What Is Federal Student Loan Administrative Wage Garnishment?

If you default on a federal student loan, the Department of Education can take up to 15% of your disposable pay without going to court. Federal student loan wage garnishment is an administrative process authorized by the Higher Education Act: after roughly 270 days of missed payments, the Department of Education or a guaranty agency can order your employer to withhold part of your paycheck, and no judge has to sign off first.1Federal Student Aid. Student Loan Default and Collections: FAQs You have rights before it starts and real options to end it once it has.

One thing to know up front: federal student loan debt has no statute of limitations. The government can pursue collection decades after default.2Office of the Law Revision Counsel. 20 USC 1091a – Limitation on Actions Against Student Loan Borrowers Waiting it out is not a strategy.

How Much the Government Can Take From Your Paycheck

The Higher Education Act caps administrative wage garnishment at 15% of your disposable pay for any pay period.3Office of the Law Revision Counsel. 20 USC 1095a – Wage Garnishment Requirement Disposable pay is what remains after legally required deductions: federal and state income taxes, Social Security, and Medicare. Voluntary deductions like retirement contributions and health insurance premiums do not reduce the base.

A second rule under the Consumer Credit Protection Act prevents garnishment from pushing your weekly disposable earnings below 30 times the federal minimum wage.4Office of the Law Revision Counsel. 15 USC 1673 – Restriction on Garnishment At the current $7.25 federal minimum wage, that floor is $217.50 per week. If your weekly disposable pay is at or below that, nothing can be withheld.

The garnishment is the lesser of 15% or the amount above the floor. Here is how that plays out:

  • If you have $500 in weekly disposable pay, 15% is $75, and the amount above the floor is $282.50. The garnishment is $75.
  • If you have $250 in weekly disposable pay, 15% is $37.50, but only $32.50 sits above the floor. The garnishment is $32.50.

This formula applies no matter how many defaulted federal student loans you have. They are treated as one debt for garnishment math.

If You Already Have Another Garnishment

The total of all garnishments cannot exceed the Consumer Credit Protection Act’s general 25% ceiling on disposable earnings for ordinary debts.5U.S. Department of Labor. Fact Sheet 30 – Wage Garnishment Protections of the Consumer Credit Protection Act Child support orders and IRS tax levies take priority over student loan garnishments; child support withholding must be honored before any other garnishment, with a narrow exception for an IRS levy entered before the support order.6Administration for Children and Families. Income Withholding If an existing garnishment already hits the 25% cap, the student loan garnishment waits.

Self-Employed and Independent Contractors

Administrative wage garnishment reaches W-2 wages paid through an employer’s payroll. If you work for yourself or are paid as a contractor, there is no paycheck to intercept. The government can still pursue bank levies, seize tax refunds, and offset federal benefit payments.

Your Notice and the 15-Day Hearing Deadline

Before any money leaves your paycheck, the agency has to mail you a written notice at least 30 days before starting garnishment proceedings.3Office of the Law Revision Counsel. 20 USC 1095a – Wage Garnishment Requirement The notice must state the amount of the debt, the intent to garnish your wages, and your rights, including the right to inspect and copy your loan records.

The date that matters most is 15 days after the notice is mailed. File a written hearing request within that 15-day window and the garnishment cannot begin until the hearing is resolved. Miss it and you can still request a hearing, but the withholding order can proceed in the meantime.3Office of the Law Revision Counsel. 20 USC 1095a – Wage Garnishment Requirement

At the hearing you can challenge:

  • Whether you owe the debt at all
  • Whether the amount is correct
  • Whether the loan was discharged in bankruptcy
  • Whether you are a victim of identity theft
  • Whether garnishment would cause extreme financial hardship

Hardship claims require detailed documentation showing that withholding would prevent you from covering basic necessities. The hearing official must issue a final decision within 60 days of receiving your petition.3Office of the Law Revision Counsel. 20 USC 1095a – Wage Garnishment Requirement That decision determines whether the order is issued, modified, or canceled.

How to Stop a Garnishment Already in Place

Two paths get a defaulted loan out of default and the garnishment turned off: rehabilitation and consolidation. They work differently, and the trade-offs matter.

Rehabilitation

Rehabilitation requires nine on-time, voluntary monthly payments during a period of 10 consecutive months, so one missed month will not sink the process.7Federal Student Aid. Student Loan Rehabilitation for Borrowers in Default: FAQs Your monthly payment is 15% of the amount by which your adjusted gross income exceeds 150% of the federal poverty guideline for your family size, divided by 12.8Federal Student Aid. Loan Rehabilitation: Income and Expense Information If that calculation runs very low, there is a $5 monthly floor. Borrowers with little or no income can still rehabilitate.

Important detail about timing: entering a rehabilitation agreement does not immediately stop the garnishment. Involuntary collections, including wage withholding and tax refund offsets, may continue until you have made at least five of the nine required payments.7Federal Student Aid. Student Loan Rehabilitation for Borrowers in Default: FAQs Once all nine payments are complete, the default notation is removed from your credit report. Other late-payment history remains for seven years.

You can only rehabilitate a given loan once.

Consolidation

Consolidation combines your defaulted loans into a new Direct Consolidation Loan. To qualify while in default, you either make three consecutive, on-time monthly payments on the defaulted loan or agree to repay the new consolidated loan under an income-driven repayment plan. Consolidation is usually faster than rehabilitation because it does not require a 10-month payment window. The trade-off: the default record stays on your credit report for seven years. Consolidation does not erase it.

Both options restore your eligibility for federal student aid, deferment, and forbearance.7Federal Student Aid. Student Loan Rehabilitation for Borrowers in Default: FAQs If you default again after rehabilitation, consolidation is your only remaining route.

Other Ways the Government Can Collect

Paycheck withholding is not the only tool. The Treasury Offset Program allows the government to seize your federal income tax refund and apply it to the defaulted balance; the Bureau of the Fiscal Service sends a letter explaining the offset, and anything above the debt is returned.9Federal Student Aid. Treasury Offset If you file jointly and your spouse is the defaulted borrower, you can protect your share by filing IRS Form 8379 (Injured Spouse Allocation).10Internal Revenue Service. Injured Spouse Relief

Social Security retirement and disability benefits are also exposed. The government can offset up to 15% of the monthly benefit amount above $750. That $750 floor was set in 1996 and has never been adjusted for inflation.11Consumer Financial Protection Bureau. Social Security Offsets and Defaulted Student Loans Supplemental Security Income payments are not directly offset, but the unreduced Social Security benefit amount gets counted when you apply for means-tested programs like SSI and SNAP, which can affect eligibility.

Can Your Employer Fire You Over It?

Federal law prohibits your employer from firing you because your wages are being garnished for any single debt.12Office of the Law Revision Counsel. 15 USC 1674 – Restriction on Discharge From Employment by Reason of Garnishment An employer who violates this can face a fine of up to $1,000, imprisonment for up to one year, or both. The Department of Labor’s Wage and Hour Division enforces the protection.5U.S. Department of Labor. Fact Sheet 30 – Wage Garnishment Protections of the Consumer Credit Protection Act

Note the limit: the protection covers garnishment for “any one indebtedness.” All of your defaulted federal student loans generally count as one debt for this purpose. But if a student loan garnishment is paired with a separate garnishment from a different creditor, that is two debts, and the firing protection no longer applies.
