What Is Amtrak Law? Federal Liability Cap and Arbitration Waiver

Amtrak passenger rights and liability sit under a mix of federal statute and Amtrak’s own ticket contract, and the combination is unusual: a federal cap limits the total money available to all injured passengers from a single accident, ticket terms since January 2019 push nearly every dispute into binding arbitration, and everyday problems like delays and lost bags are governed by Amtrak’s policies rather than any law giving you a right to compensation. Knowing which rules come from Congress and which come from the fine print you agreed to at checkout is the difference between a claim that goes somewhere and one that stalls.

If You Are Injured on an Amtrak Train

Amtrak is a common carrier, and courts hold common carriers to the highest degree of care consistent with practical operation of the service. That is a stricter standard than the ordinary “reasonable care” used in most negligence cases, and it means Amtrak can be liable for precautions an ordinary business would not owe.

Amtrak is not a federal agency, so the Federal Tort Claims Act and its two-year deadline do not apply. The statute of limitations comes from the law of the state where the injury happened. Most states allow two or three years for a personal injury suit, but some allow as little as one. Check the law of the state where your incident occurred rather than assuming.

Amtrak’s terms of carriage call for written notice of the claim before suit, identifying the claimant and describing the date, location, and nature of the injury. Missing that notice creates procedural arguments for dismissal. And because of the arbitration clause now built into ticket terms, most injury disputes will be routed into arbitration rather than court unless the arbitration agreement itself is successfully challenged.

One thing that is not an obstacle: sovereign immunity. The statute says Amtrak “is not a department, agency, or instrumentality of the United States Government” and must be “operated and managed as a for-profit corporation.”1Office of the Law Revision Counsel. 49 US Code 24301 – Status and Applicable Laws You sue Amtrak the way you would sue any private corporation.

The Federal Cap on What All Passengers Can Recover

The single most consequential rule for anyone hurt in an Amtrak accident is 49 U.S.C. Section 28103. It caps the total combined awards for all passengers, against all defendants, from a single accident. The base figure in the statute is $200 million.2Office of the Law Revision Counsel. 49 USC 28103 – Limitations on Rail Passenger Transportation Liability Congress requires inflation adjustments, and in February 2021 the Department of Transportation raised the cap from roughly $294.3 million to $322,864,228.3Federal Register. Adjustment to Rail Passenger Transportation Liability Cap Another adjustment was due around December 2025, and as of early 2026 legislation has been introduced in Congress regarding how that adjustment takes effect.

The cap is aggregate. In a derailment that injures hundreds of people, the total pot for all of them together cannot exceed that ceiling. When proven damages run above the cap, each claimant receives a proportionally reduced share. Amtrak must maintain at least $200 million in liability insurance per accident.2Office of the Law Revision Counsel. 49 USC 28103 – Limitations on Rail Passenger Transportation Liability

The cap overrides state tort law that might otherwise allow higher recovery, and it applies regardless of where the accident occurred. It covers personal injury, wrongful death, property damage, and punitive damages alike.4Office of the Law Revision Counsel. 49 US Code 28103 – Limitations on Rail Passenger Transportation Liability

Punitive Damages Are Available but Hard to Win

Punitive damages exist in Amtrak cases, but the standard is high. A passenger must prove by clear and convincing evidence that Amtrak acted with “conscious, flagrant indifference to the rights or safety of others.”4Office of the Law Revision Counsel. 49 US Code 28103 – Limitations on Rail Passenger Transportation Liability That is a heavier lift than ordinary negligence: you have to show Amtrak knew about a serious risk and consciously disregarded it.

Any punitive award still counts against the aggregate per-accident cap. In a major disaster, punitive damages for one passenger reduce what remains for everyone else’s compensatory claims. The statute preserves one exception: in states whose wrongful death laws permit only punitive-style damages rather than compensatory, the heightened standard does not apply.2Office of the Law Revision Counsel. 49 USC 28103 – Limitations on Rail Passenger Transportation Liability

Arbitration and the Class Action Waiver

Since January 2019, buying an Amtrak ticket means agreeing to resolve disputes through binding arbitration under the American Arbitration Association’s Consumer Arbitration Rules, not in court before a judge or jury. The scope is broad. Amtrak’s terms describe the arbitration agreement as covering “all claims, disputes, or controversies, past, present, or future” that would otherwise go to court, including negligence, wrongful death, emotional distress, discrimination, and punitive damages claims. It reaches claims against Amtrak’s affiliates and against host railroads whose tracks Amtrak uses.5Amtrak. Terms and Conditions

The terms also waive class actions. Passengers agree to bring claims only individually, with “no right or authority for any claim or dispute to be brought, heard or arbitrated as a class or representative action.”5Amtrak. Terms and Conditions Even when thousands of passengers are affected by the same decision, each must arbitrate alone.

