What Is the Employment Authorization Document (Form I-766)?

The Employment Authorization Document, Form I-766, is a card from U.S. Citizenship and Immigration Services that proves you’re legally allowed to work in the United States for the period printed on it. Unlike a work visa tied to one sponsoring employer, the card lets you work for any U.S. employer, hold more than one job, or freelance, as long as it hasn’t expired.

For employers, the EAD is a List A document on Form I-9, meaning it establishes both your identity and your permission to work with a single piece of paper.1U.S. Citizenship and Immigration Services. If you lose or leave a job, your work authorization stays with you until the card’s expiration date.

Who Qualifies for an EAD

Federal regulations at 8 CFR 274a.12 group work-eligible noncitizens into categories.2eCFR. 8 CFR 274a.12 Some people are authorized to work simply because of their status; others must apply for permission first. The groups that most often file for a card include:

  • Asylees and refugees.
  • Certain H-4 and L-2 spouses who meet the eligibility requirements.
  • Beneficiaries of Temporary Protected Status.

Each group has its own alphanumeric code — adjustment applicants file under (c)(9), asylees under (a)(5), and so on. Choosing the correct code on the application matters. Entering the wrong category is a common reason for denials and Requests for Evidence.

What the Card Shows

The card carries your full legal name, date of birth, photograph, and a unique Alien Registration Number (an “A” followed by eight or nine digits).5U.S. Citizenship and Immigration Services. Tips on Finding Your A-Number The front also shows the category code that identifies the legal basis for your authorization, any restrictions on the work you can perform, and a fixed expiration date. If you have a pending I-485, USCIS may issue a combination card that also functions as a travel document. How to Apply

You request the card by filing Form I-765, Application for Employment Authorization.7U.S. Citizenship and Immigration Services. I-765, Application for Employment Authorization Many categories can file online through a USCIS online account; some still require paper filing by mail. The filing fee varies and changes periodically, and some applicants (asylum seekers, for example) may qualify for a fee exemption, so check the USCIS fee schedule before submitting.

The form asks for your current address, immigration history, and any previous A-Numbers. You’ll need two identical passport-style photos and documents proving your current immigration status, such as a visa, an approval notice, or an I-94 arrival record.8U.S. Citizenship and Immigration Services. Any foreign-language document needs a certified English translation.

Requesting a Social Security Number

Form I-765 has a section where you can ask for an original Social Security number and card at the same time. If you complete it, USCIS sends your information to the Social Security Administration, which mails the card separately about 14 days after your EAD arrives.9Social Security Administration. What Happens After You File

USCIS mails a Form I-797C, Notice of Action, confirming receipt and providing a case number you can track online.10U.S. Citizenship and Immigration Services. If something is missing, USCIS issues a Request for Evidence describing exactly what it needs. The most common triggers are picking the wrong eligibility category code, leaving out required supporting documents, and photos that don’t meet specifications.11U.S. Citizenship and Immigration Services. Processing Times

How long you wait depends on your category and the service center handling your case. Median processing times for fiscal year 2026 give a rough picture:12U.S. Citizenship and Immigration Services. Historic Processing Times

  • Pending asylum applications: about 0.7 months
  • DACA-based applications: about 2.3 months
  • Pending I-485 adjustment applications: about 4.3 months
  • Parole-based applications: about 6.2 months
  • All other categories: about 4.1 months

These are medians, not guarantees. Individual cases can run longer if USCIS issues an RFE or your background check takes extra time.

Automatic Extensions Have Ended for New Renewals

This is the most important recent change for anyone renewing. As of October 30, 2025, DHS ended the practice of automatically extending expired EADs while a renewal is pending.13Federal Register. Under the old rules, a timely renewal could extend the card’s validity by up to 540 days. That safety net is gone for new filings. A few narrow carve-outs remain. Renewals filed before October 30, 2025 keep their automatic extensions under the prior rules. If Your Card Expires or Your Application Is Denied

Once your EAD expires and no valid extension is in place, you must stop working. Continuing to work without authorization can weigh against you later, when an officer or immigration judge is deciding whether to grant a green card or another discretionary benefit. Presenting false documents or misrepresenting your eligibility to keep a job carries more serious consequences, including potential criminal liability.

USCIS denies applications when the applicant cannot verify identity, fails to establish eligibility for the claimed category, or abandons the case by not responding to an RFE.11U.S. Citizenship and Immigration Services. Replacing a Lost, Stolen, or Damaged Card

You replace a lost, stolen, or damaged card by filing a new Form I-765 with the applicable fee, using the filing address for your eligibility category.7U.S. Citizenship and Immigration Services. Until the replacement arrives, you don’t have a valid List A document, so a new employer can’t complete your I-9 using the missing card.
