What Happens When Your Bankruptcy Is Discharged?

When your bankruptcy is discharged, a federal court order permanently eliminates your personal obligation to repay the debts included in your case, and the creditors holding those debts lose the legal right to pursue you for them ever again. The discharge is the successful end of the case, not a dismissal. In a Chapter 7, it usually arrives about four months after you file. In a Chapter 13, it comes only after you finish a three-to-five-year repayment plan.1United States Courts. Discharge in Bankruptcy – Bankruptcy Basics

When the Discharge Order Arrives

In a Chapter 7 case, the court typically enters the discharge about 60 days after the deadline for creditors to object, roughly four months after you filed the petition.1United States Courts. Discharge in Bankruptcy – Bankruptcy Basics There is no repayment plan, so once any non-exempt assets are liquidated and the objection window closes, the case wraps up.

Chapter 13 is slower by design. You have to complete every payment your plan calls for before the discharge is entered, and plans run three to five years.2Office of the Law Revision Counsel. 11 USC 1328 – Discharge

One requirement trips people up in both chapters: you have to finish a personal financial management course before the court will grant your discharge.3Office of the Law Revision Counsel. 11 USC 727 – Discharge2Office of the Law Revision Counsel. 11 USC 1328 – Discharge Skip that course and the discharge does not enter, no matter how faithfully you handled the rest of the case.

What Creditors Can and Cannot Do After Discharge

The moment the discharge order is entered, a permanent injunction takes effect. It bars every creditor holding a discharged debt from any collection activity: phone calls, letters, lawsuits, wage garnishment.4Office of the Law Revision Counsel. 11 US Code 524 – Effect of Discharge Any existing court judgment finding you personally liable on a discharged debt is voided.

The injunction has teeth. A creditor that knowingly ignores it can be held in civil contempt, and the Supreme Court confirmed in 2019 that bankruptcy courts can impose contempt sanctions when there is no fair ground of doubt that the creditor’s conduct was prohibited. Courts can award actual damages and attorney fees to debtors forced to fight the violations.

While your case was pending, the automatic stay gave you broad, temporary protection against nearly all collection activity. The discharge injunction replaces it: narrower, because it covers only the debts actually discharged, but permanent.4Office of the Law Revision Counsel. 11 US Code 524 – Effect of Discharge

Which Debts Are Wiped Out

Most unsecured obligations qualify. Credit card balances, medical bills, personal loans, past-due utility bills, overdue rent, and certain older income tax debts are the common ones.1United States Courts. Discharge in Bankruptcy – Bankruptcy Basics

A debt generally has to appear in the schedules you filed with the court to be discharged.5Legal Information Institute. Federal Rule of Bankruptcy Procedure 1007 – Lists, Schedules, Statements, and Other Documents In no-asset Chapter 7 cases, many courts will discharge an unlisted debt anyway on the reasoning that the creditor was not harmed, but relying on that is risky. List every debt.

Even a properly listed debt can survive if a creditor files an adversary proceeding, a mini-lawsuit inside the bankruptcy case, asking the court to declare that specific debt non-dischargeable. Debts based on fraud or misrepresentation, for example, are not automatically excluded; a creditor has to raise the issue. If nobody does, those debts go with the rest.1United States Courts. Which Debts You Still Owe

Federal law carves out several categories that a discharge cannot touch. You remain personally liable for these after the case closes.6Office of the Law Revision Counsel. 11 US Code 523 – Exceptions to Discharge The main ones:

  • Domestic support obligations, including child support and alimony.
  • Most student loans, unless you can prove repaying them would impose an undue hardship on you and your dependents.
  • Recent income taxes, and taxes tied to returns that were filed late or fraudulently.
  • Debts for death or personal injury you caused while driving under the influence.
  • Criminal fines, traffic tickets, and similar penalties owed to government agencies.

Student loans deserve a second look. Starting in late 2022, the Department of Justice introduced a standardized attestation process for evaluating whether a borrower meets the undue-hardship standard.7U.S. Department of Justice. Student Loan Guidance The legal standard did not change, but the process is more consistent, and a student loan discharge is no longer as hopeless as it once was. It still requires a separate adversary proceeding.

What Happens to Property Securing a Loan

The discharge kills your personal obligation to pay. It does not erase a creditor’s lien on specific property. If a lender held a lien on your car, the discharge means you no longer owe the loan balance personally, but the lender can still repossess the car if payments stop.1United States Courts. Discharge in Bankruptcy – Bankruptcy Basics

If you want to keep a piece of secured property on its existing terms, the tool is a reaffirmation agreement, a voluntary contract in which you agree to remain personally liable for the debt in exchange for keeping the property.8United States Courts. Instructions for Director’s Form 2400A Reaffirmation Documents The agreement has to be filed with the court before the discharge is entered.9Legal Information Institute. Federal Rules of Bankruptcy Procedure Rule 4008 – Reaffirmation Agreement and Supporting Statement Reaffirming is optional and carries real risk: if you default later, the creditor can repossess and sue you for any deficiency, because you voluntarily gave up the discharge protection on that debt.

