What Is a Prevailing Wage Determination for PERM?

A prevailing wage determination for PERM is the minimum salary the Department of Labor’s National Prevailing Wage Center (NPWC) says an employer must offer a foreign worker being sponsored for a green card through the labor certification process. The NPWC issues the determination on Form ETA-9141 based on the occupation, the job’s requirements, and where the work will be performed. Every wage figure on the PERM application flows from this number, and an expired or misapplied determination can unwind months of work.

What Sets the Wage

The prevailing wage represents the average wage paid to workers in the same occupation in the geographic area where the job is located. Three inputs drive the final number.

  • Occupational classification. Every job is mapped to a Standard Occupational Classification (SOC) code, which links it to a specific pool of wage data. The employer proposes a code on the application, but the NPWC can reclassify the position, so the job title and duties need to line up with the code chosen.2U.S. Department of Labor.   • Geographic area. Wages for the same occupation can vary dramatically between metropolitan areas and rural regions. The determination is tied to the BLS statistical area covering the worksite address on the application.
  • Wage level. The DOL assigns one of four levels based on the complexity of the duties and the education, experience, and supervisory responsibilities the position requires. Level I reflects entry-level positions with closely supervised tasks. Level IV applies to roles requiring the highest degree of independent judgment and specialized expertise. The spread between Level I and Level IV for the same SOC code in the same area can run tens of thousands of dollars.

Because the job description drives both the SOC code and the wage level, a vague or overly broad description can push the determination to a higher level than the employer expected.

Wage Sources Beyond OEWS

The regulations allow three other sources in specific situations. If the position is covered by a collective bargaining agreement negotiated at arm’s length, the CBA rate governs and the employer cannot request a different source. An employer can also submit a private or third-party wage survey, but it must cover at least 30 workers employed by at least three employers in the area, use data collected within the past 24 months, and follow a reasonable statistical methodology. Published surveys must be the most current edition, and the NPWC rejects surveys often. For most PERM cases, though, the OEWS-based determination is what the employer receives. Private surveys tend to matter when an employer believes OEWS overstates wages for a niche role in a particular area.

How to Request One

Employers request a determination by filing Form ETA-9141 with the NPWC. The DOL strongly recommends electronic filing through the Foreign Labor Application Gateway (FLAG). The form asks for the employer’s legal name, address, FEIN, and NAICS code; the job title and a full description of duties; the minimum degree, field of study, training, experience, and any special skills required; the employer’s suggested SOC code; and the worksite address, county, and BLS statistical area. Any mandatory field left blank will block electronic submission or cause a mailed form to be returned. The job description is where most cases go sideways in practice: precision protects the SOC code and the wage level the employer is aiming for.

How Long It Takes and How Long It Lasts

Processing times fluctuate with filing volume and staffing. As of March 2026, the NPWC was working on PERM prevailing wage requests with receipt dates from December 2025, for both OEWS and non-OEWS determinations — roughly a two-to-three-month wait.6Flag.dol.gov. Processing Times

Once issued, a PWD is valid for a minimum of 90 days and a maximum of one year from the determination date, with the exact window stated on the determination itself.1eCFR. 20 CFR 656.40 – Determination of Prevailing Wage for Labor Certification Purposes To use the wage rate, the employer must either file the PERM application or begin the required recruitment before the window closes. Miss it, and the process restarts with a new ETA-9141.

Recruitment itself typically runs 60 to 90 days between placing advertisements, waiting the required period, and documenting results. Employers who sit on a determination can end up racing the clock. Filing the ETA-9141 early, before finalizing recruitment strategy, is the safer sequence.

Using the PWD on the PERM Filing

After the determination is in hand and recruitment is complete, the employer files Form ETA-9089, the Application for Permanent Employment Certification. The employer information on the ETA-9089 must match the ETA-9141 exactly.7U.S. Department of Labor. Form ETA-9089 General Instructions

The offered wage must equal or exceed the prevailing wage. The employer also attests, under penalty of perjury, that the wage is not based solely on commissions or bonuses unless a guaranteed base salary meets the prevailing wage, and that the employer has sufficient funds to pay the offered salary. Ability to pay is where smaller employers most often get caught. The DOL expects the employer to show it can actually pay the offered wage from the filing date through the date the worker obtains permanent residency, which can be years later. Employers with thin margins should verify their financial capacity before locking in a prevailing wage that will strain payroll.

If You Disagree With the Wage

Employers who believe the NPWC assigned the wrong SOC code, wage level, or rate can request a review under 20 CFR 656.41 before proceeding with the PERM application.1eCFR. 20 CFR 656.40 – Determination of Prevailing Wage for Labor Certification Purposes The NPWC handles that initial review, and the employer can submit supporting documentation explaining why the determination should change.

If the NPWC affirms, the employer can escalate to the Board of Alien Labor Certification Appeals (BALCA). Appeals add months to the timeline. They make sense when the difference between the expected wage and the issued wage is large enough to affect whether the employer can realistically offer the position. For marginal disagreements, most employers accept the determination and move forward rather than watch the validity period expire mid-appeal.
