What Is the IRS Hardship Program and Who Qualifies?

The IRS hardship program, officially called Currently Not Collectible (CNC) status, temporarily stops IRS collection activity when paying your tax debt would leave you unable to cover basic living expenses like rent, food, and utilities. It does not erase what you owe. Wage garnishments and bank levies stop while you remain in hardship, penalties and interest keep accruing on the balance, and the IRS’s 10-year window to collect keeps running in the background.1Internal Revenue Service. What Currently Not Collectible Status Actually Does

Once your account is marked Currently Not Collectible, the IRS suspends active enforcement: no levies on your paycheck, bank accounts, or other assets while the status holds.1Internal Revenue Service. Temporarily Delay the Collection Process The IRS is saying it agrees you can’t pay right now, not that the debt is gone. If your finances improve later, collection can start again.2Internal Revenue Service. Topic No. 201, The Collection Process

Several things do not stop under CNC. Interest compounds daily. The failure-to-pay penalty keeps running. The IRS can still file a Notice of Federal Tax Lien, and any federal or state tax refunds you would otherwise receive get seized and applied to the balance.2Internal Revenue Service. Topic No. 201, The Collection Process Going into CNC buys you breathing room, not a clean slate.

Who Qualifies

Two things decide whether the IRS will grant hardship status: your tax filings need to be current, and your allowable monthly expenses need to meet or exceed your monthly income.

Filing Compliance

The IRS generally requires open filing requirements to be resolved before it will report an account as Currently Not Collectible.3Internal Revenue Service. 5.16.1 Currently Not Collectible If returns are missing, expect to file them first. A narrow exception exists: when the IRS can verify your finances another way and hardship is clear, it may grant CNC status even with unfiled returns, but it cannot levy to collect on those balances in the meantime.

The Income-Versus-Expenses Test

The math is simple in principle. If your necessary monthly living expenses are equal to or greater than your total monthly income, you have nothing left to send the IRS, and you qualify. The catch is that the IRS does not accept your expense figures at face value. It compares them against its own Collection Financial Standards, which cap what counts as reasonable for housing, food, transportation, and other categories based on family size and where you live.4Internal Revenue Service. Collection Financial Standards After those caps are applied, if disposable income is zero or negative, you’re in.

How the IRS Measures Your Expenses

Two sets of standards are used. National standards apply everywhere. Local standards vary by region.

National standards cover food, clothing, housekeeping supplies, personal care, and miscellaneous items. The IRS grants the full standard amount by family size without asking what you actually spent. Through June 2026, that is $839 per month for a single person and $2,129 per month for a family of four, with $394 added for each additional person.5Internal Revenue Service. National Standards: Food, Clothing and Other Items

Out-of-pocket health care has its own per-person national standard: $84 per month under age 65 and $149 per month at 65 or older, on top of insurance premiums.6Internal Revenue Service. National Standards: Out-of-Pocket Health Care

Local standards cover housing, utilities, and transportation, using county data for housing and utilities and regional data for vehicle costs. You generally get the lesser of what you actually pay or the local standard.4Internal Revenue Service. Collection Financial Standards If your real costs run higher and you can document why the standard doesn’t cover basic needs, the IRS may allow more on a case-by-case basis.

Documents You Need to Submit

Qualifying starts with a Collection Information Statement. Most individuals file Form 433-F (the shorter version) or Form 433-A (a longer version for wage earners and the self-employed).1Internal Revenue Service. Temporarily Delay the Collection Process Both are on IRS.gov. If you run a business as a corporation, partnership, or LLC, add Form 433-B; sole proprietors report business figures inside Form 433-A.7Internal Revenue Service. The forms ask for a full financial picture:

Expect to back up the numbers. The IRS may request bank statements, pay stubs, utility bills, rent or mortgage receipts, and insurance notices. Pulling several months of these together before you apply shortens the review.

How to Request Hardship Status

Calling is the most direct route. Use the general collections line at 800-829-1040 or the number printed on your latest IRS notice.1Internal Revenue Service. Temporarily Delay the Collection Process A representative can walk through your financial information on the call. If you would rather handle it in writing, mail your completed Form 433 and supporting documents to the address on your IRS correspondence. Either way, expect several weeks for review, and answer any follow-up promptly.

If a levy is already hitting your paycheck or bank account and creating immediate hardship, call the number on the levy notice right away. The IRS is required to release a wage levy that is preventing you from meeting basic living expenses.8Internal Revenue Service. What if a Levy Is Causing a Hardship

What Keeps Growing While You’re in CNC

The failure-to-pay penalty runs at 0.5% of the unpaid tax each month or partial month, capped at 25% of the original tax.9Internal Revenue Service. Failure to Pay Penalty The reduced 0.25% rate only applies under an approved installment agreement, which CNC is not, so the full rate keeps running.

