If you or a dependent has a disability, the federal tax code offers a mix of disability tax credits and deductions that can lower what you owe, along with rules that keep certain disability income out of your taxable total entirely. The main pieces are the Credit for the Elderly or the Disabled, adjustments to the Earned Income Tax Credit and the Child and Dependent Care Credit, an expanded set of deductible medical and work expenses, an extra standard deduction for blindness, exclusions for SSI and VA benefits, ABLE savings accounts, and state-level property tax relief. Which ones apply depends on the type of disability, your income, and who paid for what.
The Credit Built for Disabled Taxpayers
The Credit for the Elderly or the Disabled is the federal credit aimed most directly at disabled filers. You qualify if you’re a U.S. citizen or resident alien who is either 65 or older, or under 65 and retired on permanent and total disability with taxable disability income during the year.1IRS. You calculate it on Schedule R. The starting figure is $5,000 for a single filer or head of household, $7,500 for a joint return when both spouses qualify, and $3,750 for married filing separately. If you’re under 65, that starting amount is capped at your actual taxable disability income. It’s then reduced by nontaxable Social Security, pensions, and other nontaxable income, and reduced again by half of any adjusted gross income above the threshold. The income ceilings are low. Single filers with AGI at or above $17,500, or nontaxable income at or above $5,000, are shut out. How Disability Changes the EITC
Disability affects the Earned Income Tax Credit in two ways worth knowing. Disability retirement benefits count as earned income for EITC purposes, but only until you reach minimum retirement age; after that, the payments are treated as pension income and no longer count. A child with a permanent and total disability can be claimed as a qualifying child for the EITC at any age. The normal age limits don’t apply. You’ll need a letter from a doctor, healthcare provider, or social service agency confirming the disability.3IRS. Care for a Disabled Spouse or Adult Dependent
The Child and Dependent Care Credit isn’t only for young children. A disabled spouse or adult dependent of any age who is incapable of self-care and lives with you for more than half the year qualifies.5IRS. Child and Dependent Care Credit Information The credit covers work-related care costs — expenses you paid so you could work or look for work — up to $3,000 for one qualifying person or $6,000 for two or more, at a rate between 20% and 35% depending on income.6IRS. If your spouse is disabled and unable to work, they’re treated as having earned income for each month they meet the disability criteria: at least $250 a month with one qualifying person, $500 with two or more. That keeps the earned-income rule from disqualifying households where one spouse can’t work.7IRS. Instructions for Form 2441 You claim it on Form 2441.
Deductions That Reach Further Than People Expect
Medical Expenses
If you itemize, you can deduct unreimbursed medical and dental expenses above 7.5% of your adjusted gross income.8IRS. Publication 907, Tax Highlights for Persons With Disabilities For a disabled taxpayer, the list of qualifying costs is unusually broad: wheelchairs and their upkeep, artificial limbs and teeth, hearing aids, guide dogs and other service animals, the excess cost of Braille books over regular editions, specialized telephone equipment, entrance ramps and widened doorways, and tuition at schools providing special education to address a disability. Impairment-Related Work Expenses
This one is separate and often missed. Ordinary and necessary business expenses that a disabled person needs to work satisfactorily — a workplace attendant, specialized equipment, accessible transportation to job sites — are deducted as business expenses, not medical expenses. That matters because they aren’t subject to the 7.5% AGI floor. They go on the appropriate business schedule (C, E, or F) or Form 2106.8IRS. Extra Standard Deduction for Blindness
Legally blind taxpayers who don’t itemize get an additional standard deduction. For 2025, that’s $2,000 for single filers and heads of household, and $1,600 for married filers and surviving spouses. Disability Income That Isn’t Taxed
SSI payments are not taxable.11IRS. Regular Disability Benefits FAQ All disability compensation and pension payments from the Department of Veterans Affairs are also excluded from gross income.12IRS. Publication 907, Tax Highlights for Persons With Disabilities Workers’ compensation, compensatory damages for physical injuries, and long-term care insurance proceeds are generally excludable as well.
SSDI is different. It follows the same taxability rules as regular Social Security retirement benefits, which depend on your “provisional income” — half of your Social Security plus all other income, including tax-exempt interest.11IRS. Regular Disability Benefits FAQ
- Below $25,000 (single) or $32,000 (joint): benefits are not taxed.
- $25,000 to $34,000 (single) or $32,000 to $44,000 (joint): up to 50% of benefits may be taxable.
- Above $34,000 (single) or $44,000 (joint): up to 85% may be taxable.

Employer disability plans turn on who paid the premiums. If your employer paid with pre-tax dollars, the benefits you receive are taxable. If you paid with after-tax dollars, or you irrevocably elected after-tax treatment, the benefits are excludable under IRC Section 104(a)(3).15IRS. ABLE Accounts
ABLE (Achieving a Better Life Experience) accounts are tax-advantaged savings accounts for people with disabilities. Contributions are made with after-tax dollars and aren’t federally deductible, but earnings grow tax-free, and withdrawals are tax-free when used for qualified disability expenses like housing, medical care, education, transportation, and assistive technology.17The Arc. A significant eligibility change took effect on January 1, 2026. The ABLE Age Adjustment Act, enacted as Section 124 of the Secure 2.0 Act within the Consolidated Appropriations Act of 2023, raised the maximum age of disability onset from 26 to 46.18ABLE National Resource Center. For 2026, the standard annual contribution limit is $20,000. Account owners who work and don’t participate in an employer-sponsored retirement plan can contribute additional amounts through the ABLE-to-Work provision: up to $15,650 in the continental U.S., $19,550 in Alaska, and $17,990 in Hawaii.4ABLE National Resource Center. Up to $100,000 in an ABLE account is excluded from the $2,000 asset limit for SSI, so saving in one won’t cost you SSI eligibility the way a regular bank account would.17The Arc. State Property Tax Relief
Many states offer disability-related tax relief, most often as property tax exemptions, and the specifics vary widely. A few illustrations:

Many of the biggest state property tax breaks are tied to veteran status, so if you aren’t a veteran, check your state’s general disability exemptions separately.
Paperwork and Free Help
For the Credit for the Elderly or the Disabled, if you’re under 65 you need a physician’s statement certifying permanent and total disability. It doesn’t get filed with the return, but keep it in your records. Veterans can substitute VA Form 21-0172. If a physician signed the certification in a prior year and indicated no reasonable probability of improvement, you don’t need a new one; you just certify the condition continued.2IRS.
