IRS Form 8821, the Tax Information Authorization, is the form you use to let a person or organization see your confidential IRS records without giving them any authority to act for you. It covers whatever tax types and years you list on the form: transcripts, account details, notices, balances. The legal basis is Internal Revenue Code Section 6103(c), which otherwise keeps return information locked down but permits disclosure to anyone the taxpayer designates in writing.1Office of the Law Revision Counsel. 26 USC 6103 – Confidentiality and Disclosure of Returns and Return Information The line between access and representation is what matters most about this form, and it’s the piece people miss.
What the Designee Can and Cannot Do
Anyone you name on Form 8821 can inspect and receive your confidential tax information, verbally and in writing, for the specific tax matters and periods listed on the form.2Internal Revenue Service. What the designee cannot do is speak for you. They cannot advocate your position, sign documents on your behalf, negotiate closing agreements, execute waivers, or represent you in any other way before the IRS.4Internal Revenue Service. Instructions for Form 8821 (09/2021) They can see what the IRS has. They can’t argue with it. If you want someone who can actually represent you, that’s a different form.
How It Differs From Form 2848
Form 2848, Power of Attorney and Declaration of Representative, is the form that grants authority to act on your behalf: attend conferences and hearings, advocate positions, prepare and file documents, correspond with the IRS, and negotiate agreements.5Internal Revenue Service. Who you can name is also different. Form 2848 is limited to individuals eligible to practice before the IRS: attorneys, CPAs, enrolled agents, and certain other practitioners. Form 8821 is much broader. You can name individuals, corporations, firms, organizations, or partnerships as your designee.6Internal Revenue Service. Tax professionals often use Form 8821 as a first step. A CPA or enrolled agent files an 8821 to review the account, pull transcripts, and see what’s outstanding before deciding whether formal representation under Form 2848 makes sense.
When People Actually Use It
Form 8821 shows up in a handful of common situations:
- Mortgage and loan applications. Lenders routinely have borrowers sign Form 8821 so the lender can pull IRS transcripts to verify reported income. This applies to home loans, student loans, and small business loans.
- Background investigations. Federal and state agencies conducting background checks may require Form 8821 to verify tax compliance and financial history.
- Bookkeeping and accounting. A business can authorize its accounting firm to receive tax notices and transcripts so problems get caught early.
- Estate and trust administration. Executors and trustees sometimes need access to a decedent’s or trust’s tax records to settle obligations.
When Form 8821 is being used for something other than resolving a tax matter with the IRS, such as income verification for a lender, the IRS must receive the form within 120 days of the taxpayer’s signature date.4Internal Revenue Service. What the Form Asks For
You can download the current version of Form 8821 from the IRS website. The form has six sections, and getting any of them wrong can cause the IRS to send it back unprocessed.7Internal Revenue Service. Form 8821 (Rev. January 2021)
Your Information (Line 1)
Your legal name, current mailing address, and taxpayer identification number: SSN, ITIN, or EIN depending on the type of taxpayer. Corporations, partnerships, and associations use the business name and EIN. If you filed a joint return, your spouse must submit a separate Form 8821 to authorize access to their own information; your form covers only you.4Internal Revenue Service. Designee Information (Line 2)
The designee’s full name and mailing address. If your designee already has a Centralized Authorization File (CAF) number from a prior authorization, enter it. If they’ve never been assigned one, write “NONE” and the IRS will issue one.4Internal Revenue Service. Instructions for Form 8821 (09/2021) Use the identical name on every submission; inconsistencies cause delays.
Tax Matters (Line 3)
This is the substance of the authorization. You specify the type of tax (income, employment, excise, estate, gift, and so on), the form number (1040, 941, 720, etc.), and the exact tax years or periods.7Internal Revenue Service. A form with vague or general references will be returned. Future tax years can be listed, but the IRS will not record future periods on the CAF that exceed three years from December 31 of the year the IRS receives the form.4Internal Revenue Service. Your Signature (Line 6)
You must sign and date the form. The signature certifies that you have the legal authority to release the information for the matters and periods listed.7Internal Revenue Service. Form 8821 (Rev. Who Signs When the Taxpayer Isn’t an Individual
Corporate officers, partners, guardians, executors, receivers, administrators, and trustees can all sign a Form 8821 if they have legal authority over the tax matters at issue.7Internal Revenue Service. Form 8821 (Rev. January 2021) For estates, the executor with authority to bind the estate signs; only one signature is needed when there are co-executors. The IRS also requires Form 56, Notice Concerning Fiduciary Relationship, to identify the executor. A fiduciary is acting as the taxpayer, not as a designee, which is a different legal posture than what Form 8821 creates.8Internal Revenue Service. Instructions for Form 8821 (Rev. How to File Form 8821
Three submission paths, and how you signed the form affects which one you can use.
Mail or Fax
The IRS routes forms by the taxpayer’s geographic location to processing centers in Memphis, Ogden, or (for taxpayers outside the U.S.) Philadelphia.4Internal Revenue Service. Online Upload
The IRS Submit Forms 2848 and 8821 Online tool accepts uploads for both individual and business taxpayers, and processes them alongside faxed and mailed requests on a first-in, first-out basis.10Internal Revenue Service. Tax Pro Account Electronically signed forms must go through this tool; they can’t be faxed or mailed. Acceptable electronic signatures include a typed name in the signature block, a scanned image of a handwritten signature, stylus input, or a signature made through third-party software.4Internal Revenue Service. Instructions for Form 8821 (09/2021) If the taxpayer signs electronically in a remote transaction and the submitter isn’t physically present, the submitter must attest to having verified the taxpayer’s identity.
Tax Pro Account
Tax professionals can submit authorization requests through the IRS Tax Pro Account, where they process in real time without paper. The professional submits the request, and the taxpayer reviews, electronically signs, and approves it through their own IRS Online Account.11Internal Revenue Service. Tax Pro Account Currently this path is available only for individual taxpayers, not businesses. It’s the fastest option when both sides already have IRS online accounts.
For mailed, faxed, and uploaded submissions, processing times vary. The IRS provides a processing status tool rather than a guaranteed timeframe.9Internal Revenue Service. Submit Forms 2848 and 8821 Online
How the Authorization Ends
Filing a new Form 8821 automatically revokes all prior tax information authorizations on file for the same tax matters, unless you take action to preserve them. To keep a prior authorization active alongside a new one, attach a copy of the prior 8821 and check the box on Line 5 of the new form.8Internal Revenue Service. Instructions for Form 8821 (Rev. September 2021) This is where people get burned. If your accountant has an 8821 on file and you submit a new one naming a mortgage lender, the accountant’s authorization is gone unless you preserve it.
You can revoke a Form 8821 at any time. If you have a copy of the original, write “REVOKE” across the top of the first page, add a current signature and date below the original signature, and send it to the IRS address from the Where To File Chart. Without a copy of the original, send a written notification stating that the designee’s authority is revoked, listing the designee’s name and address and identifying the tax matters and periods, signed and dated. To wipe out a designee’s access entirely, you can write “revoke all years/periods” instead of listing each one.8Internal Revenue Service. Instructions for Form 8821 (Rev. September 2021)
