What Happens If You Divorce on a Conditional Green Card?

If you divorce on a conditional green card, you can still get a permanent 10-year card, but you have to file Form I-751 by yourself and ask USCIS to waive the requirement that you and your spouse file jointly. The waiver most divorced conditional residents use is the good faith marriage waiver: you show the marriage was real when you entered it, even though it later ended in divorce. Approval leads to the same 10-year card a joint filing would have produced.

Why Your Status Is at Risk After Divorce

A green card issued through a marriage less than two years old is conditional and expires after two years. To convert it to a 10-year card, federal law normally requires you and your spouse to file a joint I-751 petition in the 90 days before your second anniversary as a permanent resident, proving the marriage is genuine.1Office of the Law Revision Counsel. 8 USC 1186a – Conditional Permanent Resident Status for Certain Alien Spouses and Sons and Daughters

If nothing is filed, your permanent resident status automatically terminates on the two-year anniversary and USCIS can place you in removal proceedings.1Office of the Law Revision Counsel. 8 USC 1186a – Conditional Permanent Resident Status for Certain Alien Spouses and Sons and Daughters Divorce doesn’t stop that clock. Filing on your own with a waiver request is what preserves your status.

The Waiver That Fits a Divorce

Federal law allows a solo I-751 filing on any of three grounds, and you only need to qualify under one. For divorce, the relevant one is the good faith marriage waiver: you show that you entered the marriage with genuine intentions rather than to get around immigration law, and that the marriage was legally terminated by divorce or annulment.2U.S. Citizenship and Immigration Services. USCIS Policy Manual Volume 6 Part I Chapter 5 – Waiver of Joint Filing Requirement The officer is looking at what the marriage was during its life, not at why it fell apart.

One requirement matters most: the divorce must be final before USCIS will approve the waiver. A pending divorce or legal separation isn’t enough. If your conditional card is about to expire while the divorce is still working through the courts, you can file the I-751 now and submit the final decree when USCIS asks for it.

Two other waivers exist and may fit some readers better than the divorce-based one. If your U.S. citizen or lawful permanent resident spouse battered you or subjected you or your child to extreme cruelty, you can seek a waiver on that ground.3eCFR. 8 CFR 1216.5 – Waiver of Requirement to File Joint Petition to Remove Conditions by Alien Spouse There is also an extreme hardship waiver, though the standard is high and it’s harder to win.2U.S. Citizenship and Immigration Services. When to File

Unlike a joint petition, a waiver-based I-751 isn’t tied to the 90-day window before your card expires. You can file it any time before your conditional status expires.4U.S. Citizenship and Immigration Services. When to File Your Petition to Remove Conditions If your divorce is finalized a year into your conditional residence, you can file the next day.

Filing early has a practical benefit. Waiver cases often take well over two years to process. Your receipt notice extends the validity of your green card for 48 months past its printed expiration date, keeping you authorized to work and travel while USCIS reviews the case.5U.S. Citizenship and Immigration Services. If your conditional status already lapsed because you missed the window, a late filing is still possible if you can show good cause and extenuating circumstances for the delay. USCIS decides these on a case-by-case basis with no guarantee.1Office of the Law Revision Counsel. 8 USC 1186a – Conditional Permanent Resident Status for Certain Alien Spouses and Sons and Daughters

Proving the Marriage Was Genuine

A good faith waiver stands or falls on documentation. Thin packages with a few photos and one affidavit are the ones that draw denials and requests for more evidence. The stronger the paper trail of a life shared with your former spouse, the harder it is for an officer to doubt the marriage was real.

