IRS Form 709 is the federal gift and generation-skipping transfer tax return, and you file it by April 15 of the year after you make a gift that exceeds the annual per-recipient exclusion. For 2026, that exclusion is $19,000.1Internal Revenue Service. When You Have to File
Federal law taxes transfers of property by gift, and Form 709 is how you report them.2Office of the Law Revision Counsel. 26 USC 2501 – Imposition of Tax You can give $19,000 to as many separate people as you like in 2026 without triggering a return. The moment one recipient’s total gifts from you crosses $19,000 for the year, you file.
Three other situations force a return even when the dollar value looks small:
- Gifts of future interests. If the recipient cannot immediately use or enjoy the property, the annual exclusion does not apply and the gift is reportable at any value. - Generation-skipping transfers. A gift to someone two or more generations below you (usually a grandchild), or to an unrelated person more than 37½ years younger, faces an additional layer of tax and gets reported on Form 709.4Internal Revenue Service. - Gifts to a non-citizen spouse above $194,000. Gifts That Don’t Require a Return
Several categories are excluded from the gift tax and generally do not need to be reported at all:6Internal Revenue Service. Frequently Asked Questions on Gift Taxes
- Any amount to your U.S. citizen spouse, under the unlimited marital deduction.5Office of the Law Revision Counsel. 26 USC 2523 – Gift to Spouse
- Gifts to qualifying charities. If your only gifts during the year went entirely to charities, no return is required.
- Contributions for a political organization’s use.
- Tuition paid directly to an educational institution. No dollar limit, but you have to pay the school; reimbursing the student does not qualify.7eCFR. 26 CFR 25.2503-6 – Exclusion for Certain Qualified Transfer for Tuition or Medical Expenses

The tuition and medical exclusions stack with the annual exclusion. Paying $50,000 straight to a grandchild’s university and then handing that grandchild a separate $19,000 check in the same year keeps you clear of any filing requirement.
Gift Splitting for Married Couples
Married couples can elect to treat any gift made by one spouse as if each spouse gave half. This effectively doubles the annual exclusion to $38,000 per recipient for 2026. Both spouses must consent on their respective Forms 709, even if only one actually made the gifts, and the election applies to every gift to third parties that year. Splitting itself creates a filing requirement. If you give your niece $30,000 and want your spouse treated as giving half, both of you file Form 709 to document the election, even though $15,000 each would fall below the annual exclusion on its own.
Front-Loading a 529 Plan
Contributions to a 529 education savings plan count as gifts to the account beneficiary. A special election on Form 709 lets you spread a single contribution over five years for gift tax purposes, so you can put in up to $95,000 at once ($19,000 × 5) without exceeding the annual exclusion in any year. You must file Form 709 in the year of the contribution to make the election, and you report one-fifth of the amount for each of the five years. Any additional gifts to the same beneficiary during that window stack on top of the allocated portion and can push you back over the exclusion.
How the Lifetime Exemption Works
A reportable gift almost never produces an actual tax bill. Amounts above the annual exclusion simply reduce your lifetime unified exemption, which is $15 million per person for 2026 after the increase enacted by the One, Big, Beautiful Bill Act signed on July 4, 2025.8Internal Revenue Service. Out-of-pocket gift tax kicks in only once cumulative lifetime taxable gifts exceed the $15 million exemption. Rates then run from 18 percent to a top of 40 percent.3Internal Revenue Service. Instructions for Form 709 (2025) For most people the point of filing is not paying tax; it is maintaining an accurate running total so the IRS and your estate know exactly where you stand.
What to Gather Before You File
For every gift you made during the year, pull together:
- Your full legal name, address, and Social Security number or ITIN.
- Each recipient’s name, address, and relationship to you.
- A description of the gift specific enough for the IRS to identify the property, the transfer date, and the fair market value on that date.3Internal Revenue Service. Instructions for Form 709 (2025)
- Your adjusted basis in the property (original cost plus improvements). The recipient generally carries over your basis for income tax purposes, so this figure affects their future capital gains.
- A record of taxable gifts from prior Forms 709, needed to calculate how much of the lifetime exemption you have already used.
Gifts of real estate, closely held business interests, artwork, or other hard-to-value property need a qualified appraisal or a detailed explanation of how you determined fair market value.3Internal Revenue Service. Adequate Disclosure Starts the Clock
Properly disclosing each gift starts the statute of limitations, generally three years, after which the IRS can no longer challenge the reported value. To qualify as adequately disclosed, the return needs:
- A complete Form 709 with all schedules filled in.
- A description of the property transferred and any consideration you received.
- The identity and relationship of each donor and donee.
- For gifts in trust, the trust’s EIN and a summary of its terms.

If a gift is not adequately disclosed, the limitations period never starts. The IRS can revalue that gift and assess additional tax at any point in the future, even decades later.
Walking Through the Form
Schedule A is where you list your gifts, divided into three parts: gifts subject only to the gift tax (Part 1), direct skips to people two or more generations below you (Part 2), and gifts subject to both gift and generation-skipping transfer taxes (Part 3). Each entry needs the donee’s name and address, a description of the property, the date of the gift, your adjusted basis, and the fair market value.10Internal Revenue Service. After listing gifts, subtract the $19,000 annual exclusion from each qualifying gift. Future interests do not qualify. The remainder is your taxable gifts for the year. Part 2 handles the tax computation. You add the current year’s taxable gifts to all taxable gifts from prior years, apply the graduated rate table in the instructions to reach a tentative tax, and then subtract the unified credit (the tax equivalent of the $15 million lifetime exemption). Deadline, Extensions, and Where to Send It

You can now file Form 709 electronically through the IRS Modernized e-File (MeF) system, which lets you submit the return and authorize an electronic funds withdrawal at once.3Internal Revenue Service. Penalties for Late Filing or Undervaluation
If you owe gift tax and file late without reasonable cause, the failure-to-file penalty is 5 percent of the unpaid tax for each month the return is late, capped at 25 percent.14Office of the Law Revision Counsel. 26 USC 6651 – Failure to File Tax Return or to Pay Tax A separate failure-to-pay penalty of 0.5 percent per month, also capped at 25 percent, applies to tax not paid by the deadline. Interest compounds daily at the federal short-term rate plus three percentage points.
Undervaluing property invites its own penalty. A substantial valuation understatement means reporting 65 percent or less of actual fair market value; a gross understatement means reporting 40 percent or less, with steeper consequences.3Internal Revenue Service. Even when no tax is due, skipping a required Form 709 keeps the limitations clock from ever starting on the gifts you should have reported. The IRS can then examine those transfers indefinitely, which can create problems for your estate years later.
