What Is a VA Waiver on Retirement Pay and CRDP?

A VA waiver on retirement pay is the dollar-for-dollar reduction of your military retired pay that you agree to so you can receive VA disability compensation. Federal law does not let you collect the full amount of both at once, so if you qualify for both, you give up an equal slice of retired pay to get your disability check. Most retirees come out ahead on the swap because VA disability compensation is tax-free while retired pay is not, and two programs (CRDP and CRSC) can restore some or all of what you waived if you meet their rules.

What the Waiver Actually Is

Two statutes drive the waiver. 38 U.S.C. § 5304 bars simultaneous receipt of full military retired pay and VA disability compensation.1Office of the Law Revision Counsel. 38 USC 5304 – Prohibition Against Duplication of Benefits 38 U.S.C. § 5305 supplies the mechanism: you waive an amount of retired pay equal to the VA disability compensation you want, and the VA pays that amount instead.2GovInfo. 38 USC 5305 – Waiver of Retired Pay

The composition of your monthly income changes, not the total. Suppose gross retired pay is $2,500 and VA disability compensation is $800. You waive $800 of retired pay, receive $1,700 in retired pay from DFAS, and $800 in disability compensation from the VA. On paper the numbers match. In your bank account they don’t, because the tax treatment is different.

Why Veterans Sign It Anyway

Length-of-service retired pay is taxable federal income.3MyArmyBenefits. Federal Taxes on Veterans’ Disability or Military Retirement Pensions VA disability compensation is excluded from gross income entirely under IRS Publication 525.4Internal Revenue Service. Publication 525 (2025), Taxable and Nontaxable Income Signing the waiver converts taxable dollars into tax-free dollars at the same face value. That is the point of the exercise.

The election is also not permanent. Federal regulations let you re-elect retired pay over VA compensation if your situation changes.5eCFR. 38 CFR 3.750 – Entitlement to Concurrent Receipt of Military Retired Pay and Disability Compensation

Filing VA Form 21-651

The waiver goes on VA Form 21-651, titled “Election of Compensation in Lieu of Retired Pay or Waiver of Retired Pay to Secure Compensation from Department of Veterans Affairs.”6Veterans Affairs. About VA Form 21-651 The form is short. It asks for your name, VA file number, service number, Social Security number, and the address of the VA office handling your claim.7Department of Veterans Affairs. Download it from the VA website or pick one up at a local VA office, sign it, and mail it to the VA office listed in the instructions. Keep a copy. If the VA later needs to verify when you filed, your own records save the argument.

Who Has to Take the Waiver

Not every retiree with a disability rating is stuck with the waiver. It applies when you’re entitled to both retired pay and VA disability compensation but don’t qualify for a concurrent-receipt program that bypasses the offset. You will need the waiver in these situations:

Chapter 61 retirees with 20 or more years of service sit in a middle zone. They can get CRDP, but only up to what a length-of-service retirement would have paid. Anything above that still gets offset.8Office of the Law Revision Counsel. 10 USC 1414 – Members Eligible for Retired Pay Who Are Also Eligible for Veterans’ Disability Compensation for Disabilities Rated 50 Percent or Higher

CRDP: Automatic Restoration

Concurrent Retirement and Disability Pay ends the practical effect of the waiver for qualifying retirees. DFAS restores the waived retired pay automatically. No application.9Defense Finance and Accounting Service. CRDP and CRSC Payment Information

You qualify if you have both:

  • A VA disability rating of 50% or higher
  • 20 or more years of creditable service, or the reserve-retirement equivalent

CRDP payments are taxable, because they are your retired pay coming back to you. Per dollar, CRDP is less valuable than CRSC for veterans who qualify for both.

