What Is RCRA and How Does It Regulate Hazardous Waste?

The Resource Conservation and Recovery Act, known as RCRA, is the federal law that controls how hazardous and solid waste is managed in the United States from the moment it is created to its final disposal. RCRA hazardous waste regulations require businesses to identify whether their waste qualifies as hazardous, track it through a chain-of-custody manifest when it leaves the site, store it within strict time limits, and send it only to permitted treatment or disposal facilities. Congress enacted RCRA in 1976 as an amendment to the Solid Waste Disposal Act of 1965, giving the EPA authority over hazardous waste handlers, landfill standards, and underground storage tanks holding petroleum or hazardous chemicals.1Environmental Protection Agency. How the Law Is Structured and Who Enforces It

RCRA is divided into subtitles that handle different waste categories. Subtitle C contains the hazardous waste program most businesses care about: identification rules, generator duties, the manifest system, and standards for treatment, storage, and disposal facilities. Subtitle D covers non-hazardous solid waste and sets minimum federal criteria for municipal landfills. Subtitle I regulates underground storage tanks.3U.S. Environmental Protection Agency. In practice, the EPA does not run the hazardous waste program directly in most places. Through state authorization, the agency delegates primary responsibility to the states, and all 50 states and territories have been authorized to implement the base program.4US EPA. Identifying Hazardous Waste

No RCRA obligation attaches until you determine that your waste is hazardous under 40 CFR Part 261.5eCFR. 40 CFR 261.3 – Definition of Hazardous Waste A waste can qualify in one of two ways: by exhibiting a hazardous characteristic, or by appearing on one of EPA’s specific lists.

Characteristic Wastes

Four characteristics can turn ordinary waste into hazardous waste:

Listed Wastes

EPA also maintains four lists that make certain wastes hazardous by definition. The F-list captures wastes from common industrial processes such as spent solvents. The K-list targets wastes tied to specific industries, including petroleum refining and pesticide manufacturing. The P-list and U-list cover discarded commercial chemical products, with P-listed chemicals treated as acutely hazardous and subject to lower handling thresholds.8US EPA. A waste determination based only on visual inspection is the kind of shortcut that draws enforcement. Review safety data sheets, run appropriate analysis, and keep the paperwork. Auditors will ask for it.

Wastes That Are Excluded

Not every waste that seems hazardous falls under Subtitle C. Household hazardous waste is exempt regardless of its chemistry once it enters the municipal stream, so paint thinner, pesticides, and batteries from homes, hotels, and campgrounds are out. Other exclusions include wastewater discharges regulated under the Clean Water Act, domestic sewage in a sewer system, drilling fluids and produced water from oil and gas exploration, mining overburden and mineral processing waste, and samples collected solely for testing.9eCFR. 40 CFR 261.4 – Exclusions An exclusion from the hazardous waste rules is not a license to dump: most excluded wastes still face Subtitle D solid waste rules or other environmental laws.

Generator Categories and Storage Limits

Every business that produces hazardous waste falls into one of three generator categories based on monthly volume. The category sets your storage clock, your EPA identification requirements, and your paperwork load.

  • Very Small Quantity Generators (VSQGs): produce 100 kilograms or less per month, or one kilogram or less of acutely hazardous waste. They face the lightest burden and are not required to obtain an EPA ID number.10US EPA. Hazardous Waste Generator Regulatory Summary
  • Small Quantity Generators (SQGs): produce between 100 and 1,000 kilograms per month. They need an EPA ID number and may accumulate waste on-site for up to 180 days without a permit, or 270 days if the treatment facility is more than 200 miles away.11US EPA.   • Large Quantity Generators (LQGs): produce 1,000 kilograms or more per month, or more than one kilogram of acutely hazardous waste. They need an EPA ID number and face a 90-day accumulation limit.11US EPA. Categories of Hazardous Waste Generators

LQGs carry the heaviest operational load. They must maintain a formal contingency plan and designate an emergency coordinator available at all times. Every generator, regardless of category, must keep manifests, biennial reports, and exception reports for at least three years from the relevant date, and that retention period extends automatically during any unresolved enforcement action.12eCFR. 40 CFR 262.40 – Recordkeeping

Satellite Accumulation

Generators can store up to 55 gallons of non-acute hazardous waste, or one quart of liquid acutely hazardous waste, in containers at or near the point of generation with no time limit, as long as the container stays under the control of the operator generating the waste.13eCFR. 40 CFR 262.15 – Satellite Accumulation Area Once you cross the 55-gallon threshold, you have three calendar days to move the excess to a central accumulation area or ship it off-site. Missing that three-day window is one of the most common violations inspectors find.

Training and Reporting

LQGs must train employees within six months of hire and provide annual refreshers covering waste identification, container management, emergency procedures, and spill response. SQGs face a less prescriptive standard but must ensure staff know how to handle waste safely and respond to emergencies. Keep the training records with the facility’s operating file.

LQGs also submit a Biennial Hazardous Waste Report by March 1 of every even-numbered year, covering the previous calendar year, and must certify that a waste minimization program is in place.14US EPA. Biennial Hazardous Waste Report SQGs and VSQGs are not required to file biennial reports federally, though some states impose their own.

The Manifest System

Every off-site shipment of hazardous waste must travel with a Uniform Hazardous Waste Manifest, EPA Form 8700-22, which tracks the waste from generator to final destination.15US EPA. Uniform Hazardous Waste Manifest: Instructions, Sample Form and Continuation Sheet The generator and transporter both sign at the point of transfer and each keeps a copy. When the shipment arrives, the receiving facility signs to confirm delivery and submits the manifest into EPA’s national system.

