Title 14 of the Code of Federal Regulations, commonly called 14 CFR, is the body of federal law that governs aviation and commercial space activity in the United States. It covers student pilots, airline crews, aircraft manufacturers, drone operators, spaceflight companies, and airline passengers. Pilot Certificates

A student pilot certificate is the entry point and has no minimum flight hour requirement, though you need one to fly solo. A private pilot certificate requires at least 40 hours of flight time, split into 20 hours of instruction and 10 hours of solo flying, plus a written knowledge test and a practical exam.6eCFR. 14 CFR 61.109 – Aeronautical Experience A commercial pilot certificate is required to fly for compensation and demands substantially more hours. Medical Standards
Part 67 sets three classes of medical certificates, matched to the type of flying you do. A first-class medical is required to exercise airline transport pilot privileges. A second-class covers most commercial pilot work. Part 68 created an alternative called BasicMed for many private pilots. Instead of an AME exam, you see a state-licensed physician, take an online medical education course, and hold a valid U.S. driver’s license. You accept operating limits in return: no aircraft over 12,500 pounds at takeoff, no flying above 18,000 feet, no faster than 250 knots, no more than six passengers, and no flying for compensation. You must also have held a valid FAA medical certificate at some point after July 14, 2006, and it cannot have been revoked, suspended, or denied.10Federal Aviation Administration. Aircraft Design and Maintenance
An aircraft needs two layers of federal approval before it can fly legally: the design must be certified, and the individual aircraft must be maintained to airworthiness standards.
Part 21 governs how the FAA approves new designs. Part 43 governs what happens once an aircraft is in service. Every repair and inspection must follow the manufacturer’s maintenance manual or FAA-accepted methods, and every task is logged.14eCFR. 14 CFR Part 43 – Maintenance, Preventive Maintenance, Rebuilding, and Alteration Most general aviation aircraft need an annual inspection at a minimum, and aircraft used for hire also need a 100-hour inspection. Miss either, and the airworthiness certificate is invalid.
General Flight Rules
Part 91 is the foundational rulebook for operating any aircraft in U.S. airspace. It applies to a student in a Cessna and to a corporate jet crew alike.15Cornell Law Institute. 14 CFR Part 91 – General Operating and Flight Rules The pilot-in-command has final authority over the aircraft and is directly responsible for its safety. In an emergency, the pilot-in-command can deviate from any regulation as needed, but the FAA may ask for a written explanation.
Part 91 sets hard altitude floors. Over cities, towns, or open-air gatherings, an aircraft must stay at least 1,000 feet above the highest obstacle within 2,000 feet horizontally. Over non-congested areas, the floor is 500 feet above the surface. Over open water or sparsely populated areas, aircraft may fly lower but must stay at least 500 feet from any person, boat, vehicle, or structure.16eCFR. 14 CFR 91.119 – Minimum Safe Altitudes: General
Part 91 also draws a firm line on impairment. Airlines and Charter Operators
Carrying passengers or cargo for hire adds a heavier regulatory layer on top of Part 91. Operating commercially without the right certification is expensive. Civil penalties for a person or company operating an aircraft for compensation can reach $42,657 per violation and $1,200,000 per enforcement action. Drone Rules
Drones have their own framework under Parts 107 and 89, and this is the fastest-growing corner of Title 14.
Part 107 governs drones weighing less than 55 pounds at takeoff. To fly under Part 107 you need a Remote Pilot Certificate, which requires passing an FAA aeronautical knowledge test. You must be at least 16 and able to read, speak, and understand English. No flight test is required. Part 89 adds Remote ID. Most drones that must be registered with the FAA also have to broadcast identification and location data in real time, functioning as a digital license plate. Older drones without built-in Remote ID can use an attached broadcast module, though this restricts them to visual line-of-sight operations.
Passenger Protections
Title 14 also protects the people riding on airlines. These consumer rules sit in Chapter II under DOT authority.
Part 250 requires airlines to pay cash compensation when they involuntarily bump you from an overbooked flight. If your rebooked arrival is one to two hours late on a domestic flight, or one to four hours late internationally, compensation is 200% of your one-way fare, capped at $1,075. Part 259 caps tarmac delays. Domestic flights must let passengers off after three hours; international flights after four. Airlines have to provide food, water, and working restrooms during extended delays. Commercial Space
Chapter III of Title 14, Parts 400 through 460, sets the licensing framework for private-sector space operations.25Federal Aviation Administration. The process involves safety reviews, environmental assessments, and proof of financial responsibility, typically through insurance, to cover potential damage to people and property on the ground. The safety standards differ from traditional aviation regulations because they account for orbital velocities and reentry heating.
Enforcement and Appeals
When someone violates 14 CFR, the FAA has several tools available. It can suspend a certificate for a fixed period, suspend it indefinitely until the holder demonstrates continued qualification, or revoke it permanently. It can also impose civil penalties reaching $100,000 per enforcement action for individuals and small businesses, or $1,200,000 for larger entities.26Federal Aviation Administration. Most cases start with an opportunity for informal resolution, essentially a meeting with an FAA attorney to see whether both sides can settle. If that fails, the FAA issues a formal order. A certificate holder who receives a suspension or revocation order has 20 days from the date of service to appeal to the National Transportation Safety Board.
