The I-512 advance parole document is the travel authorization U.S. Citizenship and Immigration Services (USCIS) issues to people with a pending adjustment-of-status application so they can leave the country and return without USCIS treating the departure as abandonment of the case.1U.S. Citizenship and Immigration Services. Travel Documents It is proof of pre-approved permission to seek re-entry at a U.S. port of entry. It does not replace your passport, and it does not guarantee that Customs and Border Protection will let you back in.
Who Needs Advance Parole
The document matters most to people with a pending Form I-485. Leave the United States while that application is pending without advance parole, and USCIS will deny the case unless a narrow exception applies. Asylum applicants are in the same position: departing without advance parole means USCIS assumes the asylum application has been abandoned.1U.S. Citizenship and Immigration Services. Travel Documents
A few categories of nonimmigrants with a pending I-485 can travel without advance parole. H-1B and L-1 workers may leave and return if they are not in removal proceedings, still qualify for their status, are returning to work for the same employer, and hold a valid H-1B or L-1 visa stamp.2U.S. Citizenship and Immigration Services. FAQs for Individuals in H-1B Nonimmigrant Status The same protection covers H-4 and L-2 dependents if the principal is in lawful status and the dependent has a valid visa. K-3 and K-4 holders can also travel without advance parole as long as the K visa has not expired; if it will be expired on return and an I-485 is pending, advance parole has to be approved before departure.3U.S. Citizenship and Immigration Services. If you don’t fit one of those categories and you have a pending adjustment application, assume you need advance parole before any international trip.
How to Apply
You apply by filing Form I-131, Application for Travel Documents, Parole Documents, and Arrival/Departure Records.4U.S. Citizenship and Immigration Services. I-131, Application for Travel Documents, Parole Documents, and Arrival/Departure Records The form asks for your A-Number, current status, reason for travel, and expected length of time abroad. Along with the form, you submit two passport-style color photos, a copy of the I-797 receipt notice for your pending I-485, and evidence of your current immigration status such as any prior USCIS-issued status document.5U.S. Citizenship and Immigration Services. Instructions for Form I-131 Make sure the biographical details match what you gave on the I-485; mismatches slow things down.
Photo requirements changed under a December 2025 USCIS policy, so check the current Form I-131 instructions before you file.6U.S. Citizenship and Immigration Services. New Photo Policy Helps Prevent Immigration Fraud Through Enhanced Identity Verification
If your pending I-485 receipt number begins with “IOE,” you can file the I-131 online through your USCIS account. All other receipt numbers require paper filing by mail to the USCIS Lockbox or Service Center handling the underlying case.4U.S. Citizenship and Immigration Services. I-131, Application for Travel Documents, Parole Documents, and Arrival/Departure Records
After filing, expect a Form I-797C receipt notice and, in many cases, a biometrics appointment at a local Application Support Center. Missing biometrics can result in denial, so treat the appointment as mandatory. Processing times run from several months to over a year, so file well ahead of any planned travel.
What It Costs
The filing fee is $630, but whether you actually pay it depends on when you filed your I-485.7eCFR. 8 CFR 106.2 – Fees
- I-485 filed between July 30, 2007, and March 31, 2024: no I-131 fee, as long as you paid the I-485 fee and that application is still pending.
- I-485 filed on or after April 1, 2024: the full $630 fee applies. The old waiver does not carry over.
- I-485 filed before July 30, 2007: the $630 fee also applies.
There is no separate biometrics fee. The 2024 fee rule folded biometrics costs into the main filing fee for most applications, so older guides that mention an $85 biometrics charge are out of date.8Federal Register. The Two Forms the Document Takes
USCIS issues the authorization in one of two physical formats.
Standalone I-512L
A paper document printed on security paper, with your photo and identifying information. USCIS issues this version when there is no concurrent employment authorization application or when circumstances call for a travel-only document.
EAD/AP Combo Card
If you applied for work authorization and advance parole together alongside your I-485, USCIS may issue one Employment Authorization Document card with text at the bottom reading “Serves as I-512 Advance Parole.”9U.S. Citizenship and Immigration Services. USCIS to Issue Employment Authorization and Advance Parole Card for Adjustment of Status Applicants That combo card handles both work and travel. Some documents authorize only one trip, others allow multiple departures within the validity period, so check the notation on your specific card.
