Expect questions about your income, your expenses, why you need to keep the collateral, and how you plan to make the payments work when the paperwork shows you cannot. Judges in these hearings are not adversaries, but they are skeptical by design, because their job is to keep you from a decision that feels manageable now and collapses six months later. If the judge approves the agreement, you become fully liable on the debt as if the bankruptcy never touched it. You Can Still Cancel After Signing
Signing a reaffirmation agreement is not the last word. Send it by certified mail with a return receipt so you can prove delivery, and file a copy with the bankruptcy court clerk. Why the Presumption Exists
Reaffirmation can bite hard when it goes wrong. Once the agreement is approved and the rescission window closes, you are personally liable for the full debt. Fall behind on a reaffirmed car loan and the creditor can repossess the vehicle, sell it at auction, and sue you for the deficiency between the sale price and the balance owed.
