ATF Form 3 is the federal application that lets one licensed firearms business transfer a National Firearms Act item to another licensed business without paying the usual $200 transfer tax. Its full name, Application for Tax-Exempt Transfer of Firearm and Registration to Special Occupational Taxpayer, spells out exactly what it does: it moves regulated items like silencers, machine guns, and short-barreled rifles between qualified dealers while logging each transfer in the national firearms registry. Electronic submissions through the ATF’s eForms portal averaged a one-day approval turnaround as of January 2026.1Bureau of Alcohol, Tobacco, Firearms and Explosives. Current Processing Times
Who Can File a Form 3
Form 3 is only for transfers where both the sender and the receiver hold a Federal Firearms License and have paid the Special Occupational Tax. Both SOTs must be active on the date of the transfer.2eCFR. 27 CFR 479.88 – Special (Occupational) Taxpayers Private citizens cannot use this form. An individual buying an NFA item files Form 4 instead, pays the $200 tax, and clears a background check.
Any combination of SOT classes qualifies, so long as the receiving business is licensed to handle that type of firearm.3Office of the Law Revision Counsel. 26 U.S.C. 5801 – Imposition of Tax A Class 2 manufacturer can transfer to a Class 3 dealer, a Class 1 importer can transfer to a Class 2 manufacturer, and so on. The typical use case is a manufacturer shipping inventory to a distributor, or a distributor forwarding an item to a retail dealer who has a customer waiting on a pending Form 4.
The tax exemption is the whole point. Every NFA transfer normally carries a $200 tax, and Form 3 waives that tax when both parties are qualified SOT holders, so commercial inventory can move through the supply chain without a fee stacking up at each stop.4Office of the Law Revision Counsel. 26 U.S.C. 5852 – General Transfer and Making Tax Exemption
Which Firearms the Form Covers
Form 3 applies to anything that meets the federal definition of an NFA firearm.5Office of the Law Revision Counsel. 26 U.S.C. 5845 – Definitions That list includes:
- Machine guns (any weapon firing more than one shot per trigger pull)
- Short-barreled rifles (barrel under 16 inches or overall length under 26 inches)
- Short-barreled shotguns (barrel under 18 inches or overall length under 26 inches)
- Silencers
- Destructive devices, including explosives and firearms with a bore over half an inch, with limited sporting exceptions
- Any other weapons, a catch-all for items like pen guns, cane guns, and smooth-bore pistols
Antique firearms and specific collector’s items that the ATF has excluded from the NFA definition are not covered and do not need a Form 3.
Information the Form Requires
Each Form 3 covers a single firearm and pulls together identifying details for both businesses plus a full description of the item.6Bureau of Alcohol, Tobacco, Firearms and Explosives. Application for Tax-Exempt Transfer of Firearm and Registration to Special Occupational Taxpayer
For the transferor (sender) and the transferee (receiver), you need the legal name and address exactly as they appear on the FFL, any trade names, the complete 15-digit FFL number, the EIN used for SOT purposes, and the SOT class. If either side’s SOT is expired for the tax year of the transfer, the application will be rejected.
The firearm description must include the manufacturer or importer, the type of firearm, caliber or gauge, model, serial number, barrel length, and overall length. Every measurement has to match the item’s existing registration in the National Firearms Registration and Transfer Record. A mismatch between your form and the registry can delay or block approval.
How to File
The transferor prepares and submits the form. There are two ways to do it.
Electronic Filing Through eForms
The ATF’s eForms system is the standard route today. You complete, sign, and submit the form entirely online, with verification screens before you apply your electronic signature.7Bureau of Alcohol, Tobacco, Firearms and Explosives. eForms Applications Approval averaged one day as of January 2026, making Form 3 the fastest NFA application type by a wide margin.1Bureau of Alcohol, Tobacco, Firearms and Explosives. Paper Filing
Paper is still accepted but slower. Print the form, complete it in duplicate, and sign both copies in ink.6Bureau of Alcohol, Tobacco, Firearms and Explosives. Application for Tax-Exempt Transfer of Firearm and Registration to Special Occupational Taxpayer Mail both to the NFA Division at the address on the form, currently 244 Needy Road, Martinsburg, WV 25405. Fax is available at (304) 616-4501 if the transferor has filed an affidavit with the NFA Division in advance. The ATF does not publish a separate processing timeline for paper Form 3 submissions.
