What Is Form I-824? Follow-to-Join and Duplicate Approval Notices

Form I-824, Application for Action on an Approved Application or Petition, is the USCIS form you file when you need the agency to take a specific follow-up step on an immigration case that already has a final approval. The most common reason to file it is to have USCIS notify a U.S. consulate through the National Visa Center that you now hold lawful permanent resident status, so a spouse or child abroad can begin immigrant visa processing. The filing fee is $590, there is no online option, and processing runs well over a year in most cases.

What You Can Request With Form I-824

Part 2 of the form lists the actions USCIS will perform, and you pick exactly one. Check the wrong box and USCIS will only do what you asked, not what you meant.

Follow-to-Join for a Spouse or Child

This is the use that matters most for families. If you adjusted status to lawful permanent resident inside the United States, your spouse and unmarried children under 21 who are still abroad do not automatically receive immigrant visas. Filing Form I-824 triggers a notification from USCIS to the appropriate consulate through the National Visa Center, which lets those family members apply for their own immigrant visas to follow and join you.1U.S. Citizenship and Immigration Services. Notification to Department of State of Adjudication of Form I-824 The right to that derivative status comes from federal immigration law, which entitles the spouse or child of an immigrant to the same visa category when following to join the principal applicant.2Office of the Law Revision Counsel. 8 USC 1153 – Allocation of Immigrant Visas

Duplicate Approval Notice

If your original Form I-797 approval notice was lost, stolen, or destroyed, Form I-824 gets you a replacement. The duplicate carries the same approval information as the original but does not include a copy of the underlying petition, and it will not come with a replacement green card, work permit, or travel document. It is only a reissue of the approval notice itself.3Regulations.gov. Form I-824 Instructions

Redirecting a Case to a Different Consulate or Port of Entry

When a nonimmigrant visa petition is approved, it is routed to a specific U.S. consulate through the National Visa Center or the Kentucky Consular Center. If the beneficiary needs to interview at a different consulate, the petitioner uses Form I-824 to reroute the case. The same applies to waiver applications that need to be redirected to a different port of entry.3Regulations.gov. Form I-824 Instructions

When Form I-824 Is the Wrong Form

Some situations look like Form I-824 territory but are not. Filing anyway means a rejected package, a lost fee, and months of wasted time.

Refugees and asylees cannot use Form I-824 to bring a spouse or children. They must file Form I-730, Refugee/Asylee Relative Petition, instead.3Regulations.gov. Form I-824 Instructions This is one of the most common filing mistakes, and USCIS rejects these applications outright.

USCIS will also not act on Form I-824 if the underlying petition was denied or is still pending. The form only works on cases that have already received a final approval.4Government Publishing Office. Form I-824 Instructions If your petition was denied, the correct path is an appeal to the Administrative Appeals Office or the Board of Immigration Appeals, or a motion to reopen or reconsider filed with the office that issued the denial.5U.S. Citizenship and Immigration Services. Who Can File

Only the person or entity that filed the original petition or application can file Form I-824. That means the sponsoring employer, the family-based petitioner, or the individual applicant who received the original approval. The beneficiary has no standing to request action on someone else’s filing.4Government Publishing Office. Form I-824 Instructions

Someone else can fill the form out for you, but you as the original filer must sign and date it personally. An unsigned form comes back as incomplete.

What to Gather Before You File

Pull out your original Form I-797 approval notice first. It contains the 13-character receipt number USCIS uses to find your case: a three-letter prefix (such as EAC, WAC, LIN, SRC, MSC, or IOE) followed by 10 digits. You will also need the exact form number and approval date of the underlying petition.4Government Publishing Office. Form I-824 Instructions

Part 1 asks for your biographical details: full legal name, physical street address (no P.O. box), and Alien Registration Number if you have one. If you are filing on behalf of a business or organization, use the entity’s IRS Tax Identification Number instead. In Part 2, check exactly one action. Attach a copy of your Form I-797 (front and back) as supporting evidence.

Filing Fee and Fee Waiver

The filing fee is $590.6eCFR. 8 CFR Part 106 – USCIS Fee Schedule If the filing is rejected or denied, the fee is not refunded. You can pay by personal check or money order made out to the U.S. Department of Homeland Security. At a Lockbox facility you can also pay by credit, debit, or prepaid card using Form G-1450, or by ACH bank transfer using Form G-1650.7U.S. Citizenship and Immigration Services. Form I-824 is eligible for a fee waiver through Form I-912 if you can show financial hardship under the standard fee waiver criteria. The waiver request has to be submitted on paper along with your I-824.8U.S. Citizenship and Immigration Services. USCIS Fee Schedule (G-1055)

Where to Mail It

There is no online filing. Download the current PDF from the USCIS website, complete it, and mail the paper form to the correct Lockbox facility. The right Lockbox depends on the receipt number prefix on your original I-797:9Reginfo.gov. Form I-824 Instructions

  • EAC or SRC prefix: USCIS Dallas Lockbox, P.O. Box 660867, Lewisville, TX 75029.
  • LIN or CSC prefix: USCIS Phoenix Lockbox, P.O. Box 21281, Phoenix, AZ 85036.
  • MSC prefix or no receipt number: USCIS Chicago Lockbox, P.O. Box 805887, Chicago, IL 60680-4120.