Since 2018, EPA’s e-Manifest system has accepted electronic submission, and receiving facilities are now the primary point of entry for manifest data.16Environmental Protection Agency. e-Manifest Fact Sheet for the General Public Per-manifest fees vary by submission type. For fiscal year 2026, a fully electronic manifest costs $5.00, a data-plus-image upload runs $7.00, and a paper manifest submitted as a scanned image costs $25.00.17US EPA. e-Manifest User Fees and Payment Information The fee gap is deliberate. EPA wants electronic filing.

Exception Reports

If you ship waste and never receive the signed manifest back from the receiving facility, RCRA does not let you drop it. An LQG that has not received the signed copy within 45 days of the transporter accepting the waste must contact the transporter or the receiving facility. If the signed copy still has not arrived within 60 days, the LQG files an Exception Report. SQGs face the same 60-day deadline for their version of the report. As of December 2025, both LQGs and SQGs must submit exception reports through the e-Manifest system rather than mailing paper to a regional office.18eCFR. 40 CFR 262.42 – Exception Reporting

Universal Waste: Simplified Rules for Common Items

Some hazardous wastes qualify for simpler handling under the universal waste rules in 40 CFR Part 273. The five categories are batteries, pesticides, mercury-containing equipment, lamps such as fluorescent tubes, and aerosol cans.19eCFR. 40 CFR Part 273 – Standards for Universal Waste Management Handlers can accumulate these items for up to one year, must label containers with “Universal Waste” followed by the material type, and must keep containers closed except when adding waste. The material must still go to an authorized handler or destination facility. Fluorescent lamps in the dumpster are not an option.

Treatment, Storage, and Disposal Facilities

Facilities that treat, store, or dispose of hazardous waste must obtain a RCRA permit setting operating conditions for landfills, surface impoundments, incinerators, or storage tanks.20US EPA. What a Hazardous Waste Permit Is Permit applications require detailed site plans, waste analysis plans, closure cost estimates, and emergency preparedness documentation. Owners must also demonstrate financial assurance for eventual closure and any long-term monitoring, using instruments such as trust funds, surety bonds, insurance, or letters of credit. The point is to keep the taxpayer off the hook when an owner disappears or goes bankrupt.

Land Disposal Restrictions

Hazardous waste cannot go into a landfill in raw form. The Land Disposal Restrictions program under 40 CFR Part 268 requires treatment to specific standards before land disposal.21US EPA. Land Disposal Restrictions for Hazardous Waste Standards are set waste by waste, either as concentration limits (measured in the waste itself or in a TCLP extract) or as required treatment technologies for particular waste codes.22eCFR. 40 CFR Part 268 – Land Disposal Restrictions Diluting waste to meet a standard is prohibited. Treatment must actually destroy, remove, or lock in the hazardous constituents. Generators shipping untreated waste must send a one-time written notification to the treatment facility identifying the waste codes and applicable standards.

Underground Storage Tanks

Subtitle I regulates underground storage tanks that hold petroleum or hazardous substances. A tank qualifies as underground if at least 10 percent of its combined tank-and-piping volume sits below the ground surface.23eCFR. 40 CFR Part 280 – Technical Standards and Corrective Action Requirements for Owners and Operators of Underground Storage Tanks Gas stations are the most visible example, but industrial facilities, airports, and fleet operations also run regulated tanks.

Owners must register their tanks, install leak detection capable of identifying releases as small as 0.2 gallons per hour, and maintain spill and overfill prevention equipment. Financial responsibility rules require petroleum UST owners to carry at least $500,000 per occurrence for most operations, or $1 million per occurrence if the owner is engaged in petroleum production, refining, or marketing.23eCFR. 40 CFR Part 280 – Technical Standards and Corrective Action Requirements for Owners and Operators of Underground Storage Tanks A suspected or confirmed leak must be reported to the implementing agency within 24 hours, and corrective action must begin immediately. When a tank is permanently taken out of service, the owner typically must remove it and sample the surrounding soil and groundwater. Filling in place with sand or concrete is allowed only when removal would endanger nearby structures, and the site assessment is still required.

Penalties for Noncompliance

RCRA enforcement has real financial weight. The statute authorizes civil penalties of up to $25,000 per day per violation at the base level, but EPA adjusts that figure annually for inflation under 40 CFR Part 19. For violations assessed on or after January 2025, the inflation-adjusted maximum is $93,058 per day per violation.24eCFR. 40 CFR Part 19 – Adjustment of Civil Monetary Penalties for Inflation Violations that accumulate across weeks or months can produce numbers that dwarf the cost of compliance.

Criminal penalties scale with the violator’s mental state. Knowing violations of RCRA’s hazardous waste requirements carry fines of up to $50,000 per day and prison sentences of up to two years for most offenses, or up to five years for violations involving transportation to an unpermitted facility or treatment without a permit. A second conviction doubles both the fine and the potential prison term.25Office of the Law Revision Counsel. 42 USC 6928 – Federal Enforcement

The most serious charge is knowing endangerment, which applies when a person knowingly handles hazardous waste in a way that places another person in imminent danger of death or serious bodily injury. An individual convicted faces up to 15 years in prison and a fine of up to $250,000. Organizations face fines of up to $1 million.25Office of the Law Revision Counsel. 42 USC 6928 – Federal Enforcement EPA can also issue compliance orders, require corrective action to clean up contaminated soil and groundwater at regulated facilities, or suspend a facility’s permit.
