Turning 70 matters most for one reason: it is the last month Social Security will increase your monthly benefit for waiting. Delayed retirement credits stop accruing at 70, so filing any later leaves money on the table without raising your check. Someone who reaches 70 in 2026 and waited since full retirement age can receive up to $5,181 per month, the highest Social Security payment available. What happens when you turn 70 also reaches beyond Social Security: qualified charitable distributions from IRAs become available at 70½, driver’s license renewal rules tighten in many states, senior property tax exemptions may open up, and a handful of professions require you to retire.
Social Security Delayed Retirement Credits Stop at 70
Federal law adds delayed retirement credits to your monthly benefit for each month you postpone filing past full retirement age. For anyone first eligible after 2004, credits accrue at two-thirds of one percent per month, or 8% per year.1Office of the Law Revision Counsel. 42 USC 402 – Old-Age and Survivors Insurance Benefit Payments The credits stop the month you reach 70. Waiting longer earns you nothing extra and costs you the checks you could have collected.
The increase is permanent. Every check for the rest of your life reflects the credits you banked, and the maximum monthly benefit for a new filer at 70 in 2026 is $5,181.2Social Security Administration. What Is the Maximum Social Security Retirement Benefit Payable
Your Delay Also Protects a Surviving Spouse
Delayed retirement credits carry over to a surviving spouse or surviving divorced spouse. When you die, their survivor benefit is calculated from your primary insurance amount plus the full value of your accumulated credits.3Social Security Administration. Code of Federal Regulations 404-0313 – What Are Delayed Retirement Credits and How Do They Increase My Old-Age Benefit Amount In couples where one spouse earned significantly more, waiting until 70 locks in a higher income floor for the lower earner after the higher earner is gone.
Check Your Earnings Record First
Your benefit is based on your highest 35 years of indexed earnings, so any missing year quietly shrinks the check.4Social Security Administration. Your Social Security Statement Log into your my Social Security account, pull up your Social Security Statement, and read it year by year. Gaps are more common than most people expect, especially with older jobs or employers no longer in business. If you find one, call SSA at 1-800-772-1213. Corrections can take months, so do this well before you plan to file.
How to File at 70
You can apply online at ssa.gov. The application walks you through your personal information and lets you choose your benefit start date, and straightforward claims usually take under an hour. If you have a government pension, a claim on a former spouse’s record, or another wrinkle, book a phone or in-person appointment with a field office instead.
Processing generally takes two to four months. Social Security pays in arrears, so a July benefit arrives in August. New enrollees must use direct deposit or a Direct Express prepaid debit card; paper checks are no longer issued.5Social Security Administration. What You Need to Know When You Get Retirement or Survivors Benefits Your award letter, available in your online account, confirms the exact monthly amount and payment schedule.
If You File a Few Months Late
If your 70th birthday passes before you file, SSA allows up to six months of retroactive benefits for anyone already past full retirement age.6Social Security Administration. Delayed Retirement Credits File at 70 and a half and you can receive a lump sum for those six months. Because your credits maxed at 70, the retroactive payment does not reduce your ongoing benefit. File more than six months late and the earlier months are lost.
Taxes on a Larger Social Security Check
A bigger benefit brings a bigger tax question. The IRS taxes up to 50% of your Social Security when your combined income (adjusted gross income, plus nontaxable interest, plus half your Social Security) exceeds $25,000 for single filers or $32,000 for married couples filing jointly. Past $34,000 single or $44,000 joint, up to 85% of benefits are taxable.7Office of the Law Revision Counsel. 26 USC 86 – Social Security and Tier 1 Railroad Retirement Benefits
Those thresholds have not been adjusted for inflation since 1993, so they catch more retirees every year. A $5,000 monthly benefit combined with a modest pension or IRA withdrawal will almost certainly land in the 85% bracket. Plan around it if you have other retirement income pushing you across the line.8Internal Revenue Service. Publication 915, Social Security and Equivalent Railroad Retirement Benefits
Qualified Charitable Distributions Open at 70½
Starting at 70½, you can move money directly from a traditional IRA to a qualified charity without counting the transfer as taxable income. These qualified charitable distributions can later satisfy some or all of your required minimum distributions once RMDs begin at 73.9Internal Revenue Service. Seniors Can Reduce Their Tax Burden by Donating to Charity Through Their IRA The annual QCD limit is $111,000 per person in 2026 and adjusts for inflation.
