What Is the 59 Minute Rule for Federal Employees?

The 59-minute rule for federal employees is an informal management practice that lets a supervisor send you home up to 59 minutes early without docking your pay or charging any leave. It is not written into any single regulation. It works because federal timekeeping normally records leave in one-hour minimum increments, so an absence shorter than an hour slips beneath the threshold and never lands on your timecard.1The United States Army. Need to Know: Boss, Where’s My 59-Minute Rule? It is entirely discretionary. No federal employee has a right to it.

Why the Number Is 59

Federal leave accounting follows a minimum-charge rule in 5 CFR 630.206. Unless an agency has set a smaller increment through its own policy or a union contract, the minimum charge for any leave is one hour, with additional time charged in one-hour multiples.2eCFR. 5 CFR 630.206 – Minimum Charge Fifty-nine minutes is simply the largest block of time that sits just under that floor. Nothing needs to be recorded, no leave balance moves, and payroll has nothing to adjust.

An Army human resources official described the practice this way: it “is not actually a rule and is not found in specific regulatory guidance. It is a term that has evolved for authorized infrequent release of employees of an hour or less.”1The United States Army. Need to Know: Boss, Where’s My 59-Minute Rule?

When Supervisors Actually Use It

The most familiar scenario is the afternoon before a major federal holiday. On the day before Thanksgiving, Christmas, or Independence Day, work slows and many employees face long holiday commutes. Supervisors use the early release as a low-cost morale gesture.

Weather is the other common trigger. When conditions are turning bad but not bad enough to close the office, sending people home before the evening commute becomes dangerous is a sensible middle step. OPM’s governmentwide dismissal procedures recognize that early departures may be authorized based on unsafe conditions at the work location or on the route home.3U.S. Office of Personnel Management. Retirement ceremonies, agency celebrations, and end-of-year recognition events round out the usual list. Some agencies also apply their excused-absence authority to brief wellness or physical fitness activities when the agency head decides it serves the organization.4U.S. Office of Personnel Management. Health and Wellness Across all of these, the release has to stay infrequent and tied to a reason. A weekly Friday send-home is not what the practice is for.

Who Qualifies

The practice reaches executive branch employees who have an established part-time or full-time regular tour of duty. That includes General Schedule white-collar workers and Federal Wage System blue-collar workers. Employees on intermittent schedules are not covered.5U.S. Office of Personnel Management. Federal contractors sitting in the same office are not eligible, even when the government employees around them go home. Contractor hours run through the company’s contract with the government, not federal personnel rules. That gap is a familiar source of friction in mixed workplaces, but the legal line is clear.

Telework is grayer. No OPM regulation draws a line between on-site and remote workers for these brief excused absences, and 5 CFR 630.206 says nothing about where the employee is physically located.2eCFR. 5 CFR 630.206 – Minimum Charge Some managers extend the early release to everyone on the team. Others limit it to people physically in the office on the theory that the commute and gathering rationale does not apply to someone already home. Either approach is defensible because the whole practice sits on management discretion. If you telework, ask your supervisor how they handle it.

What You Cannot Do With It

You cannot demand it, and you cannot bank it. It is granted for a specific occasion, and if you stay at your desk instead of leaving, those 59 minutes are gone.

Stacking is prohibited. You cannot tack the 59 minutes onto annual leave, sick leave, a lunch break, or any other authorized absence to extend your time away.6United States Marine Corps. Administration and Resource Management Division 59 Minute Policy for Civilian Marine Employees If you already have leave scheduled for the afternoon, the early release does not shave an extra hour off the front of it.

Agencies also warn supervisors against making the practice routine. Federal agencies must maintain a basic 40-hour administrative workweek for each full-time employee under 5 U.S.C. 6101.7Office of the Law Revision Counsel. 5 USC 6101 – Basic 40-Hour Workweek Habitual early releases start to look like an unofficial change to the workweek, which is exactly the argument agencies have raised when they later try to pull the practice back.

Union Contracts Can Lock It In

If you work in a unionized federal shop, the 59-minute practice can become a negotiated condition of employment rather than a discretionary favor. The Federal Labor Relations Authority looked at this in a case involving air traffic controllers at Edwards Air Force Base. The collective bargaining agreement expressly authorized first-level supervisors to grant up to 59 minutes of paid time off in the final hour of a shift when no duties remained. When the agency tried to take that discretion away unilaterally, an arbitrator ruled the agency had violated the agreement.8Federal Labor Relations Authority. 65 FLRA No. 79 – United States Department of the Air Force, Edwards Air Force Base

The agency appealed, arguing that routinely granting the 59 minutes effectively cut the workweek below the 40-hour statutory floor. The FLRA denied the exceptions, finding the agency had not shown any actual conflict with the 40-hour workweek requirement.8Federal Labor Relations Authority. 65 FLRA No. 79 – United States Department of the Air Force, Edwards Air Force Base Once the practice is written into a union contract, management cannot revoke it without bargaining. If you are covered by a CBA, look at the language on administrative leave and early release. It may already give you more than the informal version does.
