate client — produced meaningful revenue, 6001 goes in as the third entry.
Accuracy here isn’t just a filing formality. The department uses sector-specific benchmarks to check whether your declared margins look reasonable for your line of work. A contractor reporting thin profits under a code where the department expects healthy margins draws attention during automated screening. Filing under a vague catch-all like 6010 when a specific code fits means your figures get compared against a grab bag of unrelated contractors, and normal financials can end up looking off.
What the Code Choice Affects
The business code doesn’t sit in isolation. It interacts with three other decisions on the same return.
Which ITR Form You File
Works contractors file either ITR-4 (Sugam) or ITR-3. ITR-4 is the simplified form for taxpayers claiming presumptive taxation under Section 44AD with total income up to ₹50 lakh. ITR-3 is required when turnover exceeds the presumptive thresholds, when you declare profits below the presumptive rate, when total income crosses ₹50 lakh, or when you have capital gains, foreign assets, or other income that makes ITR-4 ineligible.3Income Tax Department. Individual Having Income from Business or Profession for AY 2026-2027 You can file ITR-3 even if you qualify for ITR-4; the more detailed form is always accepted. The business code and the form selection happen in the same part of the return, so settle your taxation approach before you start filling in the code.
Whether Your Presumptive Claim Is Internally Consistent
If you claim the 6% or 8% presumptive rate under Section 44AD, your business code has to sit within an eligible activity. Selecting a non-construction code while claiming a presumptive rate meant for an eligible business creates a mismatch the system will flag. The code and the income computation need to tell the same story.
How the Department Benchmarks Your Numbers
Every code carries an implicit profit-margin profile the department maintains for scrutiny selection. Picking a code that genuinely reflects what you do puts your return in the right peer group. Picking one that doesn’t puts you in the wrong peer group, and that’s often what triggers a notice.
Where the Code Goes on the E-Filing Portal
On the Income Tax Department’s e-filing portal, the business code is entered in the “Nature of Business” section:
- Log in and select ITR-3 or ITR-4.
- Open the business or professional details section. In ITR-4 this appears early in the form; in ITR-3 the business code entry sits in Part A of the Profit and Loss schedule.
- Add a business entry, fill in the trade name, and pick the code from the drop-down list. The list mirrors the codes published in the ITR instructions.
- If you have multiple activities, add up to three entries, with the highest-revenue activity first.
- Save. The portal uses the code you selected to validate the rest of the return, so an incorrect code can cause mismatches later in the automated checks.
One placement detail worth flagging: if you file under Section 44AD using ITR-3 (which is allowed), the business code goes into the presumptive income section — Item 61 of Part A of the Profit and Loss schedule — rather than the general business details section.1Income Tax Department. Instructions for Form ITR-3 The code itself is the same; only the location changes with your taxation method.
Common Mistakes in Code Selection
Two errors show up repeatedly on works contractor returns, and both are avoidable.
The first is defaulting to 6010 when a specific code fits. Road contractors sometimes tick “other construction” because it feels safer, but the specific code exists precisely so the department can benchmark you against comparable businesses. Using 6005 when you build roads gives you the peer group you actually belong in. Using 6010 puts you outside it.
The second is a code that contradicts the rest of the return. If you tick a non-construction code but claim the 6% or 8% presumptive rate under Section 44AD, the return is internally inconsistent. Before you file, confirm that the code, the ITR form, and the income computation method all describe the same business.
Boundary: The Code Alone Doesn’t Decide Your Compliance
Picking the right code is necessary but not sufficient. Section 44AD eligibility has its own turnover thresholds (₹2 crore, or ₹3 crore where cash receipts stay within 5% of total turnover),4Income Tax Department. Small Businessmen – Benefits Allowable a five-year continuity requirement once you opt in,5Income Tax Department. Section 44AD and specific exclusions (LLPs and companies cannot use it; neither can commission or agency businesses). Tax audit obligations under Section 44AB and TDS credit reconciliation against Form 26AS run in parallel. The business code is the label on the return; the underlying rules apply on their own terms.
