Form SSA-827 is the Social Security Administration’s authorization that lets doctors, hospitals, schools, and employers release your records to SSA so it can decide your disability claim. Signing it is not legally forced, but as a practical matter every disability claim requires one: without a signed form, providers have no legal basis to hand over your records, and SSA cannot build the evidence file it needs to approve you.
What the Form Actually Does
The SSA-827 does two things at once. It works as your written request to your providers asking them to release information, and it gives those providers legal permission to send that information to SSA.1Social Security Administration. Program Operations Manual System – Completing Form SSA-827
SSA designed the form to satisfy the HIPAA Privacy Rule’s requirements for a valid authorization, which is why hospitals, clinics, and other covered entities across the country accept it without asking for their own release forms.2Social Security Administration. What Records It Reaches
The authorization covers everything created before you sign it, plus anything your providers generate within 12 months after the signature date.1Social Security Administration. Program Operations Manual System – Completing Form SSA-827 There is no fixed look-back limit on how far into the past the release reaches. SSA can request your entire treatment history if it’s relevant to the disability determination.4Social Security Administration. Information on Form SSA-827 Examiners often need years of records to trace the onset and progression of a condition, so the broad scope is deliberate.
Before you start, gather your full legal name, Social Security number, date of birth, and the names, addresses, and phone numbers of every medical provider, hospital, therapist, school, or employer whose records could support your claim. A complete provider list up front spares you follow-up requests later.
Sensitive Categories Are Already Covered
A common misunderstanding is that you have to check special boxes to release records about drug or alcohol treatment, HIV/AIDS status, sickle cell anemia, genetic testing, or mental health care. The form already gives blanket permission for all of these by default, and SSA built it that way specifically to avoid delays. Signing the form does not imply you have received any of that treatment.1Social Security Administration. Program Operations Manual System – Completing Form SSA-827
Some states are an exception. They require you to personally initial next to each sensitive category to confirm informed consent. If your state has that rule, you must use a paper version with a pen-and-ink signature; the online application cannot capture the initials.1Social Security Administration. Psychotherapy Notes Are Excluded
The SSA-827 explicitly does not authorize the release of psychotherapy notes as defined by federal regulation.2Social Security Administration. How SSA-827 Meets Requirements for Authorization to Disclose Information These are the mental health professional’s personal notes from a counseling session, kept separate from the rest of your chart.5Government Publishing Office. 45 CFR 164.501 – Definitions HIPAA treats them as especially protected and requires a separate authorization for their release.
The exclusion is narrower than most people assume. Prescriptions, medication monitoring, session dates and times, treatment plans, diagnoses, and progress summaries all fall outside the definition of psychotherapy notes, and SSA obtains those records through the standard SSA-827.5Government Publishing Office. 45 CFR 164.501 – Definitions In practice, the examiner sees the clinical picture of your mental health treatment without seeing your therapist’s private session notes.
How to Sign It
SSA accepts three signature methods. You can sign a paper copy by hand in ink. You can use the click-and-sign process inside the online disability application, which transmits the signed form directly to SSA with no printing or mailing involved.6Social Security Administration. Alternative Signature Processes for Form SSA-827 Or you can use telephone attestation, where an SSA or state agency employee reads the form’s content to you over the phone, records your verbal consent, and fills in the witness block to document the attestation.7Social Security Administration. The witness field on the paper form is for the SSA or state agency employee who processes your signature. You do not need to bring along a personal witness. When you sign online or submit a signed paper copy yourself, SSA handles the witness block through its own identity verification.
Signing for Someone Else
Not every claimant can sign personally. Who signs on someone else’s behalf depends on the situation:7Social Security Administration. POMS DI 11005.056 – Signature Requirements for Form SSA-827
- For a child under 12, a parent, legal guardian, or other person authorized under state law signs.
- For a minor 12 or older, both the child and a parent or guardian sign.
- For an adult who has been declared legally incompetent or has a court-appointed guardian, the guardian or other state-law representative signs. The claimant should not sign.
- For an adult unable to sign who has no court-appointed representative, the person who signed the underlying disability application, called the “proper applicant,” signs and explains their authority on the form.
One point catches families off guard. Being someone’s representative payee, or their appointed representative in SSA proceedings, does not by itself give you authority to sign an SSA-827. You need independent authority under state law, such as a healthcare power of attorney or guardianship order, to authorize the release of another person’s medical records.7Social Security Administration. How Long the Authorization Lasts
The form is valid for 12 months from the date you sign it. During that window SSA can request your historical records and any new records your providers create.3Social Security Administration. Form SSA-827 After 12 months the authorization expires and cannot be used to request more information. If your claim is still moving, and appeals commonly stretch past a year, SSA will ask you to sign a fresh SSA-827 to keep evidence flowing.
The same rule applies to continuing disability reviews. After you are approved, SSA periodically checks whether you still qualify, and because the original form expired long before, a new SSA-827 is required each time a review pulls in updated medical records.3Social Security Administration. Revoking It Early
You can revoke the authorization at any point before the 12 months run out. Under HIPAA the revocation has to be in writing.8eCFR. 45 CFR 164.508 – Uses and Disclosures for Which an Authorization Is Required Send the written revocation to both SSA and your providers. Once it is processed, the form can no longer be used to request new records. Anything SSA already collected before the revocation stays in your file; revocation is forward-looking only.
Think carefully before doing this while a claim is pending. Pulling the authorization mid-claim leaves SSA with less evidence, and evidence gaps rarely help the claimant.
What Happens If You Refuse to Sign
Signing is not technically mandatory. No one can force your hand. But refusing sets off a defined sequence. SSA will try to explain why the form is needed and give you time to reconsider. If you continue to decline, or simply never respond, the agency treats it as a failure to cooperate.9Social Security Administration. POMS GN 01010.410 – Failure to Submit Essential Evidence
If a final request letter goes unanswered for 30 days, SSA decides the claim on whatever evidence it already has. Without your medical records, that evidence is almost never enough, and the claim is denied for failure to establish entitlement. The denial preserves your appeal rights, but you will need to sign the SSA-827 at the appeal stage anyway if you want a realistic chance of reversal. Refusing to sign does not protect your privacy in any practical sense. It stops the claim.