Financial Records

Financial entanglement is some of the most persuasive evidence because it shows two people trusting each other with money. Useful items include joint bank statements showing regular activity, jointly filed tax returns, insurance policies naming each other as beneficiaries, shared lease or mortgage agreements, joint credit card accounts, and co-signed loans.6U.S. Citizenship and Immigration Services. A Shared Home and Daily Life

Utility bills at a shared address with both names, a lease listing both spouses, and photographs across the length of the marriage help build the picture of a couple actually living together. Photos are more persuasive when they include family, friends, and holidays over time than when they look like a single staged session. Birth certificates for children born during the marriage carry significant weight.6U.S. Citizenship and Immigration Services. Instructions for Petition to Remove Conditions on Residence

Affidavits

USCIS requires sworn statements from at least two people who knew you and your spouse during the marriage and can speak from personal knowledge. Each affidavit should include the person’s full name, address, date and place of birth, how they know you, and specific observations about the relationship. Detailed accounts of holidays together, visits with each other’s families, or how you supported each other through hard times carry more weight than generic praise. USCIS may call these people in to testify, so choose people who will stand behind what they wrote.6U.S. Citizenship and Immigration Services. Filing Form I-751 on Your Own

Form I-751 is the same form used for joint filings, but you complete it differently when filing alone. In Part 3, you select the checkbox matching your waiver ground. For a divorce, that’s the box for a marriage entered in good faith but later terminated.7U.S. Citizenship and Immigration Services. I-751, Petition to Remove Conditions on Residence

Your package should include:

  • The completed Form I-751, signed and dated, with the waiver box checked in Part 3.
  • A copy of your conditional green card, front and back.
  • A complete copy of your final divorce decree.
  • Your good faith evidence: financial records, photos, affidavits, and the other documentation described above.
  • The current filing fee, which covers biometrics; check the USCIS fee schedule because amounts change.

Mail the package to the USCIS lockbox that handles your state of residence. The correct address is listed on the USCIS I-751 filing instructions page; sending it elsewhere causes delays.

What Happens After You File

USCIS sends Form I-797C, a receipt notice, confirming your filing.8U.S. Citizenship and Immigration Services. Form I-797C Notice of Action Keep it. Presented with your expired green card, the notice shows that your permanent resident status is extended 48 months past the card’s expiration date, and you remain authorized to work and travel during that window.5U.S. Citizenship and Immigration Services. USCIS Extends Green Card Validity for Conditional Permanent Residents with a Pending Form I-751

USCIS will schedule a biometrics appointment where your fingerprints and photograph are taken for background checks. Missing it without rescheduling can jeopardize the case.

If the officer needs more information, you’ll get a Request for Evidence with a deadline. RFEs are common in waiver cases, especially when the divorce wasn’t yet final at filing or when the officer wants more good-faith proof. Respond by the deadline; failure to respond results in denial.9U.S. Citizenship and Immigration Services. USCIS Policy Manual Volume 6 Part I Chapter 3 – Petition to Remove Conditions on Residence

An in-person interview at a local field office is possible. In a waiver case, it centers on whether your marriage was genuine. Expect questions about how you met, daily routines during the marriage, shared finances, holidays, and interactions with each other’s families. Officers watch for consistent, lived-in answers rather than memorized ones. Bring originals of anything you submitted as a copy.

If USCIS accepts that the marriage was genuine, your petition is approved and a 10-year permanent resident card is issued. If it’s denied, USCIS terminates your conditional status and can begin removal proceedings, where you have the right to present your case to an immigration judge.9U.S. Citizenship and Immigration Services. Children on Your Petition

If your children received conditional resident status on the same day as you, or within 90 days after, you can include them on your I-751 by listing their names and A-numbers in Part 5. Your approved petition removes the conditions on their status as well.6U.S. Citizenship and Immigration Services. Instructions for Petition to Remove Conditions on Residence

Children who got conditional status on a different day, and children whose conditional resident parent has died, each need to file their own separate I-751 with their own evidence and fee.6U.S. Citizenship and Immigration Services. Instructions for Petition to Remove Conditions on Residence

Citizenship After the Waiver

Once the waiver is approved and you hold full permanent resident status, you can pursue naturalization. The three-year shortcut for green card holders married to U.S. citizens no longer applies once you’re divorced. You fall under the general five-year rule and can apply after five continuous years as a permanent resident. Time in conditional status counts, so your five years began when you first became a permanent resident, not when the waiver was approved.
