What Is a Conditional Resident and How to Remove Conditions

A conditional permanent resident is someone whose U.S. green card is valid for only two years because it was issued through a recent marriage to a U.S. citizen or lawful permanent resident, or through an EB-5 investment. The shorter validity gives the government time to confirm the underlying marriage or investment is genuine. To keep your status, you have to file a petition asking U.S. Citizenship and Immigration Services (USCIS) to remove the conditions during the 90 days before the card expires. Miss that window and your status ends automatically.1U.S. Citizenship and Immigration Services. Conditional Permanent Residence

Who Receives This Status

Two groups get conditional rather than standard green cards.

The first is people who immigrate through marriage when the marriage is less than two years old on the date residency is granted. This applies whether you entered on a spousal visa, a fiancĂ© visa, or through a family preference petition.2Office of the Law Revision Counsel. 8 USC 1186a – Conditional Permanent Resident Status for Certain Alien Spouses and Sons and Daughters Children who immigrate with the spouse also receive conditional status. If your children became conditional residents the same day you did, or within 90 days, they can be included on your petition. Children whose status began outside that window each need their own petition.3U.S. Citizenship and Immigration Services. Instructions for Petition to Remove Conditions on Residence

The second group is EB-5 investors. To qualify, you invest at least $1,050,000 in a new commercial enterprise (or $800,000 in a targeted employment area) and the investment must create at least ten full-time jobs for qualifying U.S. workers. Your spouse and unmarried children under 21 receive conditional status through the same petition.4U.S. Citizenship and Immigration Services. EB-5 Immigrant Investor Program

What You Can and Cannot Do With a Conditional Green Card

Legally, a conditional green card gives you the same rights as a standard ten-year card. You can work for any U.S. employer without a separate work permit; the card itself proves employment authorization.5U.S. Citizenship and Immigration Services. Employment Authorization Document You can travel internationally and return with a valid card.

You also carry the same responsibilities. You file federal tax returns and report worldwide income to the IRS. If you move, you have ten days to report the new address to USCIS, either online or by mailing Form AR-11. Failing to report can bring fines, imprisonment, or removal.6U.S. Citizenship and Immigration Services. How to Change Your Address

One thing you cannot do is renew the card. A conditional green card expires exactly two years from the date your residency was approved, and the only way to keep your status is to file to remove the conditions.1U.S. Citizenship and Immigration Services. Conditional Permanent Residence

The 90-Day Filing Window

You file the petition to remove conditions during the 90 days immediately before your card expires.2Office of the Law Revision Counsel. 8 USC 1186a – Conditional Permanent Resident Status for Certain Alien Spouses and Sons and Daughters File before that window opens and USCIS rejects the petition. Miss it and you lose your status.

Marriage-based conditional residents file Form I-751, Petition to Remove Conditions on Residence. The filing fee is $750, which includes biometric services.7U.S. Citizenship and Immigration Services. Frequently Asked Questions on the USCIS Fee Rule In the normal case, both spouses sign together in what USCIS calls a joint filing.

EB-5 investors file Form I-829, Petition by Investor to Remove Conditions on Permanent Resident Status. The filing fee is $9,525.8eCFR. 8 CFR Part 106 – USCIS Fee Schedule

Evidence You Need to Submit

The form itself is the smaller part of the job. The heart of the petition is the evidence.

For a marriage-based I-751, you’re proving the marriage is real. Stronger petitions include several kinds of documents rather than piling on one type. Useful evidence includes:

  • Joint bank, credit card, and other financial account statements
  • Residential leases or mortgage documents in both names
  • Birth certificates for children born during the marriage
  • Health, auto, or life insurance policies naming both spouses
  • Utility bills at a shared address, photographs together, correspondence addressed to you as a couple, and affidavits from people who know you both

Any document in a foreign language needs a certified English translation.

For an EB-5 I-829, you’re proving the investment stayed in place and the jobs materialized. Typical evidence includes bank statements and wire transfer receipts showing the capital remained invested, payroll records, W-2s, quarterly federal tax returns and I-9s for the enterprise’s employees, and an updated economic analysis based on actual expenditures and revenue rather than the original projections.

