What Is ATF Form 3? Filing Tax-Exempt NFA Transfers and Penalties

ATF Form 3 is the federal application that lets a licensed firearms business transfer a National Firearms Act item to another licensed business without paying the $200 transfer tax that applies to consumer sales. Its full title is the Application for Tax-Exempt Transfer of Firearm and Registration to Special Occupational Taxpayer. Only Federal Firearms Licensees who also hold a current Special Occupational Tax registration on both ends of the deal can use it. Filed electronically through the ATF eForms portal, Form 3 averaged one day of processing time in January 2026, the fastest turnaround of any NFA application ATF handles.1ATF: Bureau of Alcohol, Tobacco, Firearms and Explosives. The tax exemption comes from 26 U.S.C. § 5852(d), which allows any firearm registered to a licensed importer, manufacturer, or dealer to be transferred to another qualified licensee without the transfer tax.2Office of the Law Revision Counsel. 26 US Code 5852 – General Transfer and Making Tax Exemption The point of the form is not just the tax savings. Every NFA item has to stay registered in the National Firearms Registration and Transfer Record at all times, and Form 3 is the mechanism that updates the registry when possession changes. Moving an item between two fully licensed businesses without an approved form is a federal crime.

Who Can File

Both the sender and the receiver must be Federal Firearms Licensees who have paid the Special Occupational Tax. SOT comes in three classes with the following annual rates:3eCFR. 27 CFR 479.32 – Special (Occupational) Tax Rates

  • Class 1, Importer: $1,000 per year
  • Class 2, Manufacturer: $1,000 per year
  • Class 3, Dealer: $500 per year

Importers and manufacturers whose gross receipts fell below $500,000 in their most recent tax year pay a reduced rate of $500, matching what dealers pay.4GovInfo. 27 CFR 479.32a – Reduced Rate of Tax for Small Importers and Manufacturers The SOT year runs July 1 through June 30, with payment due by July 1.5Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF). What Items Qualify

Form 3 covers any item that meets the NFA definition of “firearm,” which is broader than most people expect. Six categories qualify:6Office of the Law Revision Counsel. 26 US Code 5845 – Definitions

  • Silencers, meaning any device designed to muffle the report of a firearm. These are the most commonly transferred items between dealers.
  • Short-barreled rifles, with a barrel under 16 inches or an overall length under 26 inches.
  • Short-barreled shotguns, with a barrel under 18 inches or an overall length under 26 inches.
  • Machine guns. Federal law bars civilians from possessing machine guns made after May 19, 1986, but licensed manufacturers and dealers may transfer them between SOT holders for legitimate business purposes such as law enforcement sales and demonstrations.7Office of the Law Revision Counsel. 18 USC 922 – Unlawful Acts
  • Destructive devices, including explosive ordnance and firearms with a bore over half an inch (standard shotguns excluded).
  • Any Other Weapons, a catch-all covering concealable devices like pen guns and smooth-bore pistols.

Each transfer needs its own Form 3, and approval must be in hand before the item physically changes possession.8Office of the Law Revision Counsel. 26 US Code 5812 – Transfers

What the Form Asks For

Both parties provide their full legal business name, any registered trade names, the complete 15-digit FFL number, SOT class, and Employer Identification Number.9Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF). Application for Tax-Exempt Transfer of Firearm and Registration to Special Occupational Taxpayer Addresses must reflect the physical location where inventory is stored, not a mailing address or P.O. Box. Mismatches with what ATF already has on file are the most common cause of rejected applications.

The firearm description requires the manufacturer or importer name and address, type, model, caliber or gauge, overall length, barrel length, and serial number. The serial number must match the physical item exactly. For high-volume transfers of identical items with consecutive serial numbers, the transferor can enter just the beginning and ending numbers of the range. Non-consecutive serials can be listed on an attachment referenced to the form.

How to Submit

ATF accepts Form 3 electronically through the eForms portal and on paper. Electronic filings averaged one day of processing in January 2026; paper filings averaged seven days.1ATF: Bureau of Alcohol, Tobacco, Firearms and Explosives. Current Processing Times

In eForms, the transferor fills out the application, signs it electronically, and submits. The system issues a tracking number so both parties can watch status. An ATF examiner verifies that both licensees hold valid FFLs and current SOT status. Once approved, the form appears in the portal with a digital approval and the transferor can ship immediately. If the examiner finds errors or expired credentials, the application is rejected or voided and has to be refiled from scratch.

After Approval

Approval authorizes the physical transfer, but two follow-on obligations matter. First, the receiving licensee must record the acquisition in the permanent bound book. Under 27 CFR 478.125(g), the entry must be made no later than the close of business on the next business day following receipt. If the dealer has a compliant commercial record such as an invoice with all required information, the deadline extends to seven days.

Second, interstate shipments of certain NFA items may require advance notice to ATF on Form 5320.20 under 18 U.S.C. § 922(a)(4). This applies to machine guns, short-barreled rifles, short-barreled shotguns, and destructive devices.10Bureau of Alcohol, Tobacco, Firearms, and Explosives. Application to Transfer and Register NFA Firearm (Tax-Paid) – ATF Form 4 Silencers and AOWs are not subject to the interstate transport notice.

Cancelling an Approved Form 3

If a deal falls through after ATF has approved the transfer, cancellation is available only while the firearm is still with the transferor. To cancel, return the approved application to ATF with a written request explaining the reason and confirming that the physical transfer never occurred.9Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF). Application for Tax-Exempt Transfer of Firearm and Registration to Special Occupational Taxpayer Once the item has been shipped and received, cancellation is off the table. Sending it back requires a new Form 3 running the other direction.

Penalties

Transferring an NFA item without proper registration, or possessing one that isn’t registered to you, is a federal felony. Under 26 U.S.C. § 5871, conviction carries up to ten years in prison.11Office of the Law Revision Counsel. 26 US Code 5871 – Penalties The NFA statute caps fines at $10,000, but a broader federal sentencing provision raises the maximum to $250,000 for individuals and $500,000 for organizations.12ATF (Bureau of Alcohol, Tobacco, Firearms and Explosives). NFA Handbook – Chapter 15 – Penalties and Sanctions

These penalties reach past illegal sales. Failing to update the registry, shipping before approval, or letting an SOT lapse while NFA items sit in inventory can all trigger enforcement. ATF industry operations inspectors review bound books and cross-reference Form 3 approvals against physical inventory, and a single unregistered item in a dealer’s safe can unwind an entire operation.