Interest compounds daily on the total balance, including accrued penalties. The rate resets quarterly at the federal short-term rate plus three points. For the first quarter of 2026, individual underpayments accrue at 7% per year.10Internal Revenue Service. Interest Rates Remain the Same for the First Quarter of 2026

A federal tax lien can still be filed. The lien itself attaches automatically to everything you own once the IRS assesses the tax, sends a bill, and you don’t pay.11Office of the Law Revision Counsel. 26 USC 6321 – Lien for Taxes The Notice of Federal Tax Lien is the public filing that protects the government’s position against other creditors and can hit your credit and complicate selling or refinancing property.2Internal Revenue Service. Topic No. 201, The Collection Process Refunds you would otherwise get, federal or state, will be applied to the balance every year until the debt is cleared or expires.

Annual Reviews and the 10-Year Clock

The IRS runs an automated income check on CNC accounts each year, using W-2s, 1099s, and filed returns to see whether things have improved.3Internal Revenue Service. 5.16.1 Currently Not Collectible If reported income crosses a threshold, the IRS may lift CNC status, send a new notice, and ask for updated financials.

The clock working in your favor is the Collection Statute Expiration Date. The IRS generally has 10 years from the date of assessment to collect a tax debt.12Office of the Law Revision Counsel. 26 USC 6502 – Collection After Assessment CNC status does not pause it. If your finances never recover enough for collection to restart, some or all of the balance can expire on its own. Certain other moves do pause the clock, including an Offer in Compromise, a Collection Due Process hearing, and bankruptcy, so weigh those against staying in CNC if the 10-year expiration is part of your plan.

If the IRS Denies Your Request

Two appeal paths exist.

Collection Due Process Hearing

When you receive a Notice of Intent to Levy or a Notice of Federal Tax Lien Filing, you have 30 days to file Form 12153 and request a Collection Due Process hearing.13Internal Revenue Service. Collection Due Process (CDP) FAQs At the hearing, an independent appeals officer will consider collection alternatives, including CNC status. Attach a completed Form 433-A to support the hardship claim. Missing the 30-day window leaves you with an equivalent hearing but no right to take the result to Tax Court.

Collection Appeals Program

The Collection Appeals Program is faster and less formal. Start by raising the issue with the IRS employee or manager on the case. If that goes nowhere, file Form 9423 for review by the IRS Independent Office of Appeals. CAP moves quicker than CDP but does not preserve Tax Court rights afterward.

Alternatives If You Can Pay Something

CNC is for taxpayers who cannot pay anything. If you can send some amount each month, other tools may fit better.

Installment Agreements

If you owe $50,000 or less in combined tax, penalties, and interest, you can apply for a streamlined installment agreement online without submitting a Collection Information Statement.14Internal Revenue Service. Online Payment Agreement Application An installment agreement cuts the failure-to-pay penalty from 0.5% to 0.25% per month for returns filed on time.9Internal Revenue Service. Failure to Pay Penalty All required returns must be filed to qualify.

Partial Payment Installment Agreement

If you can pay something monthly but not enough to clear the balance before the 10-year deadline, a Partial Payment Installment Agreement sets a payment based on ability to pay and writes off whatever remains when the collection period ends. It requires a full Collection Information Statement and managerial approval, and the IRS will look first at whether equity in your assets could go toward the debt.15Internal Revenue Service. Partial Payment Installment Agreements and the Collection Statute Expiration Date (CSED)

Offer in Compromise

An Offer in Compromise settles the debt for less than the full balance when the IRS agrees the offered amount is the most it could reasonably collect. To apply, you must have filed all required returns, be current on estimated tax payments for the year, and submit a $205 application fee and an initial payment. Low-income taxpayers who meet the guidelines are exempt from both.16Internal Revenue Service. Offer in Compromise The IRS generally will not accept an offer if you could pay the full amount through an installment agreement.

When to Bring in the Taxpayer Advocate Service

If you have tried normal IRS channels and are still stuck, or an IRS action is causing immediate financial harm, the Taxpayer Advocate Service (TAS) may step in. TAS is an independent organization inside the IRS that helps taxpayers whose problems are creating financial difficulty, who cannot resolve issues directly, or who believe an IRS process is broken.17Internal Revenue Service. Form 911, Request for Taxpayer Advocate Service Assistance File Form 911 by mail, fax, or email, or call your local office from the list on the TAS website. The help is free, and a case advocate can push on a CNC request, a denial, or a levy or lien causing immediate economic harm.
