What Is a Tax Levy on Your Paycheck and How to Stop It

A tax levy on your paycheck is a legal seizure of your wages by the IRS to satisfy unpaid taxes. It is continuous, not a one-time hit: once your employer receives the levy, they withhold everything above a small protected amount from every paycheck and send it to the IRS until the debt is paid, you set up an alternative, or the IRS formally releases the levy in writing.1Internal Revenue Service. Information About Wage Levies You can stop it, but you have to act — the levy will not expire on its own between paychecks.

How Much of Your Paycheck the IRS Can Take

The IRS leaves you a weekly exempt amount based on your filing status and dependents, published each year in Publication 1494. Everything above that goes to the government. For 2026, the weekly protected amounts are:2Internal Revenue Service. Publication 1494 – Tables for Figuring Amount Exempt From Levy

  • Single, no dependents: $309.62 per week ($1,341.67 per month)
  • Single, two dependents: $513.46 per week ($2,225.01 per month)
  • Married filing jointly, no dependents: $619.23 per week ($2,683.33 per month)
  • Married filing jointly, two dependents: $823.07 per week ($3,566.67 per month)

Each additional dependent adds roughly $101.92 per week. For someone earning $1,000 a week filing single with no dependents, the IRS takes $690.38 every week. This is far more aggressive than an ordinary creditor garnishment, and it is legal: the 25 percent cap that applies to most garnishments does not apply to federal or state tax debts.3U.S. Department of Labor. The Three-Day Statement You Cannot Skip

When your employer gets the levy, they will hand you a Statement of Dependents and Filing Status. Fill it out and return it within three days.4Internal Revenue Service. What if I Get a Levy Against One of My Employees, Vendors, Customers or Other Third Parties If you do not, your employer is required to treat you as married filing separately with no dependents — the smallest protected amount available.5Office of the Law Revision Counsel. 26 USC 6334 – Property Exempt From Levy Your W-4 does not count for this; the levy uses its own statement.6Internal Revenue Service. 5.11.5 Levy on Wages, Salary, and Other Income

Bonuses and Commissions

A bonus paid separately from your regular check is especially exposed. If the exempt amount was already applied to that pay period’s regular wages, the entire bonus goes to the IRS. Commissions and fees are treated the same way.1Internal Revenue Service. Information About Wage Levies

The 30-Day Notice: Your Cheapest Chance to Stop It

The IRS cannot garnish your wages without warning. It must send a written notice at least 30 days before the first levy, telling you the amount owed and your right to a hearing.7Office of the Law Revision Counsel. 26 USC 6330 – Notice and Opportunity for Hearing Before Levy That 30-day window is the easiest point to intervene.

During those 30 days you can request a Collection Due Process (CDP) hearing. At the hearing you can dispute whether you owe the tax, challenge the amount, or propose an alternative like an installment agreement or an offer in compromise. A timely CDP request generally freezes the levy until the hearing is resolved.7Office of the Law Revision Counsel. 26 USC 6330 – Notice and Opportunity for Hearing Before Levy Miss the window and the IRS moves forward.

How to Get an Active Levy Released

If the levy has already started hitting your paychecks, releasing it is a documentation exercise. Call the phone number printed on your levy notice first. For urgent situations, the IRS accepts emergency levy release requests by fax at 855-796-4524.8Internal Revenue Service. People First Initiative FAQs – Liens, Levies and Other Collection Activities

Before you pick up the phone, get your paperwork together. You will need to complete Form 433-F, the Collection Information Statement that captures your income, expenses, assets, and debts.9Internal Revenue Service. Form 433-F Collection Information Statement Have pay stubs, bank statements, and bills for rent, utilities, and medical care ready. The IRS uses this to decide whether you qualify for hardship relief or a payment arrangement.

File any missing returns before you ask. The IRS generally will not release a levy while you are out of filing compliance, so unfiled returns from prior years are the first task on the list.