Whether the clause holds up in every situation is not fully settled. Courts have sometimes found arbitration clauses in transportation contracts unenforceable, particularly where a passenger can argue there was no meaningful consent. But the Federal Arbitration Act generally favors enforcement, and Amtrak’s click-to-agree checkout is designed to establish that consent. For any passenger considering a claim, the arbitration clause is the first obstacle to assess.

Delays and Cancellations

Amtrak does not guarantee on-time performance, and no federal law requires compensation for rail delays the way European Union rules require for flights. Your recourse comes from Amtrak’s Customer Service Commitments rather than statute.

During significant disruptions, Amtrak commits to providing the following when possible:

  • Alternate transportation, whether another Amtrak train, a chartered bus, or in some cases air travel to your destination.
  • Complimentary meals and beverages when trains are severely delayed or a guaranteed connection is missed and no alternate transport is available until the next day.
  • Hotel accommodations at contracted hotels or in available sleeper cars if a delay, missed connection, or cancellation within Amtrak’s control strands you overnight.
  • Water, snack packs, and extended dining service during unplanned disruptions while you are on the train.

These are policies, not legal guarantees, and they depend on availability.6Amtrak. Amtrak Customer Service Commitments Passengers are unlikely to recover monetary damages for inconvenience or missed events. The practical remedies are a refund, a travel voucher, or Amtrak Guest Rewards points.

Refunds and Cancellation Fees

What you get back depends on fare type and timing. Every reserved-service ticket carries a risk-free cancellation window of 24 hours from purchase (before departure) for a full refund to your original payment method. Unreserved-service tickets have a one-hour window.7Amtrak. Train Ticket Refund and Cancellation Policy

Outside that window, refund amounts vary. Flex Fares refund in full with no cancellation fee. Value Fares forfeit 25 percent of the fare, rising to 30 percent for tickets purchased on or after April 13, 2026, with the rest refunded to the original payment method. Sale Fares forfeit 50 percent, with the other half refunded.

Private room reservations follow a tiered schedule: full refund if canceled 121 or more days before departure; 25 percent forfeited if canceled 120 to 15 days out; and within 14 days of departure, 25 percent forfeited with the remaining 75 percent returned as a non-refundable eVoucher rather than cash.7Amtrak. No-shows forfeit the entire value of the missed segment. Reward tickets booked with Guest Rewards points get the points back in full as long as you cancel before departure.7Amtrak. Train Ticket Refund and Cancellation Policy

Lost or Damaged Baggage

Amtrak’s liability for lost or damaged checked baggage is capped at $500 per ticketed passenger. You can raise that ceiling to $2,500 by declaring a higher value and paying an extra charge at check-in. Red Cap service drops the limit to $50 per bag. Parcel Check carries a $100 per bag limit, and no additional coverage can be purchased for it.8Amtrak. Limitation of Liability for Baggage

Claims for lost checked baggage must be submitted within 30 days of your trip to Amtrak’s Office of Customer Relations at its Washington, D.C., headquarters. Report damaged bags at the staffed baggage claim before leaving the station. For bags that never arrive, fill out a Baggage Tracing/Claim form at the station or mail one to the D.C. office.6Amtrak. Amtrak Customer Service Commitments If you travel with a laptop and professional equipment, the default $500 limit will not cover you; the declared-value option is the mechanism for higher coverage.

Accessibility and Service Animals

The Americans with Disabilities Act and the Rehabilitation Act of 1973 both apply to Amtrak. Federal regulations require Amtrak to make its stations accessible, including ramps, wider doorways, accessible restrooms, and platform-to-train boarding for passengers using wheelchairs and mobility devices. Congress gave Amtrak an extended timeline to reach full accessibility compared with other transportation providers, but the obligation itself is clear.

Service animals are governed by federal Department of Transportation regulations. Only animals individually trained to perform a specific task for a person with a disability qualify. Emotional support animals do not qualify and fall under Amtrak’s pet policies instead. Service animals must remain on the floor under the passenger’s seat, stay under the handler’s control, and be housebroken. Staff may ask what task the animal performs but cannot demand documentation. Amtrak can remove a service animal that behaves aggressively or is out of control.9Amtrak. Traveling with Service Animals Misrepresenting a pet as a service animal can result in the animal being removed from the train, and in many states it is also a criminal offense.
