When your Chapter 13 is paid off, the court doesn’t flip a switch the moment your last payment clears. The trustee has to file a final accounting, you have to finish a debtor education course and certify that any child support or alimony is current, and then the court issues a discharge order that legally releases you from personal liability on most remaining eligible debts. From last payment to signed discharge, expect anywhere from a few weeks to several months.
From Final Payment to Discharge Order
After your last plan payment, the bankruptcy trustee prepares a report accounting for every dollar received and distributed to creditors over the three-to-five-year life of your plan.1United States Courts. Chapter 13 – Bankruptcy Basics That report confirms you met your obligations. Occasionally the final accounting shows a small overpayment. Refunds are not automatic; your attorney typically has to file a motion, so ask if you suspect a surplus.
Before the court will sign the discharge, two more boxes have to be checked. You must complete a debtor education course on personal financial management, which is separate from the credit counseling you took before filing.2United States Courts. Credit Counseling and Debtor Education Courses And if you owe any domestic support obligations, such as child support or alimony, you must certify that those payments are current.3Office of the Law Revision Counsel. 11 USC 1328 – Discharge Miss either requirement and the court will hold your discharge until you comply.
Once everything is in order, the court enters a discharge order under 11 U.S.C. ยง 1328. That order is the legal event that releases you from personal liability on the eligible debts in your plan. Hold onto the signed order; it is the document you will reach for if a creditor ever contacts you about a discharged debt.
Which Debts Are Wiped Out
The discharge eliminates your personal obligation on most unsecured debts included in your plan. Credit card balances, medical bills, and personal loans are the usual candidates. If your plan paid these creditors only a percentage of what you owed, the remaining balances disappear at discharge.3Office of the Law Revision Counsel. 11 USC 1328 – Discharge
Chapter 13 also has one powerful advantage over Chapter 7: lien stripping. If your plan stripped a junior mortgage or second lien because your home was worth less than what you owed on the first mortgage, that stripped lien was treated as unsecured debt during the case. At discharge, it is gone, and the lender must release it. For homeowners who filed specifically to deal with underwater property, this is often the whole point.
Debts That Survive
Federal law carves out categories of debt that come through a Chapter 13 untouched. You will still owe these in full after your case closes:
- Domestic support obligations, including child support and alimony.3Office of the Law Revision Counsel. 11 USC 1328 – Discharge
- Student loans, unless you successfully proved undue hardship in a separate adversary proceeding during the case.
- Priority tax obligations and taxes where a required return was never filed or was filed late.
- Debts for money obtained through fraud, false pretenses, embezzlement, or larceny.
- Criminal fines and court-ordered restitution.
- Debts arising from death or personal injury caused by driving while intoxicated.
- Civil judgments for willful or malicious injury.
- Long-term secured debts, such as a mortgage, that your plan provided for under a continuing payment schedule.
If you are not sure whether a specific debt survived, the trustee’s final report and your attorney can confirm what remains.
The Discharge Injunction
The discharge order carries a permanent court injunction that prohibits creditors from ever attempting to collect a discharged debt. No calls, no letters, no lawsuits. The protection takes effect automatically the moment the court enters the order.4Office of the Law Revision Counsel. 11 USC 524 – Effect of Discharge
If a creditor ignores the injunction, you can ask the bankruptcy court to reopen your case and address the violation. The standard remedy is civil contempt, which often results in a fine against the creditor.5United States Courts. Discharge in Bankruptcy – Bankruptcy Basics Keep your discharge order somewhere you can find it quickly. It is your proof that a collector contacting you is violating a federal court order.
Mortgages, Car Loans, and Liens
Here is the distinction that trips people up. The discharge eliminates your personal liability on a debt. It does not automatically remove a lien on your property. Liens generally survive bankruptcy unless the court specifically stripped them during the plan.6Office of the Law Revision Counsel. 11 USC 506 – Determination of Secured Status
For your mortgage, the practical result is simple: if you want to keep the house, you keep paying. There is no grace period and no renegotiation triggered by the end of the bankruptcy. Your plan likely covered ongoing mortgage payments under a long-term cure schedule, and that schedule continues without interruption.