Filing Alone When Your Spouse Won’t Sign

Federal law recognizes three situations in which a marriage-based conditional resident can file the I-751 without the spouse’s signature. Petitions based on abuse are fee-exempt; the others carry the same $750 fee as a joint filing.7U.S. Citizenship and Immigration Services. Frequently Asked Questions on the USCIS Fee Rule

Divorce or Annulment

You can request a waiver if your marriage ended in divorce or annulment. The divorce has to be final; a pending divorce or legal separation does not qualify. You still have to show that the marriage was entered in good faith and not to evade immigration law. If you file while the divorce is still pending, USCIS will ask for the final decree before deciding.9U.S. Citizenship and Immigration Services. Waiver of Joint Filing Requirement

Abuse or Extreme Cruelty

If your spouse subjected you to physical abuse or extreme cruelty during the marriage, you can file on your own. You need to show both that the marriage was entered in good faith and that the abuse occurred. Evidence can include police reports, court records, medical documentation, photographs of injuries, restraining orders, statements from witnesses, and records from counselors or social service agencies.9U.S. Citizenship and Immigration Services. Waiver of Joint Filing Requirement

Extreme Hardship

You can also file alone by showing that removal would cause extreme hardship. Unlike the other two waivers, this one does not require proof that the marriage was entered in good faith. USCIS only considers hardship-causing circumstances that arose during the two-year conditional period, not events before or after. You do not need a qualifying relative; hardship to you alone is enough.9U.S. Citizenship and Immigration Services. Waiver of Joint Filing Requirement

If you’re filing under any of these waivers, the 90-day window doesn’t apply. You can file at any time after the qualifying event, as long as you have not already been ordered deported.

What Happens After You File

USCIS mails a Form I-797 receipt notice once it accepts the petition. That notice automatically extends the validity of your green card for 48 months beyond the printed expiration date, so you can keep living and working in the country while the case is pending.10U.S. Citizenship and Immigration Services. Form I-751 and I-829 48 Month Extension

USCIS may schedule you for a biometrics appointment for fingerprints, a photo, and a signature. Whether it does depends on the case; it isn’t automatic.3U.S. Citizenship and Immigration Services. Instructions for Petition to Remove Conditions on Residence

For joint I-751 petitions, USCIS may call both spouses to an in-person interview at a field office, where an officer asks questions and reviews evidence. USCIS can waive the interview if the written record shows a genuine marriage and there are no signs of fraud or unresolved questions. If you filed under a waiver, only you appear; your former spouse is not required.11U.S. Citizenship and Immigration Services. Chapter 3 – Petition to Remove Conditions on Residence Failing to appear for a scheduled interview automatically terminates your permanent resident status as of your two-year anniversary date.12eCFR. 8 CFR 216.4 – Joint Petition to Remove Conditional Basis of Lawful Permanent Resident Status for Alien Spouse

If USCIS approves the petition, the conditions come off and you receive a standard ten-year green card.

If You Missed the Deadline

When a conditional green card expires and no petition has been filed, permanent resident status ends on its own. You lose work authorization and the right to live in the country, and USCIS can place you in removal proceedings.1U.S. Citizenship and Immigration Services. Conditional Permanent Residence

A late petition is still possible if the delay wasn’t your fault. USCIS can accept a late I-751 when you show good cause and extenuating circumstances for the delay, and that the length of the delay was reasonable.2Office of the Law Revision Counsel. 8 USC 1186a – Conditional Permanent Resident Status for Certain Alien Spouses and Sons and Daughters Include a written explanation with the late filing describing why you couldn’t file on time. If removal proceedings are already open, the government can pause them while the late petition is considered.

Naturalization After the Conditions Come Off

Once conditions are removed, your green card carries a permanent residence date reaching back to when your conditional status began. Those conditional years count toward the continuous residence and physical presence requirements for naturalization.13U.S. Citizenship and Immigration Services. Conditional Permanent Resident Spouses and Naturalization

If you’re still married to the U.S. citizen who sponsored you, you can apply for naturalization after three years of permanent residence, including the conditional period. If you’re no longer married, or your green card wasn’t based on marriage, the standard five-year rule applies. Either way, your I-751 or I-829 has to be approved before, or at the same time as, your naturalization application. You cannot naturalize while the petition to remove conditions is still pending a decision.13U.S. Citizenship and Immigration Services. Conditional Permanent Resident Spouses and Naturalization