The tax benefit is real. A regular IRA withdrawal is ordinary income and can push more of your Social Security into the taxable range described above. A QCD skips your income entirely because the custodian sends the money straight to the charity. If you already donate, routing gifts through a QCD instead of writing personal checks saves tax dollars. You must actually be 70½ on the date of the distribution, not just reaching 70½ that year, so confirm the timing with your IRA custodian before requesting the transfer.
What Isn’t Happening at 70: Required Minimum Distributions
You do not have to take required minimum distributions from a traditional IRA or 401(k) at 70. Under the SECURE Act 2.0, RMDs now start at 73 for anyone born between 1951 and 1959, and at 75 for those born in 1960 or later.10Internal Revenue Service. Retirement Plan and IRA Required Minimum Distributions FAQs This trips people up because the old rule started RMDs at 70½.
Once you reach 73, missing an RMD triggers a 25% excise tax on the amount you should have withdrawn, dropping to 10% if you fix the shortfall within two years.11Internal Revenue Service. Retirement Topics – Required Minimum Distributions (RMDs) The years between 70 and 73 are a useful planning window. You can do Roth conversions or take voluntary withdrawals at lower rates before mandatory distributions push larger taxable amounts onto your return.
Medicare If You Worked Past 65
If you kept working past 65 with employer health coverage and are retiring around 70, Medicare enrollment needs attention right away. Once you or your spouse stop working, or lose the employer coverage, whichever comes first, you have an eight-month Special Enrollment Period to sign up for Medicare Part B without penalty.12Medicare.gov. Working Past 65 Miss it and you pay a lifetime surcharge of 10% added to your Part B premium for every full year you could have enrolled but didn’t.13Medicare.gov. Avoid Late Enrollment Penalties
The standard Part B premium in 2026 is $202.90 per month.14Centers for Medicare and Medicaid Services. 2026 Medicare Parts A and B Premiums and Deductibles One trap: COBRA does not count as employer coverage for this rule. The eight-month clock starts when employment ends, whether or not you elect COBRA afterward.
Driver’s License Renewal Rules
About 15 states prohibit drivers 70 or older from renewing online or by mail and require an in-person visit. A similar number require a vision screening at renewal for this age group, and several shorten the renewal cycle from the standard eight years down to two or three. The rules vary widely, with some states tightening as early as 65 and others waiting until 79 or 80.
The in-person requirement lets licensing staff see the driver directly. Beyond the vision test, examiners in some states can require a written knowledge test or a road test if they have reason to. If you skip an in-person renewal your state requires, the license simply expires. Check your state DMV website ahead of your renewal date, because the rules for older drivers often differ from what you did last time.
Senior Property Tax Exemptions
Many local governments offer property tax exemptions or assessment freezes for homeowners who meet age and income limits. These typically cut the taxable assessed value of a primary residence by a fixed amount, or freeze the assessment so the tax bill doesn’t rise with property values. Exemption amounts range from a few thousand dollars to six figures, and income limits vary.
Most programs require you to apply; the exemption is rarely automatic. Expect to provide proof of age, proof that the home is your primary residence, and household income documentation such as a federal tax return or Social Security award letter. Some programs qualify you at 65, others at 70 or later. Contact your local assessor’s office to find out what’s available and when to apply. Miss the deadline and you usually wait a full year.
Jobs With Mandatory Retirement at 70
The Age Discrimination in Employment Act generally bars employers from forcing workers out because of age, but a few categories are exempt. State judges are the most visible: many state constitutions require them to retire at 70. The U.S. Supreme Court upheld those provisions in Gregory v. Ashcroft, finding that age limits for state judges violate neither the ADEA nor the Equal Protection Clause.15Cornell Law Institute. Gregory v. Ashcroft, 501 U.S. 452 (1991)
Federal law also carves out state and local firefighters and law enforcement officers. Governments can set mandatory hiring and retirement ages for those positions under a bona fide retirement plan meeting specific statutory requirements.16Office of the Law Revision Counsel. 29 U.S. Code 623 – Prohibition of Age Discrimination Commercial airline pilots face an absolute ceiling at 65 under federal aviation law, earlier than the other professions here and applied regardless of fitness or record.
