What Is NEC on a 1099? Thresholds, Filing, and Differences

On a 1099, “NEC” stands for non-employee compensation: money a business paid to someone who isn’t on its payroll for services performed during the year. It shows up on Form 1099-NEC, a form the payer files with the IRS and sends to the worker. For payments made after December 31, 2025, a business has to issue the form once it has paid a single non-employee $2,000 or more in the calendar year, up from the longstanding $600 threshold.1Internal Revenue Service. What Non-Employee Compensation Actually Covers

Non-employee compensation is payment for services, made in the course of a trade or business, to someone who is not the payer’s employee. The IRS lays out four conditions: the recipient is not your employee, the payment was for services connected to your business, the recipient is an individual, partnership, estate, or in some cases a corporation, and the yearly total hit the reporting threshold.2Internal Revenue Service. Typical examples: professional fees to accountants, architects, engineers, and attorneys; commissions paid to outside salespeople; prizes and awards handed out in exchange for services; and travel reimbursements paid to a contractor outside of an accountable plan. Oil and gas payments for a working interest also belong in Box 1, whether or not any services were performed.2Internal Revenue Service. Instructions for Forms 1099-MISC and 1099-NEC (04/2025)

The dollar figure that lands in Box 1 is the full cumulative amount you paid that person during the year, not the size of any single check. Pay a freelance web designer $500 in March and $1,600 in October, and you’ve crossed $2,000. A 1099-NEC is owed.

The $2,000 Threshold for 2026

Section 70433 of Pub. L. 119-21 raised the reporting threshold from $600 to $2,000 for payments made after December 31, 2025.1Internal Revenue Service. Corporations Are Usually Exempt, With Two Catches

Most payments to corporations don’t require a 1099-NEC. Two exceptions matter. Attorney fees paid to a law firm still go in Box 1 of the 1099-NEC even if the firm is a corporation. Medical and health care payments to corporations, including professional corporations, get reported on Form 1099-MISC in Box 6.4Internal Revenue Service. Instructions for Forms 1099-MISC and 1099-NEC (Rev. If a Contractor Dies Mid-Year

Payments made during the year of death still get reported. Payments made in years after the death go to the estate or beneficiary and are reported on Form 1099-MISC rather than 1099-NEC.2Internal Revenue Service. Instructions for Forms 1099-MISC and 1099-NEC (04/2025)

How 1099-NEC Differs From 1099-MISC

Before 2020, non-employee compensation lived in Box 7 of the 1099-MISC. It has its own form now, and the two forms trip filers up. The line is straightforward: services go on the 1099-NEC. Almost everything else that used to go on 1099-MISC stays there, including rent, royalties, prizes and awards not tied to services, medical and health care payments, and gross proceeds paid to an attorney in connection with legal services (Box 10, which is separate from attorney fees for the lawyer’s own work in 1099-NEC Box 1).2Internal Revenue Service. Instructions for Forms 1099-MISC and 1099-NEC (04/2025)

When you’re unsure, look at what the money was actually for. A payment to a freelance graphic designer for logo work is 1099-NEC. A payment to that same person for renting their studio is 1099-MISC.

Worth flagging: the 1099-NEC is only correct if the worker is genuinely a non-employee. Paying someone on a 1099 because it’s cheaper doesn’t make the classification right, and misclassifying an employee as a contractor can bring back taxes, penalties, and interest. If the status is genuinely unclear, either party can file Form SS-8 to ask the IRS for a formal determination.5Internal Revenue Service. Independent Contractor (Self-Employed) or Employee?

If You Received a 1099-NEC

Income shown in Box 1 isn’t just subject to regular income tax. You also owe self-employment tax, which covers the Social Security and Medicare contributions that an employer would normally split with you. The combined rate is 15.3%: 12.4% for Social Security and 2.9% for Medicare.6Internal Revenue Service. Self-Employment Tax (Social Security and Medicare Taxes) The Social Security portion applies only to net earnings up to $184,500 in 2026; the Medicare portion has no cap.7Social Security Administration. You report the income on Schedule C (Profit or Loss from Business), where you can deduct legitimate business expenses such as supplies, software, and mileage. Net profit flows to Schedule SE, which computes the self-employment tax. Self-employment tax is owed once net earnings reach $400.8Internal Revenue Service. 1099-MISC, Independent Contractors, and Self-Employed 3 You can also deduct half of your self-employment tax from your adjusted gross income, which reduces your income tax bill.9Internal Revenue Service. Quarterly Estimated Payments

W-2 employees have taxes withheld from every paycheck. As an independent contractor, you don’t, so the IRS expects estimated payments through the year via Form 1040-ES. The due dates are April 15, June 15, September 15, and January 15 of the following year.10Internal Revenue Service. When to Pay Estimated Tax Underpaying or skipping quarters can produce an underpayment penalty even if you end up owed a refund at year-end. First-time contractors are often surprised by how large the April bill gets without those quarterly payments.

If the Form Is Wrong

If the amount on your 1099-NEC is off, or you think it shouldn’t have been issued at all, contact the payer first and ask for a corrected form. If no correction has arrived by the end of February and the payer isn’t responsive, you can call the IRS at 800-829-1040.11Internal Revenue Service. What to Do When a W-2 or Form 1099 Is Missing or Incorrect Don’t delay your own return. Report the income as you believe it to be correct. If a corrected form arrives after you’ve filed and the numbers materially change, use Form 1040-X to amend. The IRS matches 1099 data to your return, so a discrepancy usually generates a notice.

If You’re the One Issuing a 1099-NEC

Before you pay a contractor, get a signed Form W-9 with their taxpayer identification number, legal name, and address.12Internal Revenue Service. Form W-9 (Rev. March 2024) Collect it at the start of the relationship, not in January. If a contractor won’t give you a TIN, or the number they give doesn’t match IRS records, you must withhold 24% of future payments as backup withholding and remit it to the IRS until the issue is resolved.13Internal Revenue Service. Instructions for Form W-9 (Rev. March 2024)

Both the IRS copy and the recipient’s copy of the 1099-NEC are due by January 31 of the year after payment. There is no automatic extension. If you file 10 or more information returns of any type in the year (1099s, W-2s, and others all count together), you must file electronically through the IRS’s IRIS or FIRE systems.2Internal Revenue Service. Missing the deadline brings per-form penalties that climb the longer you wait.14Internal Revenue Service. General Instructions for Certain Information Returns (2025)

  • Filed within 30 days of the due date: $60 per form, capped at $683,000 per year ($239,000 for small businesses).
  • Filed after 30 days but by August 1: $130 per form, capped at $2,049,000 ($683,000 for small businesses).
  • Filed after August 1 or not filed at all: $340 per form, capped at $4,098,500 ($1,366,000 for small businesses).

The same amounts apply if the form is filed on time but contains incorrect information such as a wrong TIN or wrong dollar amount. If the IRS decides the failure was intentional, the penalty rises to at least $500 per form with no annual cap, or a percentage of the amount that should have been reported, whichever is greater.15Office of the Law Revision Counsel. 26 USC 6721 – Failure to File Correct Information Returns

Many states also want their own copy of the 1099-NEC. The IRS Combined Federal/State Filing program automatically forwards data to participating states when you e-file, but not every state participates, and some have their own thresholds or require direct filing.