Federal law requires the IRS to release a levy in five situations:10Office of the Law Revision Counsel. 26 USC 6343 – Authority to Release Levy and Return Property

  • The debt has been paid, or the 10-year collection period has run out.
  • The IRS decides that releasing the levy will actually make collection easier.
  • You have entered a formal installment agreement whose terms do not require the levy to continue.
  • The levy is causing economic hardship — you cannot pay for basic living expenses.
  • The value of the levied property significantly exceeds the debt.

For wage levies, economic hardship is the path most people take. You have to show that the amount being withheld leaves you unable to cover housing, food, transportation, or medical care.

When the IRS agrees, it issues Form 668-D, the release notice, which goes to your employer.11Internal Revenue Service. 5.11.2 Serving Levies, Releasing Levies and Returning Property Your employer will not restore your full paycheck on your word alone — they need that form in hand. Confirm with payroll that they have received it, and expect one to two pay cycles before your check returns to normal.

Resolving the Underlying Debt

Getting the levy lifted stops the bleeding, but you still owe the tax. Four paths address the debt itself.

Installment Agreement

A payment plan spreads the balance over fixed monthly amounts. Once the IRS accepts an installment agreement, it must release the wage levy unless the agreement says otherwise.10Office of the Law Revision Counsel. 26 USC 6343 – Authority to Release Levy and Return Property Interest and penalties still accrue, so paying more than the minimum shortens the debt meaningfully.

Offer in Compromise

An offer in compromise settles the debt for less than the full balance, but the IRS accepts one only when it concludes the offered amount is the most it can reasonably collect. You submit Form 656 with Form 433-A (OIC), which lays out your complete financial picture.12Internal Revenue Service. Form 433-A (OIC) Collection Information Statement for Wage Earners and Self-Employed Individuals Filing an offer does not automatically stop a wage levy already in place; the IRS decides whether to release it while your offer is under review.

Currently Not Collectible Status

If your income barely covers essential expenses, the IRS may place your account in currently not collectible status, which halts active collection including wage levies. The debt remains, and interest and penalties keep running, but the IRS stops trying to collect until your finances improve. You qualify by submitting Form 433-F or 433-A showing that paying would leave you unable to meet basic needs.13Taxpayer Advocate Service. Currently Not Collectible (CNC)

Bankruptcy

Filing for bankruptcy triggers an automatic stay that generally halts a wage levy. The IRS must take corrective action within two business days of learning about the filing.11Internal Revenue Service. 5.11.2 Serving Levies, Releasing Levies and Returning Property Whether bankruptcy discharges the tax debt itself depends on the type of tax and how old it is, so it is not a universal fix.

Your Employer Cannot Fire You Over One Levy

Processing a wage levy is a nuisance for payroll, but federal law forbids an employer from firing you because your earnings are subject to garnishment for a single debt.14Office of the Law Revision Counsel. 15 U.S. Code 1674 – Restriction on Discharge From Employment by Reason of Garnishment The Department of Labor enforces this rule.3U.S. Department of Labor. Fact Sheet 30 – Wage Garnishment Protections of the Consumer Credit Protection Act (CCPA) The protection weakens if you have multiple unrelated garnishments running at once.

When the Debt Is Old or the Levy Is Wrong

The IRS has 10 years from the date it assesses a tax to collect it. After that, the debt is generally unenforceable and any active levy must be released.15Office of the Law Revision Counsel. 26 U.S. Code 6502 – Collection After Assessment Some actions pause or extend the clock, including installment agreements and bankruptcy filings, so the assessment date matters more than the calendar date.

If the IRS levied the wrong person, the wrong amount, or served the levy after the collection period expired, you can file a wrongful levy claim to get the money back. The IRS must return wrongfully levied property or its equivalent value.16Internal Revenue Service. Filing a Wrongful Levy Claim For funds the IRS still holds, there is no filing deadline. Once the money has been applied to a debt or otherwise disposed of, you have two years from the date of the levy.