CRSC: Tax-Free Restoration for Combat-Related Disabilities

Combat-Related Special Compensation takes a different path. The VA waiver stays in place; CRSC pays a separate, tax-free monthly amount that restores the portion tied to combat-related disabilities.10Defense Finance and Accounting Service. VA Waiver and Retired Pay – CRDP – CRSC

A disability qualifies if it falls into one of these categories:11Office of the Law Revision Counsel. 10 USC 1413a – Combat-Related Special Compensation

  • Injury tied to a Purple Heart
  • Direct result of armed conflict
  • Hazardous service
  • Conditions simulating war, such as combat-replication training
  • Instrumentality of war, such as military weapons, vehicles, or equipment

CRSC is not automatic. You apply to your branch of service, and that branch decides which of your disabilities count as combat-related.9Defense Finance and Accounting Service. Choosing Between CRDP and CRSC

You can’t collect both in the same month.12Defense Finance and Accounting Service. CRDP/CRSC Open Season Frequently Asked Questions If you qualify for both, DFAS assigns the one that pays more unless you tell them otherwise. The trade-off: CRDP typically restores more dollars if your total disability rating outpaces the combat-related share, but those dollars are taxable. CRSC restores fewer dollars when only some disabilities are combat-related, but those dollars are tax-free.

DFAS runs an annual open season each January for veterans eligible for both to switch. The 2026 open season ran January 1 through January 31, 2026, and DFAS sends eligible retirees a letter showing the calculated amounts under each program.14Defense Finance and Accounting Service. When VA Pay Wipes Out Retired Pay

If your VA disability compensation is larger than your gross retired pay, the waiver zeros out your retired pay. DFAS pays you nothing in retired pay, and the VA pays your full disability amount. You don’t lose the excess; the waiver only reduces retired pay to zero, not below it.

This is common for Chapter 61 retirees with shorter careers and high ratings. Once retired pay hits zero, DFAS can no longer pull automatic deductions from it, which creates a real problem for Survivor Benefit Plan premiums and other withholdings.

Keeping SBP Premiums Paid

The Survivor Benefit Plan calculates coverage from gross retired pay, and DFAS normally deducts premiums from that pay.15Air Force Retirees. SBP Coverage Costs A large waiver can leave too little retired pay to cover the premium.

The fix is DD Form 2891, which authorizes DFAS to collect SBP premiums from your VA disability compensation instead. Sign it, list the amount and start date, and submit it to DFAS.16Defense Finance and Accounting Service. Paying for SBP The VA doesn’t complete any part of the form. Missed premiums put coverage at risk, so handle this quickly after a rating increase.

Retroactive VA Awards and Amended Tax Returns

If the VA grants you a service-connected rating retroactive to years already in the rearview mirror, you can exclude the corresponding retired pay from taxable income for that entire retroactive period. IRS Publication 525 confirms the exclusion up to the amount of VA disability benefits you would have been entitled to receive.4Internal Revenue Service. Publication 525 (2025), Taxable and Nontaxable Income

To recover the taxes you already paid, file Form 1040-X for each affected tax year and include a copy of the VA determination letter. That letter shows the monthly amounts and effective dates you need to calculate the reduction for each year.17Internal Revenue Service. Veterans Tax Information and Services

The general deadline for an amended return is three years from filing or two years from paying the tax, whichever is later.18Internal Revenue Service. Topic No. 308, Amended Returns A special rule extends the window for retroactive VA disability determinations by one year from the date of the VA’s determination, though the extension does not reach any tax year that began more than five years before that date.4Internal Revenue Service. Publication 525 (2025), Taxable and Nontaxable Income For a large retroactive award, the refund is worth the paperwork.

The Waiver in a Divorce

The waiver creates an issue in military divorces that surprises both sides. Under the Uniformed Services Former Spouses’ Protection Act, state courts can divide “disposable retired pay” as marital property, but disposable retired pay excludes any amount waived for VA disability compensation.19Defense Finance and Accounting Service. Frequently Asked Questions

In Howell v. Howell (2017), the Supreme Court held that a state court cannot order a veteran to indemnify or reimburse a former spouse for the reduction in the spouse’s share of retired pay caused by the veteran’s VA waiver.20Supreme Court of the United States. Howell v. Howell, 581 U.S. (2017) The Court found that labeling such an order “reimbursement” rather than “property division” changed nothing about the conflict with federal law.

Practically, if you get a VA rating after divorce or your rating goes up, the larger waiver shrinks the pool of retired pay your former spouse can claim. A family court can weigh that possibility when setting spousal support at the outset, but it cannot force you to make the former spouse whole for what the waiver takes.
