An endorsement stamp is a pre-inked or rubber stamp that prints a payee’s name, account number, and deposit instructions onto the back of a check in place of a handwritten signature. Under the Uniform Commercial Code, a signature can be made “by means of a device or machine” and can be any name, word, mark, or symbol adopted to authenticate a document, so a stamped endorsement carries the same legal weight as one written in pen.1Legal Information Institute. Uniform Commercial Code 3-401 – Signature Businesses that process stacks of checks each week rely on them, and anyone who deposits checks often can use one too.
Is a Stamped Endorsement Legally Valid
Yes. UCC § 3-401 says a person is not liable on a negotiable instrument unless they signed it, and then defines “signature” broadly enough to include marks made by device or machine, provided the person applying it intends to authenticate the check.1Legal Information Institute. Uniform Commercial Code 3-401 – Signature Banks accept stamped endorsements every day. What matters is the wording you choose and the care you take with the stamp itself.
Types of Endorsement Stamps
The language on your stamp controls what can happen to a check after you endorse it. Pick the wrong type and you can turn a payment into something anyone can cash.
Blank Endorsement
A blank endorsement is just the payee’s name, nothing else. Under UCC § 3-204, an instrument endorsed in blank “becomes payable to bearer and may be negotiated by delivery alone.”2Legal Information Institute. Uniform Commercial Code 3-204 – Indorsement In plain terms, a blank-endorsed check is close to cash. If it slips off a desk or disappears in transit before reaching the bank, whoever picks it up can present it. Blank endorsement stamps are a poor choice for almost anyone.
Restrictive Endorsement
A restrictive endorsement adds “For Deposit Only” along with an account number, tying the check to a single destination. UCC § 3-206 gives that restriction real force: once a check is endorsed for deposit or for collection, a depositary bank that handles it must act consistently with the endorsement or answer for any resulting loss.3Legal Information Institute. Uniform Commercial Code 3-206 – Restrictive Indorsement This is the standard stamp for businesses and the type most banks prefer. A stolen check with a restrictive endorsement cannot be walked into a counter and cashed.
Special Endorsement
A special endorsement names a new payee, usually with wording like “Pay to the order of [Name].” Once applied, only the named party can further negotiate the check.2Legal Information Institute. Uniform Commercial Code 3-204 – Indorsement Special endorsement stamps are uncommon because the new payee usually changes from check to check, but some businesses that routinely forward payments to a parent company or a specific vendor use them.
Qualified Endorsement
Adding “without recourse” to any endorsement type disclaims responsibility if the check later bounces. It matters most to intermediaries handling third-party checks, such as a factoring company or an agent collecting for a client. For a business simply depositing its own receivables, this language adds little.
What to Put on the Stamp
A restrictive endorsement stamp, the type most people should order, needs four things:
- The payee name, matching the exact legal name on your bank account. For a business, that is the registered entity name, not a DBA or nickname.
- The phrase “For Deposit Only,” which locks the check to your account.
- Your account number at the bank or credit union.
- The name of the bank or credit union.
Before ordering, pull a recent statement and copy the account name, number, and institution name character by character. A wrong digit means the bank either rejects the deposit or credits the wrong account, and unwinding that can take days and generate return-item fees. Self-inking stamps built for check endorsement generally run $20 to $80 depending on size and line count.
Who Is Authorized to Use It
If more than one person in your business handles deposits, document who is allowed to use the stamp. Most banks expect a corporate resolution or board authorization naming the people permitted to sign or stamp checks on the organization’s behalf. Update that resolution whenever someone leaves or changes roles, because the existing authority remains in effect until the bank receives written notice of the change. If an unauthorized employee stamps and deposits a check that later becomes disputed, proving the transaction was legitimate gets harder without that paper trail.
How to Stamp a Check Correctly
Where the Stamp Goes
Federal Reserve Regulation CC sets endorsement placement rules. Under Appendix D to Part 229, the payee’s endorsement belongs in the 1.5-inch strip at the trailing edge of the check, which is the left side when you look at the check face-up.4Board of Governors of the Federal Reserve System. Final Amendments to Regulation CC – Appendix D When you flip the check over, that strip sits at the top. The rest of the back is reserved for bank processing marks.
Stamping outside that 1.5-inch zone is one of the quickest ways to get a deposit rejected. Bank scanners read specific regions for routing information, and an endorsement bleeding into that space can make the check unreadable. Keep the impression inside the top strip and leave the rest of the back blank.
Ink and Pressure
Use black or dark blue ink. Both produce high contrast on check scanners and are universally accepted. Red and green may look fine to a human eye but can wash out when a scanner converts the check to an image. Press firmly and evenly so the whole impression transfers cleanly. If your self-inking stamp starts producing faded impressions, replace the ink pad before your next batch of deposits. Pressing harder warps the stamp face.
Checks Made Out to More Than One Person
When a check is payable to two people joined by “and,” both generally must endorse it. When they are joined by “or,” one endorsement is enough.5HelpWithMyBank.gov. Must Both My Spouse and I Endorse a Check Made Out to Both of Us A stamp with only one name will not satisfy the requirement on an “and” check. The second payee needs to sign by hand next to or below the stamp, still inside the 1.5-inch endorsement area.
Mobile Deposit Needs Different Wording
If you deposit checks through a banking app, your stamp wording may need an extra line. Many banks now require the phrase “For Mobile Deposit Only” or “For Mobile Deposit Only at [Bank Name]” on checks deposited remotely. Regulation CC references this kind of language as an example of a restrictive endorsement that protects the depositary bank from indemnity claims when the same check is presented twice.6eCFR. 12 CFR Part 229 – Availability of Funds and Collection of Checks (Regulation CC) If your stamp says only “For Deposit Only,” your bank may reject the image.
Check the mobile deposit terms in your bank’s agreement before ordering. Some institutions want the bank name included; others accept generic mobile-deposit wording. If you deposit checks both in person and through an app, you may need two stamps or a single stamp that includes the mobile deposit language, which also works for in-person deposits at the same bank.
Keeping the Stamp From Being Misused
An endorsement stamp left in an unlocked drawer is an easy target. Anyone who picks it up can endorse checks payable to your business and try to redirect the funds. UCC § 3-403 says an unauthorized signature is generally ineffective against the rightful account holder, but that protection only kicks in after you have discovered the fraud, reported it, and waited for the bank to work through the claim.7Legal Information Institute. Uniform Commercial Code 3-403 – Unauthorized Signature Prevention is far less painful than recovery.
A few basic controls go a long way:
- Store the stamp in a locked drawer or safe, and limit access to the specific employees authorized to endorse checks.
- Separate the deposit function from reconciliation. When one person controls both stamping incoming checks and reconciling the bank statement, embezzlement becomes easy to hide.
- When someone with stamp access leaves or changes roles, notify the bank in writing and update your corporate resolution. The old authorization stays valid until the bank receives that notice.
If the Stamp Is Lost or Misused
Call your bank right away. The Consumer Financial Protection Bureau advises reporting forged or unauthorized endorsements promptly and notes that you are generally not responsible for a fraudulent endorsement as long as you report it within the period set by your state’s law.8Consumer Financial Protection Bureau. I Wrote a Check and Someone Forged the Endorsement and Cashed the Check Additional federal protections may apply if a compromised check was processed electronically.
After the bank call, order a replacement stamp using a new account number if the bank issues one, or at minimum confirm the bank has flagged the old details. File a police report if the stamp was stolen rather than misplaced. That report creates a record that strengthens your position if you later need to dispute unauthorized transactions. Reporting windows vary by state, so acting within the first few business days gives you the strongest legal footing.