At the end of your plan, the trustee files a notice of final cure payment for any mortgage arrears you caught up on during the case. Your servicer then has 21 days to respond, confirming whether you are current on both the arrearage and all post-filing payments, fees, and escrow amounts.7United States Courts. Form 4100N Notice of Final Cure Payment Read that response carefully. Escrow accounts frequently develop shortages during a multi-year bankruptcy because property taxes and insurance premiums shift while plan payments stay fixed. Your monthly payment may rise right after discharge to cover the gap. Budget for it.
For a car loan not fully paid through the plan, you keep paying to keep the vehicle. Once any secured debt is fully satisfied, request a lien release from the creditor to clear the title. Do not assume this happens on its own.
What Happens to Co-Signers
During your case, the co-debtor stay shielded co-signers on your consumer debts from collection.8Office of the Law Revision Counsel. 11 USC 1301 – Stay of Action Against Codebtor That protection ends when the case closes. If your plan paid the co-signed debt in full, the co-signer is clear. If the plan paid only a portion and your discharge wiped out the rest, the co-signer may still owe the unpaid balance. Your discharge releases you, not them.
This catches people off guard, especially when a parent or spouse co-signed and did not file. If you know your plan did not fully cover a co-signed debt, warn your co-signer before the case closes so they can prepare or try to negotiate with the creditor.
Taxes on the Discharged Debt
Outside of bankruptcy, canceled debt is normally treated as taxable income. Bankruptcy is the major exception. Debt discharged through a bankruptcy proceeding is excluded from your gross income, so you will not owe income tax on the forgiven amounts.9Internal Revenue Service. Publication 908 – Bankruptcy Tax Guide
There is a tradeoff. The excluded amount reduces certain tax attributes you might otherwise carry forward, such as net operating losses, capital loss carryovers, and the basis of property. You report the exclusion and any attribute reductions on IRS Form 982, filed with your return for the year of discharge.10Internal Revenue Service. Instructions for Form 982 For most Chapter 13 filers the attribute reduction has little practical effect, but file the form anyway. Skipping it can trigger an IRS notice if a creditor reports the canceled debt on a 1099-C.
Your Credit Report After Discharge
Federal law allows credit reporting agencies to list a bankruptcy case for up to 10 years from the filing date.11Office of the Law Revision Counsel. 15 USC 1681c – Requirements Relating to Information Contained in Consumer Reports In practice, the major bureaus voluntarily remove Chapter 13 cases after seven years from the filing date, not the discharge date.12Central District of California United States Bankruptcy Court. Credit Report, How Do I Get A Bankruptcy Removed From My Report Because most plans run three to five years, the notation may linger for only two to four years after your discharge.
Each discharged account should appear with a zero balance and a notation such as “included in bankruptcy” or “discharged in bankruptcy.” If a discharged account still shows a balance owed, dispute it with the credit bureau. Inaccurate reporting on discharged debts is one of the most common post-bankruptcy errors, and it drags scores down for no reason.
Waiting Periods for a New Mortgage
How soon you can qualify for a new mortgage depends on the loan program:
- FHA loans: available during an active Chapter 13 plan if at least 12 months of payments have been made on time and the bankruptcy court gives written permission for the new mortgage.13U.S. Department of Housing and Urban Development. How Does a Bankruptcy Affect a Borrowers Eligibility for an FHA Mortgage
- VA loans: available during the plan with trustee approval, or as soon as one day after discharge.
- USDA loans: no mandatory waiting period after a completed plan, provided the last 12 months of payments were on time.14USDA Rural Development. Credit Requirements
- Conventional loans (Fannie Mae): two years from the discharge date, with no exceptions for extenuating circumstances.15Fannie Mae. Significant Derogatory Credit Events – Waiting Periods and Re-Establishing Credit
Meeting the waiting period is only one hurdle. You still have to satisfy the lender’s credit score, income, and debt-to-income rules.
Rebuilding From Here
The discharge itself is the biggest step. The debt that was pulling you under is gone, and every month that passes puts more distance between you and the filing date. Passive waiting only does so much, though. A secured credit card is the usual starting point: a cash deposit backs the account, you use it for small recurring charges, and you pay the statement in full each month. The point is not to borrow. The point is to build a visible record of on-time payments. After six to twelve months of consistent use, many issuers will convert the account to an unsecured card and return the deposit.
Pull your reports from all three bureaus within a month of discharge. Confirm that every discharged account shows a zero balance, and dispute anything that does not. Check again every few months. The discharge handed you a clean foundation; what you put on top of it from here is what moves your score.
