What Is Day 1 CPT: Eligibility, Compliance, and Risks

Day 1 CPT is Curricular Practical Training that lets an F-1 graduate student start working on the first day of a program, without the usual one-year wait that applies to most F-1 students. It exists because federal regulation carves out an exception for graduate programs whose curriculum requires immediate participation in professional training. The authorization comes from the university, not USCIS, which is why it’s fast and free โ€” but it also means the school’s program structure controls whether the arrangement is legitimate and whether it will hold up to scrutiny later.

Who Qualifies

The legal basis sits in 8 CFR ยง 214.2(f)(10)(i), which allows F-1 students to do CPT that is “an integral part of an established curriculum.” The standard rule requires a full academic year of full-time enrollment first. The exception applies to “students enrolled in graduate studies that require immediate participation,” and that clause is the entire foundation for Day 1 CPT.1eCFR. 8 CFR 214.2 – Special Requirements for Admission, Extension, and Maintenance of Status

To use Day 1 CPT, a student must meet all of the following:

  • Be lawfully maintaining F-1 status at the time CPT is authorized.
  • Be enrolled at a school certified by the Student and Exchange Visitor Program.
  • Be in a master’s or doctoral program. The Day 1 exception does not apply to undergraduates.
  • Be in a program whose established curriculum requires or formally integrates the work experience.
  • Have a specific job or internship already lined up before the school can authorize CPT.

The Designated School Official must confirm the employment is directly related to the student’s major before entering the authorization into SEVIS.2Study in the States. F-1 Curricular Practical Training (CPT)

The Full-Time CPT Trap That Costs You OPT

This is where careful planning matters most. CPT comes in two forms: part-time, meaning 20 hours per week or fewer, and full-time, meaning more than 20 hours per week. Accumulating 12 months or more of full-time CPT permanently eliminates eligibility for Optional Practical Training at that degree level.3ICE. Practical Training

OPT is the 12-month post-graduation work authorization most F-1 students rely on, extendable to a total of three years for STEM graduates. Losing it because of full-time CPT usage is one of the biggest avoidable errors in F-1 planning. Part-time CPT does not count toward the 12-month threshold, no matter how long it runs. A student who works part-time on CPT for the entire length of a two-year master’s keeps full OPT eligibility.4U.S. Citizenship and Immigration Services. Chapter 5 – Practical Training

The math is simple. Two years of full-time CPT equals 24 months, well past the cutoff, and OPT is gone. Two years of part-time CPT preserves OPT completely. Students who need full hours should track their cumulative full-time months and consider switching to part-time before hitting 12.

How Authorization Actually Happens

The centerpiece of the paperwork is a job offer letter on the employer’s letterhead. Schools have their own checklists, but the offer letter generally needs to spell out:

  • Job title and a description of duties specific enough for the school to verify the connection to the degree.
  • Exact start and end dates, because CPT is authorized for a defined period.
  • The physical U.S. work location.
  • Hours per week, which determines whether OPT is at risk.

Most programs also require a cooperative agreement between the employer and the school. The regulation defines CPT as training “offered by sponsoring employers through cooperative agreements with the school,” so this document is not optional.1eCFR. 8 CFR 214.2 – Special Requirements for Admission, Extension, and Maintenance of Status The student also fills out the university’s internal CPT request form, which ties the employment to a specific course in the current catalog. An academic advisor or department head signs off, confirming the work satisfies a degree requirement or earns credit. Without that academic link, the DSO cannot authorize the training.

Once everything is in, the DSO reviews it and, if satisfied, updates the student’s SEVIS record and issues a new Form I-20 with the CPT details printed on page two: employer name, authorized dates, and whether the training is full-time or part-time.5U.S. Citizenship and Immigration Services. Reminder: F-1 Students Enrolled in CPT Must Use Redesigned Form I-20 Processing typically runs five to ten business days. The student must have the updated I-20 in hand before starting work. Beginning employment even one day before the printed CPT start date counts as unauthorized work and can end F-1 status.4U.S. Citizenship and Immigration Services. Chapter 5 – Practical Training Unlike OPT, CPT involves no USCIS filing and no government fee, which is why it moves so quickly.

