Walking away from a federal job before you’re retirement-eligible sets off a chain of decisions about your pension contributions, Thrift Savings Plan balance, insurance coverage, and final paycheck. Leaving federal service before retirement doesn’t erase what you’ve built, but the choices you make in the weeks around your last day determine how much of it you keep. The single biggest call is whether to cash out your retirement contributions or leave them in place for a future annuity. Everything else follows from there.
Refund or Deferred Annuity
Once you’ve been separated for at least 31 consecutive days, you can apply for a lump-sum refund of the retirement contributions withheld from your paychecks under either FERS or the older CSRS.1Office of the Law Revision Counsel. 5 USC 8424 – Lump-Sum Benefits; Designation of Beneficiary; Order of Precedence The refund covers only what came out of your pay, plus any voluntary deposits and interest. For FERS service beyond one year, interest compounds annually at a rate tied to government securities yields. CSRS service earns a flat three percent.3U.S. Office of Personnel Management. Former Employees Because of the interest, the refund is usually larger than the sum of your paycheck deductions.
Here is the trap. Taking the refund erases the service time those contributions represent. If you come back to federal work later and want that time to count toward a pension, you have to redeposit the full amount plus interest. The alternative, if you have at least five years of creditable civilian service, is to leave your money alone and collect a deferred annuity.
How the Deferred Annuity Works
With five or more years of creditable civilian service under FERS, leaving your contributions in the system entitles you to a monthly annuity beginning at age 62.4Office of the Law Revision Counsel. 5 USC 8413 – Deferred Retirement CSRS uses the same five-year floor and age-62 start.5Office of the Law Revision Counsel. 5 USC 8338 – Deferred Retirement Payments continue for life.
The formula: one percent of your “high-3” average salary for each year of creditable service. Your high-3 is the highest average basic pay across any three consecutive years, usually your final three. It includes locality pay, not overtime or bonuses.6U.S. Office of Personnel Management. Computation Twelve years at a high-3 of $95,000 works out to roughly $950 per month starting at 62. Guaranteed for life, and hard to replicate by investing a refund on your own.
The MRA+10 Option
FERS employees who separate with at least 10 years of service get an extra choice. At your Minimum Retirement Age (55 to 57 depending on birth year), you can start the deferred annuity early. The cost is a five-percent reduction for each year you are under 62 when payments begin.4Office of the Law Revision Counsel. 5 USC 8413 – Deferred Retirement You can also postpone payments to any date between your MRA and 62 to shrink or eliminate the penalty.
Start at 57 with an MRA of 57 and you lock in a 25-percent reduction for life. Wait until 60, and the reduction drops to 10 percent. Wait until 62, and it disappears. Run this math before you file, because early payments freeze the lower amount permanently.
Survivor Protection Before the Annuity Starts
If you die after separating but before your deferred annuity begins, your surviving spouse can receive a survivor annuity only if you completed at least 10 years of service and were married at the time of separation.7Office of the Law Revision Counsel. 5 USC 8442 – Rights of a Widow or Widower With fewer than 10 years, your spouse would receive only the lump-sum credit. This matters if you are close to the threshold.
Your TSP Account After You Leave
Your Thrift Savings Plan balance belongs to you either way. Agency automatic and matching contributions stop, but the balance stays invested. After separation, you have three basic paths:
- Leave it in the TSP and use its withdrawal options: partial distributions of at least $1,000, fixed-dollar installments, or a life annuity through the TSP’s vendor.8Thrift Savings Plan. Withdrawals in Retirement
- Roll it over directly to an IRA or a new employer’s 401(k) with no immediate tax hit.
- Cash it out, in which case federal income tax applies, plus a 10-percent early withdrawal penalty if you are under 59½.9Internal Revenue Service. Retirement Topics – Exceptions to Tax on Early Distributions
Very small balances may be automatically distributed to you as a single payment under a threshold set by regulation.
