What Is an Affidavit of Non-Filing of Income Tax Return?

An affidavit of non-filing of income tax return is a document that confirms you did not file a federal income tax return for a specific year. It exists in two forms: the IRS Verification of Non-filing Letter, which the agency issues from its own records, and a self-declared written statement you sign under penalty of perjury. Lenders, schools, landlords, and government programs use it to verify that a gap in your tax history is legitimate.

Who Typically Asks for One

Financial aid is the most common trigger. Federal student aid applicants selected for verification must prove that they or their parents did not file a return for the relevant tax year, and schools will hold disbursements until the paperwork arrives.1Federal Student Aid. Mortgage underwriters ask for one when a loan application shows a year with no W-2s or tax transcripts. Administrators of subsidized housing, Medicaid, and other means-tested programs use non-filing verification to confirm applicants fall within income limits. Each requester will tell you whether it needs the official IRS letter or will accept a self-declared affidavit.

First, Confirm You Actually Weren’t Required to File

If you earned above the standard deduction for your filing status, you had a legal obligation to file. For tax year 2026, the thresholds are:2Internal Revenue Service. IRS Releases Tax Inflation Adjustments for Tax Year 2026

  • Single or married filing separately: $16,100
  • Married filing jointly: $32,200
  • Head of household: $24,150

Self-employment income has its own rule. If your net earnings from freelance work, side jobs, or independent contracting reach $400, you must file regardless of your total income.3Internal Revenue Service. Check If You Need to File a Tax Return You may also owe a return if you received marketplace health insurance subsidies, owe special taxes, or fall into other filing-triggering situations even below the standard deduction. In any of those cases, a non-filing document is the wrong answer. File the overdue return.

Writing a Self-Declared Affidavit

Landlords, banks, and some scholarship programs accept a self-written statement in place of the IRS letter. It’s also the only option for tax years outside the three-year window.

Your affidavit should include:

  • Your full legal name and Social Security number
  • The specific tax year or years for which no return was filed
  • The reason you did not file, such as earning below the filing threshold or having no U.S.-source income
  • A declaration under penalty of perjury that the statements are true and correct, followed by the date and your signature

Federal law allows a written declaration signed under penalty of perjury to carry the same weight as a notarized statement.11Office of the Law Revision Counsel. 28 USC 1746 – Unsworn Declarations Under Penalty of Perjury Notarization is not legally required. That said, the organization asking for the affidavit may have its own policy requiring a notary seal, in which case you sign in front of a licensed notary who verifies your identity and applies the seal. Notary fees vary by state but are generally modest.

Penalties for a False Affidavit

Signing a non-filing affidavit when you actually did file, or when you were required to file and are hiding income, is a federal crime. If the false statement goes to any branch of the federal government, you face up to five years in prison and substantial fines.12Office of the Law Revision Counsel. 18 USC 1001 – Statements or Entries Generally Even on a self-declared affidavit that never reaches a federal agency, the penalty-of-perjury language you signed exposes you to a perjury charge with the same five-year maximum.13Office of the Law Revision Counsel. 18 USC 1621 – Perjury Generally

Program-level consequences follow separately. A false affidavit can trigger repayment demands for financial aid already disbursed, loan acceleration by a mortgage lender, or disqualification from housing and assistance programs. Federal agencies share data, and discrepancies between an affidavit and IRS records tend to surface during routine audits years later.

If You Discover You Should Have Filed

If you realize during this process that you actually were required to file for the year in question, do not submit a non-filing affidavit. File the overdue return. The IRS charges a failure-to-file penalty of 5% of the unpaid tax for each month the return is late, up to 25%. For returns more than 60 days late with a due date after December 31, 2025, the minimum penalty is $525 or 100% of the unpaid tax, whichever is less.14Internal Revenue Service. Failure to File Penalty

Those penalties only apply when you owe tax. If you were due a refund, there is no late-filing penalty, though you generally have three years from the original due date to claim the refund. Filing late and owing nothing is far better than falsely declaring you were not required to file.
