What Is a Tax Compliance Report and When Do You Need One

A tax compliance report is a record showing whether a person or business is current on their tax obligations. At the federal level, it usually takes the form of an IRS tax transcript — most often the tax account transcript, which lists filings, payments, balances, penalties, and any collection activity. At the state level, the equivalent document is generally called a tax clearance certificate, issued by the state revenue department to confirm a business has paid what it owes. Whichever version you need, the purpose is the same: independent proof, from the taxing authority itself, that you are square with the government.

Which IRS Transcript Shows Compliance

The IRS does not issue anything titled “tax compliance report.” It offers several transcript types, and the right one depends on what the requester wants to see.

  • The tax account transcript shows account-level activity: payments posted, penalties assessed, adjustments made by the IRS, and any balance still owed. This is the closest thing to a compliance snapshot, because it reveals whether you owe money.
  • The tax return transcript shows the data you originally reported — income, deductions, credits, filing status. Mortgage lenders commonly request this one to verify income.
  • The record of account combines the return transcript and the account transcript into a single document.
  • The wage and income transcript shows the W-2s, 1099s, and other information returns filed under your name.
  • The verification of nonfiling letter confirms the IRS has no record of a return for a specific year, which is useful for financial aid or when a third party needs proof you weren’t required to file.

Through the IRS Individual Online Account, tax return and record of account transcripts are available for the current year and three prior years. Tax account transcripts are available for the current year and nine prior years. Older records require a paper request on Form 4506-T.1Internal Revenue Service. What the Transcript Actually Reveals

A tax account transcript opens with your taxpayer identification number, then uses transaction codes to walk through each tax year. Some codes are routine: one shows the date you filed and the tax on your return, another reflects withholding credits, another shows a refund was issued.2Taxpayer Advocate Service. Decoding IRS Transcripts and the New Transcript Format: Part II

The codes that matter for compliance are the ones flagging trouble. Separate codes indicate a failure-to-pay penalty, a filed federal tax lien, initiated litigation, or an account classified as currently not collectible. A lien indicator points to a claim filed against your property under 26 U.S.C. § 6321, the statute that gives the government a legal interest in everything you own once a tax debt goes unpaid after demand.3Office of the Law Revision Counsel. 26 USC 6321 – Lien for Taxes Any remaining balance appears alongside the date through which penalties and interest were calculated.2Taxpayer Advocate Service. A transcript that reads as compliant will show returns filed for every applicable year, payments that match or exceed the tax assessed, no penalty codes, no lien indicators, and a zero balance due. Even a single unresolved balance can raise a flag with a lender or contracting officer, so pulling your own transcript before someone else does is worth the small effort.

When You’ll Be Asked for One

Federal Contracts

Federal procurement is where these records carry the most weight. Under the Federal Acquisition Regulation, a contractor bidding on a federal contract must certify whether it has been notified of any delinquent federal tax liability exceeding $15,000 within the past three years. A debt only counts as delinquent when the liability has been assessed and full payment is past due; a pending administrative or judicial challenge means it is not yet final.4Acquisition.GOV. FAR 52.209-5 Certification Regarding Responsibility Matters When an offeror discloses a delinquency, the contracting officer must notify the agency debarment or suspension official before awarding the contract.5Acquisition.GOV. FAR 9.104-5 Representation and Certifications Regarding Responsibility Matters

For IRS contracts specifically, all potential vendors undergo a tax check, and anyone with an unresolved delinquency is ineligible. A taxpayer with an active installment agreement or a pending offer in compromise is treated as in compliance; what matters is that the debt is being addressed, not that it has been paid in full.6Internal Revenue Service. Business Sales, Licensing, and Lending

Buyers doing due diligence on an acquisition target routinely pull transcripts to test what the seller represented on the balance sheet. An unfiled return or an unpaid penalty accumulating interest can change a company’s valuation. Some professional licensing boards require proof of tax compliance at application or renewal, and certain visa programs use it to establish financial stability. Mortgage lenders request tax return transcripts as part of income verification. In every case the logic is the same: the requester wants confirmation from the IRS itself, not from you.