If You Have an Outstanding TSP Loan
An unpaid TSP loan turns into a problem the day you separate. If you don’t repay it, the remaining balance is treated as a taxable distribution, with income tax owed on the full outstanding amount plus the 10-percent penalty if you are under 59½.10Thrift Savings Plan. Tax Rules About TSP Payments You can avoid the tax by rolling the taxable amount into your TSP or another eligible plan using personal funds, but the rollover must be complete by the due date of your federal return for that year. Health, Life, and Other Insurance
Your Federal Employees Health Benefits coverage keeps running for 31 days after your enrollment ends, at no cost to you.11U.S. Office of Personnel Management. TCC keeps you in the same plan, but you pay the full premium (both the employee and government shares) plus an administrative charge of up to two percent.12Office of the Law Revision Counsel. 5 USC 8905a – Temporary Continuation of Coverage For most plans, that roughly triples what you were paying. FEGLI
Federal Employees’ Group Life Insurance also carries a 31-day extension after separation.13Bureau of Indian Education. Separated Employee During that window you can convert to an individual policy with no medical exam and no health questions.14Office of the Law Revision Counsel. 5 USC Chapter 87 – Life Insurance Individual premiums are based on age and coverage amount and will run higher than payroll rates, but the guaranteed-issue feature is valuable if your health would make new coverage expensive or unattainable.
Dental, Vision, and FSAs
FEDVIP dental and vision coverage ends at the close of the pay period in which you separate. No 31-day extension, no continuation option, no conversion right.15eCFR. 5 CFR Part 894 Subpart F – Termination or Cancellation of Coverage It works differently from FEHB and FEGLI, which is where people get caught. Line up replacement coverage before your last day.
A Health Care Flexible Spending Account terminates on your separation date. Expenses incurred before that date remain reimbursable; anything after does not, even if you already had allotments deducted. A Dependent Care FSA is more forgiving: the remaining balance can continue reimbursing eligible expenses until it runs out or the calendar year ends, whichever comes first.16FSAFEDS. Your Annual Leave Payout
All accumulated and accrued annual leave is paid as a lump sum when you separate.17Office of the Law Revision Counsel. 5 USC 5551 – Lump-Sum Payment for Accumulated and Accrued Leave on Separation The calculation projects the leave forward as if you had stayed and used it, so it reflects basic pay, locality pay, and certain other pay elements like special rate supplements. For taxes, the payout is supplemental wages. Federal income tax is withheld at a flat 22 percent (37 percent if your supplemental wages for the year exceed $1 million), and Social Security and Medicare apply on top.19Internal Revenue Service. Publication 15, Employer’s Tax Guide The payment typically arrives in the pay cycle following your separation date. A large balance produces a real tax hit, so plan for it.
Sick Leave Has No Cash Value
Sick leave doesn’t pay out. It stays on the books. Come back to federal service at any point in the future, with no time limit on the break, and your balance is re-credited in full.20eCFR. 5 CFR 630.502 – Sick Leave Recredit
If you eventually qualify for a FERS annuity, unused sick leave also adds to creditable service in the computation. A large balance can add months or more to your service credit. Taking a refund wipes out that sick-leave value along with everything else, which is one more reason to weigh the refund choice slowly.
Repaying Incentives and Federal Debts
If you signed a service agreement for a recruitment or relocation incentive, leaving before it ends triggers repayment. When an employee fails to fulfill the agreement’s terms, the agency must terminate it.21eCFR. 5 CFR 575.111 – Termination of a Service Agreement The amount owed depends on your agency’s policy and the original terms. Termination is not grievable or appealable.
Outstanding federal debts, including overpayments, travel card balances, and amounts owed under a terminated incentive agreement, can be collected by administrative offset against your final paycheck or your retirement refund. Review your Leave and Earnings Statements in your last months and clear anything you can before it’s deducted for you.
Unemployment for Former Federal Employees
Former feds who lose their jobs through no fault of their own may qualify for benefits under the Unemployment Compensation for Federal Employees program. States administer UCFE using their own rules and amounts, based on your last official duty station, and the federal government reimburses the state dollar for dollar.22U.S. Department of Labor. Voluntary resignation generally disqualifies you. A reduction in force, reorganization, or elimination of your position generally does not. Eligibility and weekly amounts vary by state; contact your state unemployment office after separation.
Resignation Paperwork and Records to Keep
A voluntary resignation goes through Standard Form 52, the Request for Personnel Action, which captures your effective date, reason for leaving, and forwarding address.23Office of Personnel Management. Be specific and straightforward, and submit the form to your supervisor or HR.
Before your last day, pull everything you can from your electronic Official Personnel Folder. System access usually cuts off within hours of your final shift. Save several months of Leave and Earnings Statements as proof of pay, deductions, and withholdings; you’ll need them for future employers and for any retirement refund application.
Weeks later, a Standard Form 50, Notification of Personnel Action, arrives at your forwarding address.24Bureau of Indian Education.