Tax Treatment of the Discharged Balances

Outside bankruptcy, forgiven debt is normally treated as taxable income. Bankruptcy is the major exception. Debt discharged in a Title 11 case is excluded from your gross income entirely.10Office of the Law Revision Counsel. 26 USC 108 – Income From Discharge of Indebtedness

A creditor may still send you a Form 1099-C reporting the canceled amount. Getting the form does not mean you owe tax on it. You file IRS Form 982 with your return for the year of the discharge, indicating the cancellation happened in a Title 11 case. A 1099-C carrying a code “A” (bankruptcy) is essentially confirming what the statute already provides.

Your Job, Your License, Your Apartment

Federal law limits certain kinds of discrimination based on your bankruptcy. Government agencies cannot deny, revoke, or refuse to renew a license, permit, or similar authorization solely because you filed or failed to pay a discharged debt.11Office of the Law Revision Counsel. 11 US Code 525 – Protection Against Discriminatory Treatment A state licensing board cannot pull your professional license over the bankruptcy alone.

Private employers cannot fire you or discriminate against you in employment solely because of a bankruptcy filing.11Office of the Law Revision Counsel. 11 US Code 525 – Protection Against Discriminatory Treatment There is a gap worth knowing: the statute addresses termination and employment discrimination, but most courts have read it as not covering a private employer’s decision to refuse to hire you in the first place. Government employers, by contrast, are barred from discriminating in hiring as well.

When a Discharge Can Be Denied or Taken Back

Discharge is not automatic. In a Chapter 7 case, the court can refuse to grant it for dishonest or obstructive conduct, including concealing or transferring property to defraud creditors, destroying or failing to keep financial records, lying under oath, failing to explain missing assets, refusing to obey a court order, or having received a Chapter 7 discharge within the previous eight years.3Office of the Law Revision Counsel. 11 USC 727 – Discharge

Even after entry, a discharge can be revoked. A trustee, creditor, or the U.S. Trustee can ask the court to take it back if it was obtained by fraud that came to light later, or if the debtor concealed property belonging to the estate. The request generally has to be made within one year of the discharge.3Office of the Law Revision Counsel. 11 USC 727 – Discharge

How Soon You Can File Again

A discharge does not give you unlimited future access to relief. Waiting periods run from the filing date of the earlier case, not the discharge date.

  • Chapter 7 after a prior Chapter 7: eight years.3Office of the Law Revision Counsel. 11 USC 727 – Discharge
  • Chapter 13 after a prior Chapter 7: four years.2Office of the Law Revision Counsel. 11 USC 1328 – Discharge
  • Chapter 13 after a prior Chapter 13: two years.
  • Chapter 7 after a prior Chapter 13: six years, unless you paid at least 70 percent of unsecured claims under a good-faith plan.3Office of the Law Revision Counsel. 11 USC 727 – Discharge

You can file a new case inside the waiting period, but the court will not grant a discharge. Some people do it deliberately to use the automatic stay while paying non-dischargeable debts through a Chapter 13 plan.

Cleaning Up Your Credit After Discharge

The bankruptcy stays on your credit report for up to ten years from the filing date.12Consumer Financial Protection Bureau. How Long Does a Bankruptcy Appear on Credit Reports Its practical drag on your score fades well before then if you work at rebuilding.

Start by pulling your reports. Free weekly reports from all three major bureaus are available at AnnualCreditReport.com.13Federal Trade Commission. Free Credit Reports Check every account that was in the bankruptcy. Each discharged debt should show a zero balance. If a creditor is still reporting a balance on a discharged account, dispute the error with the credit bureau and the creditor.14Consumer Financial Protection Bureau. How Do I Dispute an Error on My Credit Report Reporting a balance on a discharged debt arguably violates the discharge injunction, so creditors tend to correct these quickly once you push.

A secured credit card is the usual rebuilding tool. You put down a cash deposit that becomes your credit limit, use the card for small purchases, and pay it off each month. Six months to a year of on-time payments will start moving your score. Some lenders offer unsecured cards to post-bankruptcy consumers after about a year, and credit-builder installment loans work similarly. The bankruptcy on your report does not lock you out of new credit; it narrows your options and raises your interest rates in the short term.
