A USCIS expedite request is a free, discretionary petition asking U.S. Citizenship and Immigration Services to pull your pending case out of the normal processing queue and act on it sooner. Meeting one of the agency’s five criteria doesn’t guarantee approval — officers decide each request on the individual facts, and USCIS rarely explains a denial.1U.S. Citizenship and Immigration Services. Expedite Requests If your case involves a passport rather than an immigration benefit, that goes through a different Department of State process covered at the end.
The Five Criteria That Can Qualify You
The USCIS Policy Manual recognizes five categories that can justify moving a case ahead of others in the queue.2U.S. Citizenship and Immigration Services. Chapter 5 – Expedite Requests Your situation needs to fit at least one of them, and the fit needs to be documented.
Severe financial loss to a person or company. The harm has to be substantial and imminent, and it can’t be the result of your own delay in filing or responding to a request for evidence. Examples include losing a major contract, an employer unable to keep operating without a specific worker’s authorization, or a scheduled layoff tied to a pending petition.
Emergencies or urgent humanitarian situations. Medical emergencies requiring life-saving treatment, caring for a terminally ill relative, or dangerous conditions abroad such as civil unrest or natural disasters. USCIS looks for harm that waiting cannot undo.
Nonprofit organization interests. An IRS-designated nonprofit can request an expedite for a specific beneficiary whose role furthers U.S. cultural or social interests. The focus is on what the individual will do, not on the organization’s mission in general. A medical researcher needed for a public health project or a professor required for an imminent program are the kinds of cases the manual contemplates.2U.S. Citizenship and Immigration Services. Government interests. Cases involving public safety, national security, or another federal agency’s urgent interest. When agencies such as the Department of Justice, Department of Labor, Department of State, or other DHS components identify an urgent government interest, USCIS generally defers to that assessment.2U.S. Citizenship and Immigration Services. Chapter 5 – Expedite Requests
Clear USCIS error. If the agency itself made a mistake that delayed your case, that error is grounds for expedited handling.2U.S. Citizenship and Immigration Services. Chapter 5 – Expedite Requests
Officers keep full discretion across all five categories. Meeting the baseline doesn’t entitle you to approval, and USCIS generally doesn’t give a reasoned explanation when it says no.
When You Can’t Use an Expedite Request
If premium processing is available for your form type, USCIS will generally refuse to consider a discretionary expedite request.1U.S. Citizenship and Immigration Services. Expedite Requests That covers most I-129 nonimmigrant worker petitions, I-140 immigrant worker petitions, many I-765 employment authorization applications, and certain I-539 change-of-status filings. For these, the faster route is Form I-907 and the premium processing fee, which comes with a guaranteed timeline for USCIS to act.3U.S. Citizenship and Immigration Services. How Do I Request Premium Processing
There is one exception. An IRS-designated nonprofit filing for a beneficiary whose services further U.S. cultural or social interests can request a free expedite even when premium processing is available for that benefit.2U.S. Citizenship and Immigration Services. Chapter 5 – Expedite Requests
Check whether your form type is eligible for premium processing before you spend time assembling an expedite package. If it is, USCIS won’t review the expedite request.
Evidence to Include With Your Request
Expedite requests are decided on the paperwork you send in. A request without supporting documents almost always gets a fast denial rather than a follow-up asking for more.
Your request letter should include the receipt number from your Form I-797C (Notice of Action), your full legal name, and your Alien Registration Number if you have one. Connect your specific facts to one of the five criteria, and reference each attached document by name.
Financial Loss
Objective proof of imminent, real damage. Bank statements, signed contracts at risk, payroll records, or tax returns showing sharp revenue decline. An employer letter naming a specific layoff date tied to your immigration status weighs more than a general statement about possible job loss. The harm has to go well beyond the ordinary inconvenience every applicant in the queue experiences.
Humanitarian or Medical
A physician’s letter on official letterhead with the diagnosis, urgency, and consequences of delay. For dangerous conditions abroad, include news reports or country condition documentation showing the specific threat. Every assertion in your letter should have a corresponding document behind it.
Government Interest or USCIS Error
For another agency’s interest, that agency needs to send a formal memorandum explaining why your status or presence is necessary for a specific program or investigation. For a USCIS error, include copies of your original filing along with the incorrect notices you received so the mistake is visible on paper.
Foreign-Language Documents
Anything not in English needs a certified English translation. The translator signs a statement certifying they are competent in both languages and that the translation is accurate, and the certification carries the translator’s printed name, signature, address, and date.4eCFR. 8 CFR 1003.33 – Translation of Documents You don’t need a professional service — anyone fluent in both languages can do it — but the certification statement is mandatory. Without it, USCIS may disregard the document.
How to Submit Your Request
Three channels are available, and the right one depends on your situation.
The most common is the USCIS Contact Center, reached by phone or through the Emma virtual assistant on the USCIS website. State clearly that you are requesting an expedite and have your receipt number ready. The representative will ask screening questions to determine whether your circumstances line up with the criteria.1U.S. Citizenship and Immigration Services. Expedite Requests
If you have a USCIS online account with secure messaging, you can select “expedite” as the reason for your inquiry and upload scanned copies of your supporting documents through the portal.1U.S. Citizenship and Immigration Services. Expedite Requests That creates a written record, useful if you need to follow up.
For a case pending at a USCIS office outside the United States, you may need to send a written request with supporting documentation directly to the specific office handling your case.
What Happens After You Submit
USCIS receives a high volume of expedite requests. The agency has said it generally sends responses to requests submitted through the Contact Center, though it doesn’t publish a guaranteed response time.2U.S. Citizenship and Immigration Services. Chapter 5 – Expedite Requests Communication usually comes through the email on your account or by mail.
If approved, your case moves ahead of the standard queue. Time to a final decision still depends on complexity. Approval of the expedite is not approval of the underlying application. USCIS is just agreeing to look at it sooner.
If Your Request Is Denied
A denied expedite does not affect your underlying case, which continues processing normally. USCIS generally does not explain the reasoning behind an expedite denial.2U.S. Citizenship and Immigration Services. Chapter 5 – Expedite Requests
Because these decisions are discretionary, there is no formal appeal. You can submit a new expedite request with stronger evidence or documentation of changed circumstances. If a medical condition has worsened or a financial deadline has moved closer, a fresh submission with updated proof may land differently.
Congressional Assistance
Your U.S. Representative or Senator’s office can make a congressional inquiry on your behalf. Most congressional offices have a caseworker who handles immigration. They’ll ask you to sign a privacy release form and provide your receipt notice and supporting documentation, then contact USCIS to request a status update or expedited review. A congressional inquiry doesn’t override USCIS’s discretion, but it adds visibility and sometimes prompts faster action.
Passport Expedites Are a Separate Process
If what you actually need is a passport in a hurry, that runs through the Department of State, not USCIS. Standard passport processing takes four to six weeks. A $60 expedite fee shortens processing to two to three weeks, with mailing time of up to two weeks in each direction on top of that.5U.S. Department of State. Processing Times for U.S. Passports The fee can be added whether you’re applying in person for a new passport or renewing by mail.6U.S. Department of State. How to Get My U.S. Passport Fast
A separate life-or-death emergency appointment is available if you need to travel internationally within two weeks because an immediate family member abroad has died, is dying, or has a life-threatening illness or injury. Immediate family for this purpose means a parent, child, spouse, sibling, or grandparent, not aunts, uncles, or cousins.