Validity Periods
For adjustment-of-status applicants (category C09), USCIS reduced the maximum EAD validity period from five years to 18 months for any application pending or filed on or after December 5, 2025.10U.S. Citizenship and Immigration Services. Reduced Validity Periods for Newly Issued Employment Authorization Documents A combo card issued before that date with a longer validity remains valid until its printed expiration, but newer cards run in shorter windows and will need renewing more often.
Emergency Advance Parole
If you need to travel in fewer than 15 days and cannot wait for normal processing, USCIS may issue an emergency advance parole document through a local field office. Call the USCIS Contact Center at 800-375-5283 or request an appointment through the online “My Appointment” tool.11U.S. Citizenship and Immigration Services. Emergency Travel
Not every situation qualifies. USCIS looks for a pressing or critical need, such as urgent medical treatment available only abroad, the death or serious illness of a close family member, or a professional, academic, or personal commitment that cannot be postponed where a timely expedite request was already filed and remains pending.11U.S. Citizenship and Immigration Services. Emergency Travel
If your situation qualifies, USCIS schedules an in-person appointment. Bring a completed and signed Form I-131 with the filing fee (even if you already have a pending I-131, you file a new one), two passport-style photos, evidence of eligibility, and documentation proving urgency. Any non-English documents need a certified English translation.
Coming Back Into the United States
At the port of entry you present the I-512 document to a Customs and Border Protection officer. There is a legal distinction worth understanding: you are not “admitted” to the country. You are “paroled” in, which means CBP is allowing you to physically enter while the underlying adjustment case continues to process.1U.S. Citizenship and Immigration Services. Travel Documents
Most advance parole travelers are directed to secondary inspection, where officers review the file more closely. Waits range from minutes to hours. Officers may ask about the purpose of your trip, check criminal and immigration databases, and search belongings including your phone. Once cleared, CBP issues an electronic I-94 arrival/departure record, typically annotated with the admission date, class of admission, and expiration of your parole.12U.S. Customs and Border Protection. POMS RM 10211.195 – Evidence of Parolee Status When an Alien Submits Form I-94 or Unexpired Foreign Passport Save a copy until you have a final decision on your adjustment case.
The document has a printed expiration date, and you have to enter the United States before that date. A document that expires while you are abroad cannot be used to seek re-entry. Build in a comfortable buffer.
What Can Still Block Re-entry
Holding a valid advance parole document does not guarantee re-entry. The CBP officer at the port of entry makes the final call, and two categories of issues cause most refusals.
Criminal History
Criminal convictions are the most common problem. Officers check criminal databases during inspection, and several grounds under the Immigration and Nationality Act can make someone inadmissible: crimes involving moral turpitude, controlled substance violations, multiple criminal convictions with aggregate sentences of five years or more, and drug trafficking. Old convictions, dismissed cases, and expunged records can still surface. If you have any criminal history, talk to an immigration attorney before you travel.
Unlawful Presence
If you accumulated unlawful presence in the United States before filing your I-485, leaving on advance parole raises the question of whether departure triggers the three-year or ten-year inadmissibility bars. Under the 2012 Board of Immigration Appeals decision Matter of Arrabally and Yerrabelly, the answer is generally no, and USCIS has adopted the position that departing with advance parole does not trigger the bars under INA 212(a)(9)(B)(i)(I) or INA 212(a)(9)(B)(i)(II). That protection does not extend to the permanent bar under INA 212(a)(9)(C), which applies when someone with more than a year of aggregate unlawful presence leaves and then re-enters without being admitted or paroled.14U.S. Citizenship and Immigration Services. Unlawful Presence and Inadmissibility Policy can shift, so if unlawful presence is part of your history, get legal advice before you travel.
Renewing Before Expiration
If your advance parole is approaching expiration and your I-485 is still pending, file a new Form I-131 to renew. USCIS recommends submitting renewal requests no earlier than 180 days (six months) before the current document expires; filing too early can lead to rejection or denial without a refund.4U.S. Citizenship and Immigration Services. I-131, Application for Travel Documents, Parole Documents, and Arrival/Departure Records
With the 18-month validity now in effect for adjustment applicants, renewal timing matters more than it used to. Processing can take months, so filing near the six-month mark gives the best chance of getting a new document in hand before the current one lapses. Do not travel internationally if your document is close to expiring and the renewal is not yet approved.