I-9 and Social Security Number

The employer completes Form I-9 to verify work authorization. For a CPT worker, the employer records the updated I-20 showing the CPT endorsement, along with the passport and Form I-94. The CPT employment end date on the I-20 serves as the expiration date for Section 2 of the I-9.6U.S. Citizenship and Immigration Services. 7.4.2 F-1 and M-1 Nonimmigrant Students

Payroll usually needs a Social Security number. Students without one can apply at a local SSA office after their SEVIS record has been in Active status for at least two days. SSA recommends waiting at least 10 days after arriving in the U.S. so verification systems can update.7Study in the States. Obtaining a Social Security Number Bring the passport, I-94, and CPT-endorsed I-20 to the appointment. The card usually arrives within a few weeks, and some employers will let a new hire start with proof of application.

Staying in Compliance

CPT authorization is not something you can set and forget.

The foundation is maintaining a full course of study. For graduate students, that means whatever the school certifies as full-time enrollment. Dropping below that threshold or failing to make academic progress can terminate the work authorization immediately.8Study in the States. Full Course of Study The academic side is not a technicality. It is the legal justification for the work.

Address changes must be reported to the DSO within 10 days.9eCFR. 8 CFR Part 214 – Nonimmigrant Classes Any change in the job โ€” new location, different duties, different hours โ€” has to be reported and approved by the DSO before the change takes effect. If the program continues into a new semester, CPT has to be renewed, which usually means a fresh I-20 for each term.

Traveling While on CPT

International travel is possible during active CPT but requires preparation. Re-entry generally calls for a valid passport with at least six months remaining, a valid F-1 visa stamp, and an I-20 with a recent DSO travel signature. That endorsement signals to Customs and Border Protection that the student is actively enrolled and authorized.10ICE. Travel

CBP officers have discretion to admit or deny any nonimmigrant, and Day 1 CPT students can draw extra questions about their program. Students with a pending Form I-485 need to be especially cautious. Leaving without Advance Parole is treated as abandoning that application, and an officer may also question whether the student’s intent lines up with nonimmigrant status. Talking to the DSO before any trip is the safest habit.

Taxes on CPT Income

CPT wages are subject to federal income tax. Social Security and Medicare tax depends on time in the country. F-1 students who have been in the United States fewer than five calendar years are generally classified as nonresident aliens and are exempt from Social Security and Medicare taxes on wages from authorized employment like CPT.11Internal Revenue Service. Foreign Student Liability for Social Security and Medicare Taxes Once the five-year mark passes, those taxes usually apply.

At tax time, nonresident alien students with CPT income generally file Form 1040-NR. Even students with no U.S. income need to file Form 8843, an informational statement that preserves exempt status for purposes of the substantial presence test.12Internal Revenue Service. Instructions for Form 1040-NR (2025) Missing these filings can complicate future visa applications, because USCIS reviews tax compliance.

The Scrutiny Risk You Need to Plan For

Day 1 CPT is legal, but it attracts more scrutiny than standard CPT, because enrolling in a new graduate program primarily to keep working can look problematic to immigration officers later. The most common flashpoint is H-1B petition processing, where USCIS may issue a Request for Evidence asking the student to prove they genuinely maintained F-1 status during the CPT period.

Typical RFE questions focus on whether the student actually attended classes, including in-person sessions; whether the job was genuinely related to the degree; whether the cooperative agreement was legitimate; and whether the student made real academic progress. USCIS may ask for transcripts, syllabi, attendance proof, tuition payment receipts, and letters from both the employer and school.

Students who treat the academic program as an afterthought are the ones who run into trouble. The regulation requires CPT to be “an integral part of an established curriculum,” and USCIS will test whether that was actually the case.1eCFR. 8 CFR 214.2 – Special Requirements for Admission, Extension, and Maintenance of Status Picking an accredited school with a legitimate program, attending required sessions, keeping grades up, and holding onto thorough records throughout the program are the best defenses if an RFE comes.

School choice is the biggest single decision in the process. SEVP-certified schools are supposed to be bona fide institutions with the facilities, personnel, and finances to actually deliver instruction.13ICE. SEVP Governing Regulations for Students and Schools Programs from unaccredited or marginally accredited institutions attract heavier scrutiny, and if USCIS or ICE concludes that a school was essentially selling CPT access rather than providing education, every student who enrolled there can face consequences. Research the accreditation status and reputation of any school offering Day 1 CPT before you enroll.
