Proof of assessment of income tax for a passport, in the Indian ECNR context, means documents showing you filed a return and actually paid income tax for the last one year. The Passport Seva portal accepts either proof of income tax assessment and actual payment for the last one year, or an Income Tax Return statement for the last one year stamped by the income tax authorities together with a copy of your PAN card.1Passport Seva. What Counts as Proof and What Doesn’t
The document most applicants use is the ITR-V, the Income Tax Return Verification form. It is the acknowledgement generated when the Income Tax Department successfully receives your filed return, and it shows your name, PAN, the assessment year, and an acknowledgement number. A formal Assessment Order issued by a tax officer for the relevant year also qualifies, because it represents a completed evaluation of your tax liability.
Two things do not count. A nil return, where you report zero taxable income and pay nothing, is specifically excluded from the income tax route to ECNR. Proof of advance tax payment on its own is also not sufficient; the passport office wants the return documents that show final assessment, not just interim payments.1Passport Seva. If you qualify through income tax, your spouse and dependent children under 18 are covered under the same category and do not need to file their own returns to claim ECNR. The income tax route is one of twelve ways to qualify for ECNR, and it is most useful for applicants who lack a matriculation certificate or another qualifying credential. If you have passed the 10th standard, that certificate alone is enough and you do not need the tax documents at all.
How to Download or Obtain the Documents
To download your ITR-V, log in to the Income Tax Department’s e-filing portal at incometax.gov.in using your PAN. Open the e-File menu, choose Income Tax Returns, then View Filed Returns. Find the relevant assessment year and click Download Receipt to save the ITR-V as a PDF. Check the file before you close it: your name, the assessment year, and the acknowledgement number should all be clearly legible. A missing or unclear detail is a common reason passport applications get held up.
The stamped Income Tax Return statement under the second option requires a visit to your local Income Tax office, where an officer validates the return statement and applies the department’s stamp. It takes longer than the online download, but it is the sturdier document if your ITR-V has any formatting issues or if the passport office asks for extra verification. Whichever route you take, keep your PAN card copy ready — it is required alongside the stamped return, and useful to carry either way.
If you paid tax in an earlier year but never actually filed the return, you cannot produce ECNR-qualifying documents until you complete that filing. Advance tax challans, TDS certificates, and bank statements showing tax deducted are not substitutes for a filed return.
How to Submit the Documents for ECNR
Getting the ECR endorsement removed from an existing passport is done through a passport reissue. On the Passport Seva portal, apply for reissue and specifically select deletion of the ECR endorsement as the reason.2Passport Seva. Bring your original tax documents along with one set of self-attested photocopies, meaning you sign each photocopied page yourself to certify the copy.3Passport Seva. Document Required for Fresh Passport The officer will match the copies against the originals and hand the originals back to you the same day.
Before your appointment, cross-check the income and personal details on your tax documents against your passport application. Discrepancies between the name spelling, address, or income figures are a frequent cause of delays and rejections. If anything looks off, fix it before you go in.
Fees and Processing Times
The reissue application fee is ₹1,500 for a 36-page booklet and ₹2,000 for a 60-page booklet. Faster processing under the Tatkaal scheme adds ₹2,000 on top of the base fee.4Passport Seva. Fee Structure Minors under 18 pay ₹1,000 for a 36-page booklet. Senior citizens over 60 and children under 8 applying for a fresh passport get a 10% discount on the application fee.
Processing times depend on whether police verification is needed and whether you filed under normal or Tatkaal service. Domestic PSK applications generally take a few weeks under normal service and are prioritized under Tatkaal. Applications filed at an Indian consulate abroad take roughly 30 working days under normal service and around 5 working days under Tatkaal.
Why the Documents Have to Be Genuine
Submitting forged tax records or false information to obtain a passport is a criminal offense under Section 12 of the Passports Act, 1967. Furnishing false information or suppressing material facts to obtain a passport carries imprisonment of up to two years, a fine of up to ₹5,000, or both. A second conviction under the Act doubles the penalty. Non-citizens who obtain an Indian passport by suppressing their nationality face a mandatory minimum of one year in prison, extending up to five years, plus fines between ₹10,000 and ₹50,000.5India Code. What Tax Proof Is Not Required For
Emigration clearance based on ECR or ECNR status matters only for Indian citizens traveling to specific countries for employment. Travel on a tourist, student, or other non-employment visa does not require emigration clearance regardless of what your passport says.6Ministry of External Affairs. Emigration Abroad for Employment If you never plan to take up overseas employment in one of the designated ECR countries, upgrading to ECNR is optional rather than essential.
A separate point worth flagging: rules connecting tax status to a passport in the United States work on the opposite logic.