Each Lockbox has a separate street address for express mail and courier delivery. Sending to the wrong facility gets your package returned or badly delayed. USCIS updates its filing locations from time to time, so verify the current address on the USCIS website if more than 30 days have passed since the form’s latest edition date.

After You File

Once the Lockbox receives your package, USCIS mails you a Form I-797C Notice of Action confirming receipt and assigning a tracking number you can use with the online case status tool.

Processing takes longer than most filers expect. As of early 2026, most cases handled at a USCIS service center take around 15 months, and cases that require follow-on action from the National Visa Center take considerably longer.10U.S. Citizenship and Immigration Services. USCIS Processing Times Plan around that if family members abroad are waiting. Check the USCIS processing times page for current estimates, since the numbers shift with agency workload.

USCIS generally exempts Form I-824 filers from biometrics, but the agency keeps the right to require fingerprints, photographs, or an in-person interview at any point before it decides.11Regulations.gov. Form I-824 Instructions If that becomes necessary, you will get a written notice with the time and location.

Can You Ask for Faster Processing

There is no premium processing option for Form I-824. USCIS does consider expedite requests case by case, and you need to show something beyond ordinary inconvenience. The two categories the agency evaluates are severe financial loss and humanitarian emergencies.12U.S. Citizenship and Immigration Services. USCIS Policy Manual, Volume 1, Part A, Chapter 5 – Expedite Requests

For financial loss, USCIS looks at whether a company is at risk of failing, losing a critical contract, or laying off employees, and for individuals, at losing a job or losing access to critical public benefits. The urgency cannot be the result of your own delay in filing. Humanitarian emergencies cover serious illness, disability, the death of a family member, and dangerous conditions caused by natural disasters or armed conflict. Filing a humanitarian-based petition does not, on its own, justify an expedite. You need evidence of specific, time-sensitive circumstances affecting someone’s welfare.

Why Form I-824 Gets Denied

The clearest reason USCIS denies an I-824 is that the underlying petition is no longer valid. Even after an approval, USCIS can revoke, rescind, or terminate an immigration benefit for cause.13U.S. Citizenship and Immigration Services. USCIS Policy Manual, Volume 1, Part E, Chapter 10 – Post-Decision Actions If the approval was revoked before you filed, or revocation is underway, USCIS has nothing to act on.

Other frequent causes include picking the wrong action in Part 2, giving a receipt number that does not match USCIS records, and filing as someone who was not the original petitioner. Incomplete packages, missing signatures, wrong fees, or a missing I-797 copy come back as rejected rather than denied, but the practical result is the same: months lost. Verify that your receipt number, form number, and approval date match your original I-797 before anything goes in the mail.

Form I-824 and a Child About to Age Out

If you are filing to bring a child through follow-to-join processing, the Child Status Protection Act (CSPA) is directly relevant. Under CSPA, a child beneficiary of a family-based or employment-based immigrant petition must show they “sought to acquire” permanent residence within one year of a visa becoming available. Filing Form I-824 on the child’s behalf satisfies that requirement.14U.S. Citizenship and Immigration Services. USCIS Policy Manual, Volume 7, Part A, Chapter 7 – Child Status Protection Act

This matters when a child is close to 21. A child who ages out before completing processing loses derivative beneficiary status under most preference categories. The CSPA age is calculated by subtracting the number of days the underlying petition was pending from the child’s actual age on the date a visa became available. Filing Form I-824 does not change that calculation, but it does satisfy the separate “sought to acquire” requirement within the one-year window. A previously filed I-824 denied because the principal’s adjustment had not yet been approved can still serve as evidence that the child actively sought status.14U.S. Citizenship and Immigration Services. USCIS Policy Manual, Volume 7, Part A, Chapter 7 – Child Status Protection Act

The “sought to acquire” rule does not apply to immediate relatives, derivative refugees, or derivative asylees. For everyone else in the preference categories, filing Form I-824 early can be the difference between qualifying and aging out.

What Happens After Approval

Once USCIS approves the form, next steps depend on what you asked for. A duplicate approval notice arrives in the mail. For follow-to-join and consular notification requests, the case moves to the Department of State.

USCIS forwards the approved I-824 and supporting documents to the National Visa Center, which opens a new case.15U.S. Department of State. Begin National Visa Center (NVC) Processing The NVC then sends the beneficiary a Welcome Letter by email or mail with a case number and Invoice ID to access the Consular Electronic Application Center (CEAC), where they submit fees, forms, and supporting documents and receive messages from NVC.16U.S. Department of State. NVC Timeframes

Once the NVC confirms the case is “documentarily complete,” it schedules the immigrant visa interview at the designated U.S. Embassy or Consulate. The gap between I-824 approval and a scheduled interview varies, and the NVC timeframes page on the State Department website has the most current estimates.