How to Request Your Transcript

IRS transcripts are free through every request method. You’ll need your legal name, taxpayer identification number, and the specific tax form and year: Form 1040 for individual income tax, Form 1120 for a C corporation, Form 1065 for a partnership.7Internal Revenue Service. Online

The fastest route is your IRS Individual Online Account, where you can view, print, or download every transcript type immediately.8Internal Revenue Service. Transcript Types for Individuals and Ways to Order Them The first time in, you’ll verify your identity through the IRS authentication system.

By Mail or Phone

If you can’t use the online system, the “Get Transcript by Mail” tool and the automated phone line at 800-908-9946 will send a tax return transcript or tax account transcript to the address the IRS has on file. Delivery runs 5 to 10 calendar days.8Internal Revenue Service. Transcript Types for Individuals and Ways to Order Them If your current address doesn’t match IRS records, file Form 8822 (Change of Address) first, and expect four to six weeks for that change to process.1Internal Revenue Service. Form 4506-T

For years not available through the online or automated systems, submit Form 4506-T by mail or fax to the IRS service center for the state where the return was filed. The IRS must receive the form within 120 days of the date you signed it, or the request will be rejected. You must also check the authorization box in the signature area; an unchecked box means the form won’t be processed.9Internal Revenue Service. Form 4506-T, Request for Transcript of Tax Return

Letting Someone Else Get the Transcript

You can authorize an accountant, attorney, or other representative to receive your tax information. Form 8821 (Tax Information Authorization) designates a person or organization to inspect or receive your confidential tax information for specific tax types and periods. The designee can pull transcripts and speak with the IRS about your account, but cannot represent you or sign anything for you.10Internal Revenue Service. About Form 8821, Tax Information Authorization If you need someone who can actually negotiate, sign agreements, or file appeals on your behalf, that requires Form 2848 (Power of Attorney).

Enrolled agents, CPAs, and attorneys can pull transcripts electronically through the IRS Transcript Delivery System once a properly executed Form 2848 or Form 8821 is on file, which is considerably faster than mailing paper.11Internal Revenue Service. Transcript Delivery System (TDS)

One boundary to know: since July 2019, the IRS no longer mails transcripts to third-party addresses. A transcript requested on Form 4506-T goes only to the taxpayer’s address of record. Third parties who need transcripts directly, such as mortgage lenders, must use the Income Verification Express Service (IVES) or work through an existing IVES participant.12Internal Revenue Service. State Tax Clearance Certificates

Federal transcripts get the most attention, but the state-side document matters just as much for businesses. A state tax clearance certificate confirms a business has no outstanding state tax liabilities, typically franchise taxes, sales taxes, or withholding taxes. States commonly require one when a business is terminating its registration, reinstating a lapsed one, or bidding on state contracts.

The process varies by jurisdiction. Some states accept online requests through the comptroller’s or revenue department’s website; others require a written application. Names vary too, from Certificate of Account Status to Tax Clearance Letter. Fees run from nothing to a modest charge, and published processing times are rare. Check your state revenue department’s website or call the office before you need the certificate, not the day before a filing deadline.

Fixing Problems the Transcript Surfaces

Sometimes the transcript shows a balance you didn’t know about, a return the IRS says was never filed, or a lien you thought was resolved. What to do depends on the problem.

If you owe and can pay, paying in full is the fastest path to a clean record. If you can’t, an installment agreement changes your status in a meaningful way: while the agreement is pending or active, the IRS is generally prohibited from issuing levies, and your account is typically treated as in compliance for purposes like contract eligibility.13Internal Revenue Service. Payment Plans; Installment Agreements An offer in compromise, where the IRS agrees to accept less than the full amount owed, has a similar protective effect while pending.6Internal Revenue Service. If a federal tax lien was filed against your property by mistake, perhaps because you share a name with the actual debtor, you can apply for a Certificate of Non-Attachment under Internal Revenue Code section 6325(e). There’s no standard form; you submit a letter to the IRS Advisory Group Manager explaining why you are not the person who owes the debt, along with supporting documentation such as your Social Security number, a copy of the lien notice, and a description of the affected property. If the request is denied, you have the right to appeal.14Internal Revenue Service. How to Apply for a Certificate of Non-Attachment of Federal Tax Lien