What Approval Looks Like
Once approved, an authorized ATF official signs the form and returns a copy to the transferor.6Bureau of Alcohol, Tobacco, Firearms and Explosives. Application for Tax-Exempt Transfer of Firearm and Registration to Special Occupational Taxpayer eForms submissions produce a downloadable PDF in the portal. Approval also registers the firearm to the transferee in the NFRTR.
You can track a pending application on the eForms dashboard. For direct help, the Industry Processing Branch is reachable at ipb@atf.gov, and the “Ask the Experts” function is built into eForms.7Bureau of Alcohol, Tobacco, Firearms and Explosives. eForms Applications
Shipping After Approval
Two rules govern the physical transfer. Do not ship or hand over the firearm until you have the approved form in hand. Once you have it, complete the transfer promptly rather than sitting on the approval.6Bureau of Alcohol, Tobacco, Firearms and Explosives. Application for Tax-Exempt Transfer of Firearm and Registration to Special Occupational Taxpayer Moving an NFA item before ATF approval violates federal law and can cost a business its license.8Office of the Law Revision Counsel. 18 U.S.C. 922 – Unlawful Acts
Federal shipping rules also apply. You must give the common carrier written notice that the package contains a firearm. The carrier cannot place any external label indicating a firearm is inside, and it must obtain written acknowledgment of receipt from whoever accepts delivery.8Office of the Law Revision Counsel. 18 U.S.C. 922 – Unlawful Acts Carriers have their own layered policies on top of these federal requirements. Some refuse machine guns entirely; others require a pre-approved contract before accepting any NFA items. Confirm your carrier’s policy before scheduling pickup.
If Your Form Is Disapproved
The reason for a disapproval should appear on the last page of the returned PDF. If it is missing or unclear, call the NFA Branch at (304) 616-4500.
A disapproved eForm cannot be edited, resubmitted, or copied as a template. You start a new submission from scratch with the corrected information. Because Form 3 is tax-exempt, no refund is involved.
The usual causes of disapproval are mismatched FFL or SOT information, expired SOT status on one side of the transaction, and firearm descriptions that do not match the item’s existing NFRTR entry.
Records You Must Keep
Every FFL with SOT status must keep NFA registration documents, including approved Form 3 copies, in chronological order at the licensed premises.9Bureau of Alcohol, Tobacco, Firearms and Explosives. Federal Firearms Licensee Quick Reference and Best Practices Guide At a minimum, you must retain the Form 3 for every NFA firearm currently registered to you and still in your inventory.
Once you transfer an item out on a subsequent Form 3 or on a Form 4, the regulation no longer strictly requires you to keep the old inbound Form 3. Best practice is to hold onto them anyway. If an NFRTR record contains an error, your approved Form 3 is the cleanest proof of a lawful chain of custody, and ATF investigators will review these documents during compliance inspections.
Using Form 3 to Close a Business
If you are surrendering your FFL or shutting down, you can still move NFA inventory tax-free on Form 3 to another qualified FFL/SOT, but only while your license and SOT status remain active.10Bureau of Alcohol, Tobacco, Firearms and Explosives. NFA Handbook – Chapter 14 – Going Out of Business Let either lapse before finishing the transfers and the rest of the inventory has to move on Form 4 at $200 per item.
Post-1986 machine guns held as dealer samples have an extra step. When you transfer these on Form 3 during a business closure, you must document that you are discontinuing business and include that documentation with each application.10Bureau of Alcohol, Tobacco, Firearms and Explosives. NFA Handbook – Chapter 14 – Going Out of Business Once the SOT lapses, the window for tax-free transfers closes permanently.
Penalties for Getting It Wrong
Federal law lists specific prohibited acts around NFA firearms, including possessing an unregistered item, transferring without approval, altering a serial number, and making a false entry on any NFA application.11Office of the Law Revision Counsel. 26 U.S.C. 5861 – Prohibited Acts A conviction carries up to ten years in federal prison.12GovInfo. 26 U.S.C. 5871 – Penalties The NFA sets a maximum fine of $10,000, and a separate federal sentencing statute raises the ceiling to $250,000 for individuals and $500,000 for organizations.13Bureau of Alcohol, Tobacco, Firearms and Explosives. NFA Handbook – Chapter 15 – Penalties and Sanctions
A violation can also mean revocation of the FFL itself. Because Form 3 approval is what registers the firearm to the new holder, shipping or receiving an NFA item without the approved form in hand leaves the item effectively unregistered in the recipient’s name, which is its own federal offense.
